LEGAL NOTICE

Under the instructions of my client Smt. Shylaja Prabhu,


Daughter of Sri. Prabhakar Prabhu, residing at Flat No. F01,
2nd Floor, Tuscan Infinite, 1st A Cross, Chenna Kesava Layout,
Kacharakanahalli, Bengaluru, Karnataka – 560084, I do hereby
issue this notice to you as hereunder: -

1. My client states that you and my client have been friends


for about 15 years, since the time that my client bought
an apartment at the Tuscan Infinite Apartment.

2. My client states you have illegally constructed an


additional bathroom and a room on the terrace of the
building without obtaining the necessary permissions from
appropriate governing bodies and further, without my
client’s consent and knowledge, as my client is also a
part owner of the Common Area as per the sale deed.

3. My client states that such an illegitimate construction
has compromised the structural integrity of the Apartment
Complex. This act has also resulted in damages to my
client’s flat such as water leakage, cracks and seepage
in the bathroom roof, tiles, floors, taps and walls,
peeling of paint and moisture in walls, etc. This has
also violated the building byelaws and the terms and
conditions of the sale deed.

4. My client further states that you have been running an


illegal catering business and cats breeding business,
from your penthouse, which has created security issues
for my client and other residents of the building. My
client further states that you have allowed innumerable
entries and exits of strangers through the elevators and
stairway of the Apartment Complex at odd hours, usually
after 10 pm on most weekdays and often on weekends,
putting the safety and the security of fellow residents
at grave danger. Furthermore, you have also left the
gates of the apartment complex wide open for stray dogs
and rats who feast on garbage, gnawing on electrical
wiring in my client’s car and bike leading to frequent
repair and service. This has endangered the safety,
privacy and exposed my client and other residents of the
apartment to health and fire hazards.

5. My client states that you have been misusing the common


amenities like water, electricity, elevator, parking lot
and other amenities for your personal and commercial
purposes. My client further states that you have been
consuming excessive water and electricity for your
catering business as well as to your cats breeding

business, which has resulted in higher bills and lower
supply for my client and other residents. Furthermore,
you have also been occupying more than your allotted
parking space and have given constant trouble to my
client if they try and question you on the same.

6. My client states that you have been spilling dirty water


into my client’s bedroom windows by watering your potted
plants on the terrace, resulting in annual maintenance
issues such as scraping paint and plastering, repainting
wall leakages and installation of shades on windows and
balcony. Further, you have been turning off the main
water supply valves on the Apartment terrace,
interrupting and preventing water supply to client’s
apartment, thereby taking away my client’s necessities
and causing a grave deal of stress to my client.

7. My client states that you have time and again been using
bad language and have made derogatory remarks based on my
client’s single status. You have been spreading false
rumours about my client’s character to helping staff,
thereby tarnishing her reputation.

8. My client further states that you have not allowed my


client to reside and live peacefully within her own home
and caused constant problems to my client and her mother.
Furthermore, my client states that your son and his
friends even attempted to film a video of my client when
they were sitting in their balcony and even went on the
boast about the same to fellow residents and owners.

9. My client states that you have been making sudden loud
noises by banging your grill gates which are a part of
the illegal extension that you made on the terrace of the
apartment complex, without any notice to any of the
governing. Further, on multiple occasions my client has
approached you and your family regarding loud noise
caused by you and family during late hours of the night
usually after 10 pm every night, disturbing and
eventually causing a great deal of stress and health
complications to my client and her mother.

10.My client states that she has tried to resolve the


aforementioned issues amicably with you on several
occasions, but you have ignored and refused to cooperate
with my client. You have also threatened my client saying
that there would be consequences if my client tried to
approach any authorities and have threatened her to say
that you are well versed with laws of the land and are in
constant touch with influential people. Further, you have
also made it very clear to my client that you have
influential background and any kind of confrontation with
you would result in damage caused to my client. Thereby,
you have shown no regard for the law and the rights of
other residents.

11.Therefore, I hereby demand that you immediately stop all


the illegal and unlawful activities mentioned above and

restore the terrace to its original condition, failing
which you will be liable to face legal consequences and
appropriate action from the enforcement department.

You are liable to pay a sum of Rs.25,000/- (Rupees


Twenty-Five Thousand Only), towards the charges of this
legal notice.
