DEED OF ASSIGNMENT

THIS DEED OF ASSIGNMENT IS MADE AT PUNE ON THIS 27th DAY OF


THE MONTH OF APRIL 2023.

BETWEEN
MR. AMBADAS DEVIDAS CHIGARE,
Age : 62 Years, Occupation: Business,
PAN NO. AANPC8419L
Residing At: CTS No. 1265, SADASHIV PETH,
PUNE 411030.

Hereinafter called or referred as “THE VENDOR” (Which expression shall


unless it be repugnant to the context or meaning thereof shall mean
& include his legal heirs, executors, administrators & assigns etc.)

MR. SURESH DATTATRAY SHINDE.

Residing At: CTS No. 1413, AVISHKAR HIGHTS

Hereinafter called or referred as “THE PURCHASERS” (Which expression


shall unless it be repugnant to the context or meaning thereof shall
mean & include their heirs, executors, administrators & assigns etc.)
THE PARTY OF THE SECOND PART.

WHEREAS

(A) All that property bearing City Survey No. 1115 admeasuring area
about 189.80 sq. mtrs. along with the building standing thereon
known as SHRIRAM APARTMENTS, Sadashiv Peth, within the
registration District Pune, sub registration District Haveli, Taluka
Pune city and within the limits of Pune Municipal Corporation, Pune
and which is more particularly described in the Schedule A written
hereunder and hereinafter referred to or called as THE SAID
PROPERTY'.

(B) By executing an Agreement dated 16/4/1994 and Supplementary


Agreement dated 23/3/1995, The Land Owner Mr. Bhikamchand
Raghunath Jain had agreed to sell and entrust re-development in
respect of the said land to M/s Jalan Construction Co., i.e. Promoter/
Builder herein on the terms and conditions and for the consideration
as stated therein and in pursuance of that has executed Power of
Attorney dated 16/4/1994 and has appointed Mr. Govind Gajanan
Jalan as his constituted attorney.
(C) The said land being land with building, was and is not vacant plot of
land as defined under Urban Land (Ceiling and Regulation) Act 1976.
(D) The Promoter obtained Commencement Certificate No.1966 dated
23/08/1996 has sanction to the building plans from the Pune
Municipal Corporation, for the building which was under
construction on the said land, after demolishing the then structure
standing therein and is revised from time to time and lastly vide
Commencement Certificate No. 1384 dated 7/06/1995. The Promoter
had commenced, continued and completed the construction of the
building which is constructed in the said property and obtained
Completion Certificate vide Completion Certificate No.3957 dated
18/03/1997 in respect of the building standing in the said property.
(E) The Promoters by executing Deed of Declaration dated 7/12/1999
have submitted the said property, which is more particularly
described in the Schedule- A written hereunder and formed an
Association of Apartments under The Maharashtra Apartment
Ownership Act, 1970 and rules made thereunder and which Deed of
Declaration is duly registered in the Office of the Joint Sub Registrar

Haveli No. l on 3/02/2000 under its Serial No. 865/2000, hereinafter


referred to or called as "THE SAID DECLARATION",

F) As per Maharashtra Apartment Ownership Act (Regulation of the


Promotion of Construction, Sale, Management and Transfer) Act,
1970, the said Promoters/Developer i.e. M/s. Jalan Construction Co.
sold the said Flat to MR. AMBADAS DEVIDAS CHIGARE i.e. Vendor
herein. The Said agreement has been registered in Sub Registrar
Haveli No. 1 at Serial No 3909/2005 dated 02.07.2005. which is more
particularly described in Schedule - B written hereunder and
hereinafter for the sake of brevity and convenience referred to
particularly described in the or called as "THE SAID FLAT".

G) Now the Vendor is absolutely seized and possessed of and otherwise


well and sufficiently entitled to the said Flat.

H) the property is very old and not suitable for vendor; hence it was
decided by vendor to sold it out.

I) the Purchasers on coming to know about the intention of the Vendor,


approached the Vendor and showed their willingness to purchase the
said Flat.

NOW THEREFORE THIS DEED OF ASSIGNMENT WITNESSETH AND


IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES
HERETO AS UNDER:-

1. In consideration of Rs. 35,00,000/- (RUPEES THIRTY FIVE


LAKHS ONLY.) paid by the purchaser to the vendor as per details
given in the Schedule 'C' written hereunder the receipt whereof the
Vendor doth hereby admit and acknowledge and exonerate the
Purchaser and the same being entire consideration of the said FLAT
more particularly described in the Schedule 'B' written hereunder.
The Vendor doth here by and forever grant, convey, transfer and

assure to the Purchaser the entire Flat together with all fittings,
fixtures, and together with undivided share in the entire land
common areas and facilities and TO HAVE AND TO HOLD the entire
premises and all the singular and the other facilities herein granted,
released, and assured UNTO AND TO THE USE OF the Purchaser
forever. The Vendors have handed over vacant and peaceful
possession of the said Flat to the Purchaser at the time of Execution
of this Deed.

2. The Purchaser shall henceforth pay all rents, taxes and rates of
Pune Municipal Corporation and Government chargeable upon the
said premises and the land or become payable in respect thereof.

3. The Vendor hereby further covenants with the Purchaser that they
have full power and absolute authority to grant, convey, release,
assure to the Purchaser, to sell and dispose of the said premises in
favor of the Purchaser and the Purchaser may at all times hereafter
peaceably and quietly occupy, possess and enjoy the said premises
and to receive benefits without any interruption, claim or demand
whatsoever from the Vendor or their legal heirs, representatives etc.
or from any person claiming any right, title interest of and from
them.

4. The Vendor hereby further convents that they shall and will from
time to time hereafter at the request and cost of purchasers do and
execute or cause to be done and executed all such further Deeds and
Documents and other lawful reasons, acts Deeds, Matters and
things assurances in law whatsoever for further and more perfectly
and absolutely granting assuring the said premises hereinabove
granted unto the Purchaser and to the use of the Purchaser in the
manner aforesaid as shall or may be reasonably required and the
Vendor hereby further covenants with the Purchasers that they have
not done, omitted or knowingly and willingly suffered or been party
or privy to any Act, Deed or things hereby they are prevented from

granting and conveying the said premises in the manner aforesaid or


whereby the same or any part thereof is charged, encumbered or
prejudicially affected in estate, tile or otherwise however.

5. The Vendor hereby agrees to keep the Purchaser saved, defended,


kept harmless and indemnified from and against all estate, charges,
encumbrances whatsoever either already created or to be created or
to be hereinafter made and executed, occasioned suffered by the
Vendor or by any other person or persons lawfully and equitably
claiming by, from the under or in trust for them.

6. The Purchasers may transfer all their rights, title and interest in the
Said Flat together with their rights, title and interest and undivided
share in the common areas and facilities by way of sale, gift, lease
exchange or otherwise any manner to the same extent and subject to
the same rights, privileges/obligations, liabilities, etc. as in any
other immovable property. However, the Purchasers and their
transferees shall not claim partition or division of any part of the
common areas and facilities or the property mentioned in the
Schedule 'B' written hereunder.

7. This Deed of Assignment shall always be subject to the provisions of


the Maharashtra Flat Ownership Act, 1970 and the rules made there
under/Said Act and their rule made there under.

8. The Vendor has handed over All the original documents of the title to
the Purchaser.

9. The vendor also represented that:


a) The said Flat is his self-acquired property and that no one else has
any rights, title or interest therein.
b) The said flat is free from any encumbrances & mortgages and there
is no litigation pending in respect of the said property in any court.
c) That he has absolute authority to transfer and sell the said
apartment in favour of the Purchaser.

10. The stamp duty of Rs 4,00,000/- and the Registration Fees Rs.
30,000/- has to paid by Purchaser done.

SCHEDULE- A DESCRIPTION OF THE SAID PLOT


All that piece and parcel of land lying, being situated at Sadashiv
Peth, Pune bearing City Survey No. 1115 admeasuring about 189.80
sq.mtrs. along with the building standing thereon known as
"SHRIRAM APARTMENTS within the registration District Pune, Sub
Registration District Haveli, Taluka Pune City and within the limits of
Pune Municipal Corporation, Pune, and which property bounded as
follows:

On or towards East : CTS. No.1114, Sadashiv Peth, Pune


On or towards South : P.M.C. Road
On or towards West : CTS No.1116, Sadashiv Peth, Pune
On or towards North : CTS No. 1075, Sadashiv Peth, Pune

SCHEDULE- B DESCRIPTION OF THE SAID FLAT:

All that Flat No. 5, situated on Third Floor, admeasuring about 51.56
Sq. Mtrs. built up (i.e. Builtup area of 554.00 Sq. Ft.) as per
sanctioned plan, in the building known as 'SHRIRAM APARTMENTS',
along with 10.80% proportionate undivided share in the property
bearing City Survey No. 1115, Sadashiv Peth, within the registration
District Pune, Sub registration District Haveli, Taluka Pune City, and
within the local limits of Pune Municipal Corporation. which is
Without any Car Parking allotted, along with the all the rights,
interest, benefit attached thereto.
