Re: Letter-Response to Nestle Philippines Inc. Resolution of Findings

Dear Business Partner,

We are writing in relation to your letter of findings that B-Mirk Enterprises Corporation
committed violation of applicable labor laws especially its wrong computation of PHILHEALTH
contributions of its employees.

In this regard, we would like to express our utmost sincerity in fixing and clarifying these issues
especially in PHILHEALTH computations to prove that we are actually using proper
computations on our PHILHEALTH in compliance with Philippine Labor Laws.

To answer your question, we would like to state that B-Mirk Enterprises Corporation is actually
correct and is using the proper formula and method in the computation of PHILHEALTH
benefits for its employees.

We hope that this letter would have answered all your concerns and will help in resolving the
issues here so that the assumed gaps will be addressed. We are hopeful in the resolution of said
issues to avoid the possibility of legal action that will take time to be resolved and wasteful of
money and resources and to avoid the possible termination of NPI Agreements.
