Re: Public Access to Paths in the Meadow Glen Neighborhood

Dear Meadow Glen Community Members and Meadow Glen Residents Association:

The city has recently been contacted by multiple members of the Meadow Glen neighborhood along with
members of the Meadows Glen Residents Association (MGRA) board about who has access to and can establish
the rules for use of paths located in your neighborhood. The city has reviewed the land use records, subdivision
plats, deeds and associated easements that have been granted to the city for public access to these paths.

Through the review of these records we have found the following information (see attached map for locations):

1. The paths located south of Racquet Lane are within Outlots D and I of the Ponderosa Subdivision. This
subdivision granted Public Access Easements across both of these Outlots to the city.

2. North of Racquet Lane the paths are located in Meadow Glen Outlot C and Meadow Glen II Outlot C and
the records do not show easements or city ownership of this outlots nor the paths located within them.

3. Sidewalks along the public streets (including Racquet Lane, Meadow Glen Drive, and Stone Wall Place)
are located in either city right-of-way or Public Access / Sidewalk Easements granted to the city.

The Boulder Revised Code (B.R.C. 1981 Section 8-5-2) defines Public Easements as “a public interest in land
owned by another person that entitles the public to a specific limited use or enjoyment of said land for the use or
installation, construction, reconstruction, repair, or maintenance of public infrastructure such as utilities, drainage
systems, or transportation improvements.” Areas with Public Access Easements granted to the city shall allow the
public free and open access to the paths and remain open to all members of the public.

Paths that are not within Public Access Easements nor owned by the city and that are located on private property
are controlled by the property owner. In this case that includes Meadow Glen Outlot C and Meadow Glen II Outlot
C, which the city’s records indicate are owned by the Meadow Glen Residents Association, Inc.
