Research the following:

1. How does Facebook and Instagram handle copyright issues regarding the photos and
videos and/or reels uploaded by their users?

Facebook and Instagram handle copyright issues regarding the photos, videos, and reels
uploaded by their users by implementing several measures to address this kind of issue.
Some of the implementations were the Terms of Services, Reporting System, and Rights
Management Tools/Intellectual Property.

One of the main and significant ways the companies stated above handle copyright
issues is by using the Terms of Services. Both of the social media platforms above stated
the ways that you must refrain from using their platform, such as "That infringes or
violates someone else's rights, including their intellectual property rights (such as by
infringing another's copyright or trademark, or distributing or selling counterfeit or
pirated goods), unless an exception or limitation applies under applicable law", (Terms of
Service, n.d., sec. What you can share and do on Meta Products) and "You can't post
someone else's private or confidential information without permission or do anything
that violates someone else's rights, including intellectual property rights (e.g. copyright
infringement, trademark infringement, counterfeit or pirated goods)" (Terms of Use, n.d.,
sec. How you can’t use Instagram).

In other circumstances, there are scenarios in which other users have been copying or
reproducing someone's work; then, the owner can apply a report filing for copyright

infringement in the form provided by their platform. Other forms of reporting copyright
infringements are through brand rights protection, which is only available to businesses
who have business accounts on Business Manager (Reporting Copyright Infringements,
n.d., sec. Report copyright infringement on Instagram). In addition to verifying the
report by an authorized individual or the rightful owner, the company will immediately
take action and remove or restrict content that engages in copyright issues (Intellectual
Property, n.d.). The mentioned-above implementations were some of their methods to
handle these copyright issues to ensure and protect their user's intellectual property
and rights in using their platforms.

2. How does YouTube handle copyright issues on videos uploaded by their users?

YouTube handles copyright issues using various measures, such as its Content ID System,
DMCA Webform, and Copyright Match Tool.

YouTube's Content ID System is a significant tool/method for copyright owners to find


and manage their copyrighted content on the platform. When a video is uploaded to
YouTube, the said platform will check it against its database of audio and visual content
that's been submitted to YouTube by copyright owners. If the Content ID finds a match, it
applies a Content ID claim to the matching video, where the claim results in different
actions depending on the copyright owner's Content ID settings, such as blocking the
video from being viewed (How Content ID Works - YouTube Help, n.d., ll. 3–11).

Another way to remove unauthorized copies of copyrighted content used by YouTube is


to submit a copyright notification through the DMCA (Digital Millennium Copyright Act)
web form. "A DMCA Takedown is when content is removed from a website or internet
platform at the request of the owner of the content (What Is a DMCA Takedown?, n.d.,
ll. 1–2).

The Copyright Match Tool on YouTube can automatically find videos that are the same or
similar to those already uploaded or removed due to copyright issues. When it finds
matches, you can decide what to do next, like emailing the person who uploaded a
similar video, asking for the video to be removed, or keeping a record of the match. This
tool uses the same matching technology as Content ID. However, it is more
straightforward and only needs a few resources (Overview of Copyright Management
Tools - YouTube Help, n.d., sec. Copyright Match Tool).

Before submitting takedown requests, it is essential to consider whether fair use, fair
dealing, or other exceptions to copyright apply in each situation.
