1. Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as
defined in Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued
by Ministry of Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned
Ministry. If the bidder wants to avail the Purchase preference, the bidder must be the manufacturer of the offered
product in case of bid for supply of goods. Traders are excluded from the purview of Public Procurement Policy for
Micro and Small Enterprises. In respect of bid for Services, the bidder must be the Service provider of the offered
Service. Relevant documentary evidence in this regard shall be uploaded along with the bid in respect of the

1. Central Ministries/ Departments while procuring electrical appliances notified by Department of

Expenditure (DoE) shall ensure that they carry the notified threshold or higher Star Rating of Bureau of
Energy Efficiency (BEE). In this regard, DoE OM No.26/6/2012-PPD dated 21.01.2013 may also be referred
wherein appliances and threshold star rating have been circulated (copy attached against Upload Verified
and Signed TP document; OM No. 18 47 2020 -PPD.pdf (1.401 MB ))

1. Generic

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up
to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to
increase the ordered quantity by up to 25% of the contracted quantity during the currency of the
contract at the contracted rates. Bidders are bound to accept the orders accordingly.

2. Generic

While generating invoice in GeM portal, the seller must upload scanned copy of GST invoice and the
screenshot of GST portal confirming payment of GST.

3. Scope of Supply

Scope of supply (Bid price to include all cost components) : Supply Installation Testing and
Commissioning of Goods

Special terms and Conditions:

1. The scope of of work includes Supply, Installation,Testing and Commissioning of the 33 nos. of Geysers.

2. The following accessories shall also be supplied with each Geyser along with all other standard accessor
ies:
a. Anchoring bolts & nuts -4 nos.
b. Flexible corrugated Stainless-steel connectors for hot and cold water pipe
c. Non-return valve
d. Suitably rated plug top

3. All materials shall be supplied strictly as per the GeM Order specifications.
4. The items with quantity to be supplied are mentioned in Schedule of Quantity (SOQ) attached as Annex
ure-I.
5. Complete Supply, Installation, Testing and Commissioning of 33 nos. of Geysers and all other accessory

 items shall be in the scope of the supplier.
6. Geysers shall be installed at Studio Apartment, Duliajan as advised by OIL. Supplier shall make their ow
n arrangement for boarding and lodging of their working personnel during installation and commissioning.
Supplier shall make their own arrangement for storage of all supplied materials.
7. Transportation of Supplier's personnel to the site shall be Supplier's responsibility.
8. All necessary arrangements for installation and commissioning job are to be made by the Supplier inclu
ding supply of all safety appliances and tools to workmen. The Supplier will be responsible for their tools, t
ackles, materials and personnel at site till all the jobs are finally handed over to OIL.
9. Loading, unloading, shifting, etc of all the materials shall be in the scope of the supplier. Complete hand
over of the materials shall be taken by OIL only after installation and commissioning and submission of co
mpletion documents to OIL.
10. The supplier shall take all safety measures during the execution of the work. OIL will not be
responsible in any way and shall not be liable to compensate the supplier in any way for any loss of suppli
er's men and material during installation and commissioning. Supplier shall arrange all required personnel
protective equipment (PPE) like safety helmet, safety belt, safety shoes etc. for his personnel deployed for
working at site. Person without PPE will not be allowed to work at site.
11. Due to improper execution of the work or due to negligence on the part of the supplier if OIL's property
is damaged, the supplier has to compensate for such loss.
12. All the works shall be carried out as per relevant codes, practices rules and regulations. The installatio
n and commissioning works shall be carried out under direct supervision of the Supplier.
13. Installation and commissioning of all the items supplied shall be in the scope of Supplier. Any other ma
terial not mentioned in the SOQ but required for Installation & commissioning of the items shall be in the s
cope of Supplier at no extra cost. Supplier shall consider the cost of the same in the installation and commi
ssioning job.
14. Any tools/measuring instrument/equipment required like drill machine, ladder etc. shall be arranged b
y the Supplier.
15. Bidder may visit the site for actual assessment of the job before bidding.
16. Material should be adequately packed to avoid damage and ingress of water during transit.

17. Installation and commissioning to be carried out either by OEM or their designated representative.
18. Warranty:
a. Warranty of the Geyser shall be of minimum 2 (two) years and the storage tank shall be of minimum 5 y
ears from the date of handing over to OIL.
b. Supplier shall arrange for repair/ replacement of any defective parts/ items within one month of reportin
g of the failure by OIL during the entire warranty period.

19. Documents to be submitted:

I. Along with Bid documents:
a. Bidder shall Mention make and model of the offered geyser.
b. Bidder shall submit Technical data sheet and catalogue of the geyser.
c. Bidder has to fill up the attached technical evaluation sheet (Annexure-II) and upload the same with the
bid document.

II. After Installation & Commissioning:

a. Guarantee/warranty certificate duly signed by the Supplier.
b. Standard manual of the geyser.

20. Annexure-I(SOQ) , Annexure-II(Technical Evaluation Sheet) and Annexure-III(General Notes to Bidders)

are attached as Buyer uploaded ATC document. Bidder shall have to comply the same in their offer for eva
luation.

Disclaimer/अ वीकरण

The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses
on the bidding process, its outcome, and consequences thereof including any eccentricity / restriction arising in
the bidding process due to these ATCs and due to modification of technical specifications and / or terms and

conditions governing the bid. Any clause(s) incorporated by the Buyer regarding following shall be treated as
null and void and would not be considered as part of bid:-

1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum
issued by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to
exemption provided to such sellers under GeM GTC.
3. Publishing Custom / BOQ bids for items for which regular GeM categories are available without any
Category item bunched with it.
4. Creating BoQ bid for single item.
5. Mentioning specific Brand or Make or Model or Manufacturer or Dealer name.
6. Mandating submission of documents in physical form as a pre-requisite to qualify bidders.
7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process.
9. Mandating foreign / international certifications even in case of existence of Indian Standards without
specifying equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export
experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the
case may be.

Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of
this bid, they can raise their representation against the same by using the Representation window provided in
the bid details field in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer
is duty bound to reply to all such representations and would not be allowed to open bids if he fails to reply to
such representations.

In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action
