VII. Rationale/Background Information/Location/Coverage:

The Implementation of environmental laws in the Philippines has been a great challenge to the
National Government ever since, one of the devolved functions devolved to the Local
Government Units is the Environment and Natural Resources Sector.

According to Section 17 RA 7160 or the Local Government Code of 1991, the local government
units shall endeavor to be self-reliant and shall continue exercising the powers and discharging
the duties and functions currently vested upon them. They shall also discharge the functions and
responsibilities of national agencies and offices devolved to them pursuant to this Code. Local
government units shall likewise exercise such other powers and discharge such other functions
and responsibilities as are necessary, appropriate, or incidental to the efficient and effective
provision of the basic services and facilities.

In Section 8 of RA 7942 the Role of the Local Government unit pursuant to the Local Government
Code of other pertinent laws. The LGUs shall have the following roles in mining projects within
their respective jurisdiction, to ensure that relevant laws on public notice, public consultation
and public consultation and public participation are complied and to participate in the
monitoring and enforcement as may be provided for by applicable laws, rules and regulations.

Under Section 4 and Section 5 of Executive Order No. 138 or the Full Devolution of certain
functions of the Executive Branch to Local Governments, Creation of a Committee on Devolution,
and for other purposes states the functions, Services, and facilities which shall be fully devolved
from the NG to the LGUs no later than the end of FY 2024, In accordance with this Section17 (g)
of RA No. 7160, the basic services and facilities fully devolved shall be funded from the LGU
share of the LGUs. Section 5 state also the definition of standards for the delivery of devolved
services: a strategy for the capacity development of the LGUs: a framework for monitoring and
performance assessment of the LGUs.

In the environment sector, among those devolved functions is the enforcement of mines and

 mineral resources within the area of jurisdiction. This includes the Mining Laws and other laws
that embodied the protection of our environment..

VII. Project Description/Methodology

The Provincial Environment and Natural Resources Office is mandated under the law in
protecting and preserving the environment within Zamboanga del Sur. The mines and minerals
enforcement division facilitates the issuance of the Governor’s permit, establishment of mining
tenement maps, and other relative works involving the enforcement of environmental and
mining laws.

This project profile involves the following: Conduct Information, Education, and Campaign to
LGUs within the Province of Zamboanga del Sur, Assessment of Mineral resources within the
province, the establishment of Tenement maps, the establishment of Mineral Reservation, and
formulation of communication participation in enhancement training and conferences such as
symposiums or workshops that are related to the environment, assist in the formulation of
policies for the declaration of the Industrial and commercial areas of non-metallic concessions
and Enforcement of Mining Laws.

IX. Project Objective

 To equip the Technical Personnel on the assessment or inventory of Mineral Resources
within the Province of Zds.
 To prepare the Mineral Enforcement section on the formulation of policies that evolves
the implementation, documentation of the Provincial Mining Regulatory Board (PMRB)
 To enhance the knowledge of Technical Personnel in dealing with problems during
fieldwork.
 To formulate accurate data for MLGUs in terms of Mineral resources.
 To assist the MLGUs in the enforcement
 To promulgate rules and regulations as may be necessary to implement the intent of the
provisions of the Act.
 To enforce ENR Laws.

Government of Zamboanga Del Sur.

XVII. Remarks:

Project Profile was based on the Executive Order 138 “Mandanas” rules the devolution of certain
functions of the executive branch to local governments. Under Section 3, the order shall cover all
LGUs, departments, agencies, and instrumentalities of the Executive Branch whose functions are
in line with the devolved functions of the LGUs under section 17 of RA 7160, and other pertinent
laws.
