WITNESS

I, RACHEL GREEN-GELLER, Filipino, of legal age,


married, with address at 38 Cambridge Circle, Forbes Park,
Makati City, after having been duly sworn in accordance with
law, hereby attest that:

PRELIMINARY STATEMENT
I am executing this Judicial Affidavit, in Question and
Answer form, and hereby answer the following questions
below in support of my claims and allegations as petitioner,
in Civil Case No. 21202-MKT for Nullity of Marriage pending
before RTC Branch 28, Makati City. Consciously knowing that
I am under oath and with understanding that I may face
criminal liability for false testimony or perjury, I hereby
answer the following questions from Atty. Chandler Muriel
Bing with office address at Unit 527 Cityland 8 Condominum,
Sen. Gil Puyat Ave., Brgy. Pio Del Pilar, Makati City, who
conducted this examination in her office.

OFFER OF TESTIMONY
The following testimony of affiant RACHEL GREEN-
GELLER is being offered to prove the following:
a. That the Petitioner and the Respondent have been living
separately since January 2018;
b. That in the period of five years prior their separation,
Respondent had illicit affairs with different women;
c. That on December 2017, Respondent admitted to
Petitioner that he has been seeing a woman for almost two
years, after Petitioner saw them in a rest house in Batangas;
d. That Respondent’s behavior of being a womanizer ever
since they got married implies that he is psychologically
incapacitated to assume marital obligations which is the legal
basis for the declaration of nullity of Petitioner’s marriage with
Respondent;
e. Other matters in relation thereto.

JUDICIAL AFFIDAVIT PROPER

1. Q. Please state your name and other personal


circumstances for the record.
A. I am Rachel Green-Geller, 35 years old.

2. Q. Are you the same Rachel Green-Geller, the


petitioner in this case?
A. Yes, ma’am.

3. Q. Do you know a certain Ross Eustace Geller?


A. Yes, ma’am. He is my husband.

4. Q. When and where did you and the respondent get


married?
A. We got married on January 3, 2012 at the Manila
Cathedral, Intramuros, Manila.

5. Q. What is your proof that you and the respondent got


married on January 3, 2012 at the Manila
Cathedral, Intramuros, Manila?
A. Our marriage certificate issued by the Philippine
Statistics Authority.

6. Q. Showing you this certificate of marriage issued by


the Philippine Statistics Authority, is this the one
you just mentioned?
A. Yes, ma’am.

7. Q. Are you still cohabiting with Ross Eustace Geller?


A. No, ma’am. Ross and I have been living separately
for two (2) years now since January 2018.

8. Q. Did you have children with Ross Eustace Geller?


A. No, Ross and I have no children, ma’am.

9. Q. What was the reason of your separation?


A. Ross was unfaithful and after a year of being
married until we got separated, he has been having
illicit relationships with different women. He would
also frequently hang out with his friends and would
have no time for me and his family.

10. Q. When and where did you and the respondent first
meet?
A. I first met Ross sometime in 2007 when he worked
as a substitute professor in one of my subjects. I
was then a senior in law school at Far Eastern
University – Institute of Law.

11. Q. What happened after your first meeting?


A. Nothing much happened. I was too focused on my
review subjects to prepare for the bar so I did not
really see him in a romantic way.

12. Q. What else happened?


A. After the semester ended, he approached me and
asked if we could go out for a lunch or dinner. I told
him that I have no time for that since the bar is fast
approaching. However, due to his being insistent, I
agreed to meet him once.

13. Q. What happened next, if any?


A. After our first date, I kind of got to know him better
and I ended up having few more dates with him.
After few months of dating, he asked me if I could
be his girlfriend. I told him that I cannot be
committed to anyone and anything at the moment
except for the upcoming bar exams. He told me
that he could and would wait for me.

14. Q. What happened after that, if any?


A. After I took the bar and during the last Sunday on
November 23, 2008, I told him that I am ready to
commit in a serious relationship with him as his
girlfriend.

15. Q. What happened when you and the respondent


became sweethearts?
A. We spent more time together along with our
families and friends, ma’am. We were sweethearts
for 3 years before we got married and we have not
had any serious fights during those period aside
from his being a happy-go-lucky type of guy and
sometimes his being overly attached to his female
friends and colleagues.

16. Q. What happened after 3 years of being together?


A. On November 23, 2011, he proposed to me while
we were having a simple dinner to celebrate our
3rd-year anniversary as boyfriend and girlfriend.
We then got married on January 3, 2012 at the
Manila Cathedral, ma’am.

17. Q. How will you describe your married life with the
respondent?
A. The first year was great, ma’am. We had travel a
lot both here and abroad. We just enjoyed our first
year of being together as husband and wife.
However, after that, he started being cold and
aloof. He would spend more time with his friends.

18. Q. How did you respond to the respondent’s behavior?


A. I would sometimes question his behavior, why he
was acting the way that he do or if there was a
problem that he might want to tell me. However,
during those times he would get mad and start
yelling at me. Because of that, I would rather keep
everything to myself, ma’am.

19. Q. Were you not curious about his behavior towards


you?
A. I was, ma’am.

20. Q. What did you do, if any?


A. I talked to some of our closest friends about him.
One of our friends confessed that Ross was seeing
a woman from his office. I then confronted Ross if
such was true but he got angry and left the house
for five (5) days. I decided to go to his office and
ask him to come back to our house and that was
when I caught him being intimate with a colleague.

21. Q. What happened after you saw him with another


woman?
A. I went home and decided to leave our house to stay
at my parent’s house. Ross followed me, begged
and cried not to leave him. He said he was sorry
and that he would not do it again. After I calmed
down, we talked about it and I decided to stay.

22. Q. What happened next, if any?


A. For few months thereafter, Ross became sweet
again to me and he would spend less time to none
with his friends. He would prioritize me and our
family. However, after that, Ross became his usual
self again, moody, easily irritated and would spend
more time outside, ma’am.

23. Q. Were you not concerned that he might be having


an illicit affair again?
A. I actually was, ma’am.

24. Q. Did you find out whether he was having an affair?


A. Yes, ma’am. I found out that he was seeing a
female friend from high school and I was able to
confirm that they were having an affair after
reading their conversation in his phone.

25. Q. What happened then, if any?


A. Again, I decided to leave him for good. I stayed at
my sister’s house in Quezon City for 3 months. Ross
would regularly visit and message me saying that
he was sorry and that he would want me back in
his life again. I decided to talk to him and we were
able to patch things up, ma’am.

26. Q. Did he have any other illicit relationships after that?


A. Yes, ma’am. He had another two illicit affair, one
with a client of him and another with a woman he
met at a bar in Taguig.

27. Q. What did you do during those times when you found
out that he was again cheating on you?
A. I would do what I usually do which is to leave him.
However, in spite of his infidelities, I could not leave
him because I truly love him and I cannot picture a
life without him, ma’am.

28. Q. Why did you decide to leave him then in January


2018?
A. I finally got into my senses, ma’am. I found out in
December 2017 that he has been seeing a woman,
my bestfriend to be precise, for two years.

29. Q. How did you know about this?


A. He admitted it to me himself when I caught them
together in our rest house in Batangas alone.

30. Q. How did you feel about it?


A. I was totally devastated because the two people
that I love the most betrayed me. That was when I
realized that this man does not love me and for all
the years that we were married he was not ready
to fulfill his vow and his marital obligations.

31. Q. Do you still love the respondent?


A. No more, ma’am. I have already lost my love,
trust, and respect to him because of what he did to
me all those years. He did not love me at all and
the man that I once loved no longer exists.

32. Q. What if he comes back, asks for forgiveness and


promises to change, will you forgive and accept the
respondent again?
A. No more, ma’am because I do not love him
anymore and I am choosing myself for once.

I, DR. JOEY TRIBBIANI, Filipino, of legal age, married,


with address at 34 Washington Circle, Bel-Air, Makati City,
after having been duly sworn in accordance with law, hereby
attest that:

PRELIMINARY STATEMENT
I am executing this Judicial Affidavit, in Question and
Answer form, and hereby answer the following questions
below in support of my claims and allegations as an expert
witness, in Civil Case No. 21202-MKT for Nullity of Marriage
pending before RTC Branch 28, Makati City. Consciously
knowing that I am under oath and with understanding that I
may face criminal liability for false testimony or perjury, I
hereby answer the following questions from Atty. Chandler
Muriel Bing with office address at Unit 527 Cityland 8
Condominum, Sen. Gil Puyat Ave., Brgy. Pio Del Pilar, Makati
City, who conducted this examination in her office.

The following testimony of affiant DR. JOEY TRIBBIANA
is being offered to prove the following:
a. That the Respondent has been examined by him;
b. That he prepared a psychiatric evaluation report of the
respondent;
c. That he diagnosed respondent as suffering from
Narcissistic Personality disorder and that such condition is
permanent and incurable and ;
d. That Respondent’s behavior of being a womanizer ever
since they got married implies that he is psychologically
incapacitated to assume marital obligations which is the legal
basis for the declaration of nullity of Petitioner’s marriage with
Respondent;
e. Other matters in relation thereto.

JUDICIAL AFFIDAVIT PROPER

1. Q. Please state your name and other personal


circumstances for the record.
A. I am Dr. Joey Tribbiani, 47 years old.

2. Q. What is your occupation?


A. I am a clinical psychologist from Makati Medical
Center, ma’am.

3. Q. Do you know a certain Ross Eustace Geller?


A. Yes, ma’am. I conducted a psychiatric evaluation of
him in relation to this case, ma’am.

4. Q. What is/are your proof/s that you have conducted


such evaluation?
A. I prepared a Psychological Report of the
respondent.

5. Q. I am showing to you this document entitled


Psychological Report dated January 11, 2020, is
this the same document that you are referring to?
A. Yes, ma’am.

6. Q. I am showing you the signature in this document


written above the name Dr. Joey Tribbiani, is this
your signature?
A. Yes, ma’am.

7. Q. Are you allowed to reveal the contents of the said


report?
A. Yes, ma’am.

8. Q. How so?
A. The parties in this case, Mr. and Mrs. Geller came
to me with a letter saying that they were instructed
to undergo psychiatric evaluation for purposes of a
pending case in court.

9. Q. How did you conduct the psychiatric evaluation of


Mr. Ross Geller?
A. I interviewed him and some individuals close to him
and conducted a battery of psychiatric tests to Mr.
Geller.

10. Q. What are you findings with regard to Mr. Ross


Geller’s condition, if any?
A. During the interview, I found out that Mr. Geller has
some kind of desire to have an affair with several
women simultaneously.

11. Q. How would you characterize such behavior?


A. I characterized such behavior as his way of proving
his masculinity and his way to make himself feel
good and appreciated.

12. Q. What is your diagnosis with respect to his behavior,


if any?
A. I found that Mr. Geller is suffering from Narcissistic
Personality Disorder which is grave, severe, long
lasting and incurable by any treatment.

13. Q. When did he acquire such condition?


A. Based on my evaluation, I found out that he was
exhibiting this behavior way back his teenage
years.

14. Q. What are the consequences of having this disorder,


if any?
A. Having a Narcissistic Personality Disorder heightens
a sense of self-importance and grandiose feelings
that he is unique in some way which oftentimes
makes a person too proud and self-conceited.

15. Q. What would happen if a person who is suffering this


condition decided to get married?
A. There is a great risk and possibility that he would
not have full-grasp as to the intricacies of a married
life and would not be able to fulfill the duties and
obligation reserved for married couples.

16. Q. Based on the psychiatric evaluation you conducted


on respondent, would you consider him falling
under this possibility?
A. Yes, ma’am. His womanizing is of such a degree
that is considered permanent, incurable, and
deeply integrated within his psyche and that it was
present but repressed at the time of the celebration
of the marriage and the onset was in early
adulthood.

II. REFERRAL INFORMATION:


The petitioner, Mrs. Rachel Green-Geller was referred by Atty. Janice
Wheeler to determine whether both couple are psychological capable of
carrying out the ordinary and essential obligations of marital state. She is
filing an action for declaration of nullity of marriage against her estranged
husband Mr. Ross E. Geller.
The couple was married on January 03, 2012 at Manila Cathedral and had no
child. A letter was sent to Mr. Ross informing him of the petition filed by his
wife and the need for him to undergo psychological evaluation. The
respondent acceded to the invitation and went to the clinic on the above
mentioned date.
The clinical impressions of the petitioner and the respondent were based on
their psychological assessment and interviews of the following witnesses;
Monica E. Geller, Mother of Ross and Phoebe G. Green, Mother of Rachel.

IV. RACHEL GREEN-GELLER (PETITIONER)

Mental Status Examination

Petitioner, Rachel came to the office for assessment once. She was well
groomed and neatly dressed and appropriately garbed during her session with
the clinician. She had above average height and average weight with fair
complexion. She was straight-forward and spontaneous during the interview.
The petitioner was able to draw the requested figures in a span of 20 minutes.
She has a rapid performance rate. She was also extremely at ease and she made
a good social contact. She was very enthusiastic in answering the questions
and has an excellent expressive ability. Eye contact was adequate, with affect
congruent to her moods and she has a clear perception of reality and properly
oriented with respect to time, place and person.

Psychiatric Assessment

Rachel is sociable and friendly. However, she often overthinks situations and
how other perceive her as a person. Nevertheless, she tries to maintain trust
and confidence towards other people.

Diagnosis

The interviews and battery of psychiatric tests conducted to Rachel revealed


that she is suffering from serious anxiety she acquired through time during her
marriage.

V. ROSS E. GELLER (RESPONDENT)

Mental Status Examination


Mr. Ross came for the assessment on the above mentioned date. He was
appropriately garbed for the occasions. He appeared truthful in describing
himself, worked persistently and was cooperative and had no interfering
conditions such as anxiety or depression during the testing and interview. He
was straightforward and spontaneous during the interview. He was also
extremely at ease and he made a good social contact. He was cooperative in
answering the questions and has an excellent expressive ability. Eye contact
was adequate, with affect congruent to his moods and he has a clear perception
of reality and properly oriented with respect to time, place and person.
Psychiatric Assessment
Ross is a proud man. He gives much weight on how he appears to other people
and how others perceive him as an individual.
Diagnosis
The series of examinations and interviews conducted to Ross showed that he
is suffering from Narcissistic Personality Disorder. His way of putting himself
above anyone and anything suggests that his condition is grave, permanent
and incurable.
