ANSWER
I, ALFIA MARIE ITLANAS, of legal age, Filipino and a resident of
Barangay 76-A Bucana, Ecoland, Davao City, after having been sworn to in
accordance with law, hereby deposes and says THAT:
That am the respondent in Criminal Case DOCKET NO: 12345 for the
crime of Theft under Article 308 of the Revised Penal Code;
I am executing this Counter-Affidavit as a reply and comment to the
Complaint Affidavit of CHENNIE CASTRO, that the charges against me by the
complaint are malicious and have no basis in fact on the day that she stated in
paragraph 2 in her complaint which is September 24, 2023 I did not see her in
person and I'm too busy on doing my activities.
To start with, I know that MS. CHENNIE CASTRO has a new luxury
IPhone Pro Max 15 because she is my classmate. I am aware that this loss of her
has a big impact to her financially and emotionally but i think she’s mistaken for
accusing me of being getting her phone because she has no proof that I am the
one who get it.
 I do not personally know that she attempted to resolve this matter with me
she never confronted me about this matter, in fact i don't know that she lost her
phone I just knew when I already received her complaint. As a matter of fact I did
not see any witness/witnesses in her complaint.
Last but not least, the complaint lacks any corroborating witness affidavits
to back up the complainant's concocted and categorically false account of events.
If otherwise, she would have previously included a supporting affidavit from a
reliable witness that could attest to the veracity of her claims. Due to the fact that
the complaint in question has no basis in either fact or law, it is obvious that there
is no probable cause, and it should be dismissed.
I am executing this affidavit in order to attest to all the foregoing facts and
for whatever legal purpose it may best serve.
