AFFIDAVIT TO CANCEL LIEN UNDER

SEC. 4, RULE 74 OF THE RULES OF COURT

WE, SPS. ALDWIN VICENTE O. RECINTO married to HERAN A. RAHMAN

NORDE , both of legal ages, Filipino Citizen, and resident of Brgy. Pinagtung-ulan, San
Jose, Batangas, after having been duly sworn to in accordance to law hereby depose and
say:

1. THAT WE, the registered owner of a parcel of land together with all the
improvements thereon found thereon if any, consisting of THREE
HUNDRED (300) SQUARE METERS, more or less, covered and embraced
by TCT No. 171937, situated at Brgy. Pinagtung-ulan, San Jose, Batangas,
Sto. Tomas, Batangas and particularly described as follows:

A parcel of land (Lot 9511-B of the subdivision plan Psd-04-199547,
being a portion of Lot 9511, Cad-464-D, San Jose Cadastre, LRC Record
No. ), situated in the Brgy. of Pinagtung-Ulan, Municipality of San Jose,
Province of Batangas. Bounded on the SW., along line 1-2 by Barrio Road; on
the NW., along line 2-3 by Provincial Road; on the NE., along line 3-4 by Lot
9510, Cad-464-D San Jose Cadastre; on the SE., along line 4-1 by Lot 9511-A
of the subdivision plan. Beginning at a point marked “1” on plan, being N. 26
deg. 30'W., 5553.44 m. from BLLM No. 1, Cad-464-D, San Jose Cadastre.
Thence.…………, containing an area of THREE HUNDRED (300)
SQUARE METERS, together with all the improvements existing and to be
introduced or constructed thereon. Registered in the name of ALDWIN
VICENTE O. RECINTO married to Heran A. Rahman Norde, of legal
age, Filipino and resident of Brgy. Pinagtung-Ulan, San Jose, Batangas.

2. THAT pursuant to the Rules of Court, annotation of encumbrance was made

at the face of said Title, to answer for whatever claims might be presented
against the said estate within two (2) years from date of inscription of said
encumbrance on March 19, 2007.

3. THAT more than two (2) years has already elapsed without any creditors’
claims having been presented against the above estate, and therefore, pursuant
to Rule 74, Sec. 1 and 4 of the Rules of Court, the said encumbrance may
accordingly be cancelled.
