    1. Applicant has filed this application U/s 457 of the Code of


    Criminal Procedure to release the seized Mahindra Scorpio four
    wheeler vehicle bearing registration No. MH-20-EJ-6103 in his favour.
    The above vehicle is seized in CR. No.1 of 2023 registered under
    Sections 307, 324, 323, 143, 147, 148, 149, 504, 506 of Indian Penal
    Code and under section 3(1)(R), 3(1)(S), 3(2)(V), 3(2) (Va) Scheduled
    Castes and the Scheduled Tribes Prevention of Atrocities Act and under
    section 4/25 of Arms Act, registered with Bidkin police station,
    Aurangabad.

    2. The investigating officer submitted that the vehicle is


    seized in the crime. The investigation is in the progress. If the vehicle
    is released there is possibility to use it again to commit the offence.

    3. On perusal of documents produced on the record, it


    revealed that the present applicant is the owner of the seized vehicle.
    The vehicle is not required for the purpose of evidence. During pending
    the trial, applicant is the best custodian of said vehicle. Hence, the
    following order.
    2 Cri. MA No.99/2023

    ORDER
    1. Application is partly allowed.
    2. Seized Mahindra Scorpio four wheeler vehicle bearing
    registration No. MH-20-EJ-6103 be released in favour of applicant on
    execution of supurtnama of Rs. 5,00,000/- with a condition that she
    shall not sell or destroy the above vehicle till disposal of the case and
    produced it before the court if ordered in future.
    3. Inform to concerned police station accordingly.
