MEMORANDUM OF AGREEMENT

Know all Men by These Presents:

This Memorandum of Agreement made and entered into by and between:

The DEPARTMENT OF EDUCATION, an agency of the national government

of the Republic of the Philippines, was created by virtue, particularly Batas
Pambansa Blg. 232, otherwise known as the “Education Act of 1982,” as amended
by Republic Act No. 9155, otherwise known as the “Governance of Basic
Education Act of 2001,” with its field office at Schools Division of North Cotabato
with office address at Barangay Amas, Kidapawan City represented by its Schools
Division Superintendent ROMELITO G. FLORES, CESO V. hereinafter referred to
as “DepEd”.

KASILAK DEVELOPMENT FOUNDATION, INC., a non-stock, non-profit

organization duly organized and existing under and by virtue of the laws of the
Republic of the Philippines, with offices addressed at Apartment H, Calla Lily
Apartments, Indigo Bunting Street, Belisario Heights Subdivision, Lanang, Davao
City, represented herein by its Executive Director, JOEMIL S. MONTEBON,
hereinafter referred to as “Kasilak”.

The UNIVERSITY OF SOUTHERN MINDANAO a Level IV state university, duly

created and existing under and virtue of the Laws of the Philippines, with office
and postal address at Kabacan, Cotabato, and represented in this act by
FRANCISCO GIL N. GARCIA, RPAE, Ph.D. in his capacity as President of the
University of Southern Mindanao, hereinafter referred as “USM”.

WITNESSETH:

WHEREAS, the Department of Education, Schools Division Office of

Cotabato therein strengthens projects on its interventions in strengthening better
implementation of safe and quality education among learners;

WHEREAS, the University of Southern Mindanao has manpower with

technical expertise in conducting training or capacity building in Mental Health
First Aid and Psychological assessment.

WHEREAS, the Kasilak Development Foundation, Inc. has fund in

providing training or capacity building in promoting safe and secures
environment.

Section 1. Scope of Work/Description of the Project

The Parties hereby undertake the capacity building in providing Mental Health
First Aid and Psychological Assessment of the public school teachers and schools
heads in Schools Division Office of Cotabato

Section 2. The obligation of the SCHOOLS DIVISION OFFICE OF COTABATO

The Schools Division Office of Cotabato shall have the following obligation:

1. Provide data on frequent abuses in School Division of Cotabato

2. Identify participants in the Capacity Development.
3. Conduct a theoretical assessment of the participants.
4. Prepares the liquidation and after-activity reports.

Section 3. The obligation of the KASILAK DEVELOPMENT FOUNDATION, INC.

The Kasilak Development Foundation, Inc. shall have the following obligation:

1. Provides funds for Capacity Building.

2. Facilitate the monitoring and evaluation in Mental Health First Aid Training
of Trainers (TOT).

Section 3. The obligation of the UNIVERSITY OF SOUTHERN MINDANAO.

The University of Southern Mindanao shall have the following obligation:

1. Prepares the Training Design for the Mental Health First Aid Training of
Trainers (TOT).
2. Provide expert trainers for the Mental Health First Aid Training of Trainers
(TOT).
3. Administer the conduct of Mental Health First Aid Training of Trainers
(TOT).
4. Provides a tool for Psychological Assessment and Adverse Childhood
Experiences (ACE) for the participants of the capacity building.

5. Analyze the result of the Psychological Assessment and Adverse Childhood

Experiences (ACE).
6. Provide support on Mental Health therapy.

Section 4. Amendments

No amendment or modification of any of the terms and conditions of this

Agreement shall be validated unless evidenced by a written Agreement executed
by the parties’ respective authorized representative.

Section 5. Arbitrary Clause

If any dispute or differences of any kind whatsoever shall arise between the parties
in connection with the implementation of this Agreement, the parties shall make
every effort to resolve amicably such dispute or difference by mutual agreement.

Accordingly, the parties may resort to court only after efforts to settle the dispute
amicably have been exhausted.

Section 5. Binding Effect

This agreement shall be effective immediately upon signing hereof and shall
remain in full force and effect for the duration of the activities under this
agreement unless sooner terminated in writing by either of the parties with written
consent from the other party.
IN WITNESS WHEREOF, the parties hereto have signed this Agreement on the ___
day of _______ , 2023 in USM Compound, Kabacan, Cotabato.
