PTA CONSTITUTION AND BY-LAWS

PREAMBLE

The SCHOOL PARENT TEACHER ASSOCIATION (SPTA) of CUMCUMRAAS-MANGGADDI-


PITPITAC ELEMENTARY SCHOOL binding themselves in solidarity, unity and cooperation and
imploring the help of the Divine Providence and drawing inspiration from the Greatest Teacher and
Source of Wisdom in order to establish an organization that shall embody their ideals, strengthen
the spirit of brotherhood and cooperation among themselves and promote the scholastic , social and
moral well-being of the student population do ordain and promulgates this Constitution and By-
Laws.

Article I – Name

Section1. The organization shall be known as the CUMAPIT ES SPTA, a duly organized association of
all homeroom and federation of parents and teachers of Cumcumraas-Manggadddi-Pitpitac
Elementary School.
Section2. The official address of the association shall be at the City of Batac Barangay Sumader.

Article II – Objectives
Section1. The objectives of the PTA shall be:

a. To provide an avenue for discussing issues and its solutions and relevant concerns
related to the total school program.
b. To encourage and strengthen cooperation, unity and camaraderie among parents and
teachers in the efficient implementation of the said school program.
c. To provide relevant assistance and support to the school for the promotion of the
welfare of the students, and their common interest.
d. To promote and enhance moral, economic, social, and cultural welfare of the students,
teachers, parents and members.

Article III – Membership

Section1. The parents or legal guardians and the teachers of the students & non-teaching staff shall
constitute theregular members of the Association with all the rights, privileges, and
obligations appertaining to such members.

Section2. All members have the following rights:


a. To have a personal voice and vote in every decision the Association needs to make;
b. To enjoy equal protection, privileges and opportunities in the Association as any other
member;
c. To be nominated, elected and hold office in accordance to the provision of this
constitution and By-Laws;

d. To seek assistance and be assisted by the Association for the protection and the
pursuit of his/her rights and privileges as provided by this Constitution and By-Laws;

e. To be informed about school programs and activities;

f. The PTA is authorized to undertake fund-raising activities to provide the school’s


academic and co-curricular programs, projects, and activities subject to pertinent
DepEd guidelines;

g. A death aid shall be given to the bereaved family of a PTA member in case of death
among immediate family member. The amount of death aid may either be set by the
BOD or the amount that may be obtained from collecting PhP50* from the paying
parents plus the voluntary contribution from other schools.

Section3. All members shall have the following obligations:

a. To uphold and defend this Constitution and By-Laws;

b. To observe, respect and uphold the rules and regulations of PARES which shall mold
and nurture the morale, physical and intellectual well-being of the student;

c. To abide by the decisions of the majority and recognize at all times those in authority
by reason of their position, render the respect and submission due them and their
decisions.

d. To fulfil faithfully and promptly his obligations, whether financial, moral, technical or
otherwise as member of this Association.

e. At all times be guided by the precepts of the Association.

Section4. All members shall pay the Association Annual fee of PhP 100.00* or as prescribed by the
Board of Directors (BOD) and approved by the general assembly.
Section5. The general assembly shall be the highest deciding body of the association.

Article IV – Officers, Board of Directors and Federated PTA

Section I. The Association shall have a set of Homeroom Officers in every grade level and a BOD as

the highest governing body. For representation in the local school board and other
purposes, all schools’ PTA Presidents in the City of Batac shall federate and elect among
themselves their respective officers and BOD. The set of officers shall be as follows and
their qualifications and tenures shall be as provided herein;

President
Vice President
Secretary
Sub Secretary
Treasurer
Sub Treasurer
Auditor
Business Manager
Public Information Officer

Section2. The Homeroom officers and PTA Executive Officers shall have the following duties:

a. The President
1. He/she shall represent the PTA in the School Governing Council
2. He/she shall be the chief executive officer of the Association, shall preside at all
general and board meetings and call regular and special meetings;
3. He/she must have an agenda for the meeting and conduct them accordingly;
4. He/she shall carry out all decisions arrived at during the meeting of the Association
to the best of his/her ability;
5. He/she may create committees to help him/her carry out the projects of the
Association;
6. He/she shall officially represent the Association and shall have the power to act on
matters which require immediate decisions as circumstances warrant such as
emergencies; provided however that he/she does not fail to report such actions.
7. He/she shall enforce and implement the Constitution and By-Laws, rules and
resolutions.
8. The Homeroom President shall act as the presiding officer during homeroom PTA
meetings.
9. The Federated President shall sit as the representative of the Federation to the local
school board.

b. The Vice-President
1. He/she shall take the place of the president as acting President in case of absence,
temporary inability or disability of the latter provided however that in case of death,
permanent disability, removal from office or resignation of the president, he/she
shall automatically become the president by succession and shall serve the
remaining term; and
2. He/she maybe called upon to assume other duties essential to Association by the
president and/or Board of Directors.

c. The Secretary
1. He/she shall prepare and send out notices of all general and board meetings,
including resolutions, circulars and memoranda;
2. He/she shall keep records, committee reports and minutes of the meetings;
addresses and contact information of the officers;
3. He/she maybe called upon to assume other duties essential to Association by the
president and/or Board of Directors.

d. The Sub Secretary


1. He/she shall take the place of the secretary as acting secretary in case of absence,
temporary inability or disability of the latter provided however that in case of death,
permanent disability, removal from office or resignation of the president, he/she
shall automatically become the secretary by succession and shall serve the
remaining term; and
2. He/she maybe called upon to assume other duties essential to Association by the
president and/or Board of Directors.

e. The Treasurer
1. He/she shall receive all money from members, including cash donations or other
money due to the Association , and shall issue the corresponding acknowledgement
receipts thereof;
2. He/she shall disburse funds in payment of the obligations of the Association;
3. He/she shall prepare and render at every meeting a report of the financial standings
of the Association duly certified of the Auditor;
4. He/she maybe called upon to assume other duties essential to Association by the
president and/or Board of Directors.

f. The Sub Treasurer


1. He/ she shall take the place of the treasurer as acting treasurer in case of absence,
temporary inability of the latter provided however that in case of death, permanent
disability, removal from office or resignation of the president, he/she shall
automatically become the treasurer by succession and shall serve the remaining
term; and
2. He/ she maybe called upon to assume other duties essential to Association Board of
Directors.

g. The Auditor
1. He/ she shall examine all records to determine if all funds of the Association shall
have been totally accounted for and all disbursements have been duly authorized
and supported by invoice receipts, and vouchers, etc;
2. He/she shall check accuracy if projects estimates based on current market trends, to
3. He/ she maybe called upon to assume other duties essential to Association by the
president and/ or Board of Directors.

h. The Business Manager


1. He/she shall coordinate with the Board of Directors on authorized projects and
canvass the materials needed and labor cost for the same; and
2. He/ she maybe called upon to assume other duties essential to Association by the
president and/or Board of Directors.

i. The Public Information Officer


1. He/ she shall take charge of all liaison work and publicity, develop and maintain
cordial relations within and outside the Association at all times; and
2. He/ she maybe called upon to assume other duties essential to Association by the
president and/ or Board of Directors.

Section3. The Homeroom Officers, the BOD and the federated BOD shall hold office for one (1) year
and shall remain in office until their successor shall have been qualified and elected. In no
case shall a BOD serve for more than two (2) consecutive terms.

Section4. The BOD shall be composed of fifteen (15)** members: Ten** (10) homeroom presidents
and five** (5) teachers. In case where the number of presidents will not suffice, the Vice
Presidents will be tapped.

Section5. The BOD shall elect among themselves the association’s executive officers.

Section6. The duties of the BOD are as follows:

a. It shall be responsible for the formulation and execution of policies and resolutions. All
new business, policies and resolutions shall be considered by the Board for deliberations
and approval;
b. It shall have the duties and powers expressed and implied as set forth elsewhere in this
Constitution and By-Laws; and
c. Any member of the Board of Directors maybe appointed Chairman of any standing
committee.

Section7. The Duties of the Federated BOD are as follows:

a. It will spearhead all Division- Wide PTA activities;


b. It shall represent the school’ PTA in all Divisions- Wide PTA concerns;
c. It shall formulate common policies and general provisions among all schools’ PTA;
d. Any member of the BOD may be appointed as chairman of any of the standing
committees.

Article VI – Elections

Section1. All Homeroom officers shall be elected by the majority membership of the respective
homerooms. The ten** (10) Board of Directors shall be elected from among the duly
elected Homerooms Presidents presents during the BOD election day. Officers of the BOD
shall be elected from among the duly elected members of the BOD.

Section2. The manner of election shall be by VIVA VOCE for the homeroom officers while secret
ballot will be used for the election of the BOD and the federated officers.

Section3. The election of BOD and federated PTA Officers shall be facilitated by the federation
election committee. The PTA Presidents from all schools shall convene and elect the five
member FEC through secret ballot. The FEC will then oversee the election of the 15
members of the Federated BOD. The Federated PTA Officers shall be elected from the
Federated BOD.

**Ten (10) BOD members: Seven (7) homeroom presidents and three (3) teachers for small school

Section4. Should there be vacancies in any office except the president; secretary & treasurer; a
special election shall be called by the Board of Directors. Section1, section2, & Section3
shall be observed.

Section5. Proxies or representatives are for attendance purposes only. They cannot vote or be
nominated.

Article VII – Working Committees

Section1. Working committees shall be formed to work out the projects of the association just after
the new sets of officers are elected. The following committees shall be formed or
organized:

Steering Committee
Finance Committee
Programs and Project Committee
Ways and Means Committee
External & Community Committee
Audit Committee
Grievance Committee
Election Committee

Section2. The different committees shall have the following functions;


a. Finance
1. To be responsible for the collection, handling and disbursement of finances of the
association.
2. To keep an updated record of the finances of the PTA Projects
3. To initiate and coordinate relevant activities related to finances.
4. To coordinate and work with the other committees.

b. Program & Projects


1. To support the school in its scheduled and specifically-designed programs and
celebrations.
2. To assist, if required or when needed, the teachers and the students in the planning
and presentation of programs and celebrations.
3. To document all activities and project of the Association .
4. To coordinate and work with the other committees.
5. To perform other duties related to Programs and Projects.

c. Ways and Means


1. To make plans regarding financial requirements of all the activities and projects of
the Association.
2. To device ways and means to raise funds for upcoming projects.
3. To device ways and means to augment the finances of the School for specific
purposes as needed.
4. To work closely with the other committees in the performance of their functions.

d. External and Community


1. To make available means of transportation when needed.
2. To coordinate community Outreach Programs of the association.
3. To assist/prepare materials for scheduled Outreach Programs, such as medicines
and medical groups for Medical Missions, food and goods for Calamity/Disaster
Operations or gifts for Gift-Giving Activities to indigents.
4. To work closely with the other Committees in the Performance of their functios.

e. Grievance
1. To provide an avenue of resolving conflicts and disputes among members ensuring
that issues will be confined within and among the disputed parties.
2. To serve as an arbiter when resolving conflicts.
3. To represent the PTA to school authorities regarding any issues that need to be
clarified and resolved as the need arises.

Section3. The BOD shall serve as the steering committee and chaired by the president.

Article VIII- Quorum


Section1. The presence of 50% plus one shall constitute a quorum. (Optional… The present members
shall constitute the quorum.

Article IX – Activities & Meetings

Section1. All members shall meet in a general assembly at least two times annually. Other
association
Activities and meetings shall be disseminated at least five days prior to the scheduled
activity/meeting through a notice of meeting/activity called by the president.

Section2. A fine shall be collected for failure to attend association activities and meetings. Members
will be fined PhP 100.00* and officers PhP 200.00*. Proxies may be sent on behalf of
members/officers who cannot attend.

Section3. All PTA activities within the school premises or which involve the school, its personnel or
Students shall be prior consultation and approval of the school head.

Section4. All Division – Wide PTA activities shall be with prior consultation and approval of the CSDB
Superintendent.

*To be decided by the general assembly of each school

Article X – Funds

Section1. At the end of each school year, funds, records and receipts should be audited by the
auditor.

Section2. All funds appropriated for specific projects shall be used only for the purpose for which it
was raised, unless overruled, rescinded or cancelled by the Board of Directors. Any
unspent fund shall be properly accounted for and deposited in the school PTA bank
account under the name of the president, treasurer and the assistant treasurer .

Section3. A mid-school year report of financial statement ending October 30 shall be prepared by
the Treasurer, audited by the Auditor and signed by PTA Audit Committee. It shall be
submitted not later than November 30 to the School Head.

Section4. An Annual Financial Statement signed by the PTA President, Treasurer, and Auditor shall
be submitted to the School Head not later than 30 days after the last day of classes. The
said Financial Statement must be posted in the PTA bulletin board and must be presented
to the first General Assembly early next school year.

Article XI – Amendments and Ratification


Section1. Amendments to the provision of this Constitution and By – Laws shall be entertained upon
endorsement of at least 75 % of all the members through referendum. An ad hoc
committee shall be formed by the Board of Directors to make the amendments within 10
days after the endorsement has been filed.

Section2. Ratification of the amendments shall take effect the following school year after approval
by the majority votes of the members who constitute a quorum.

Article XII – Adoption

Section1. This Constitution and By – Laws shall take effect 15 days after the posting of the approved
form approved by the majority votes of the members who constitute a quorum.
