TENANCY AGREEMENT

This Tenancy Agreement is made on the ……… day of ………………. 2024 between:

WHEREAS:
The Landlord agrees to let unit XXX YYY, a 3-bedroomed apartment located in XXXXX
(hereinafter referred to as ‘the unit’) to the tenant subject to the terms and conditions listed
below.
1. APPLICABLE LAW
1.1 This agreement shall be governed by and construed in accordance with all relevant law.

2. DURATION
2.1 This agreement shall commence on the intended date of occupation which shall be the
……… day of ………………. 2024 and shall lapse 1 year after the aforementioned date.
2.2 The tenant shall have the right to renew this contract at the discretion and terms of the
landlord.

3. RENT
3.1 Kshs. 90,000.00 shall be payable by the tenant to the landlord as rent.
3.2 Prior to occupancy, the tenant shall deposit with the Landlord Kshs. 180,000.00 as 2
months’ rent paid in advance.
3.3 Rent payable shall be due on the 1st week of each month.
3.4 The tenant shall be responsible for the monthly payment of Kshs. 10,000 service charge.
3.5 Rent payments shall be made to the bank account specified below:

4. ENJOYMENT AND USAGE


4.1 The tenant shall have the right to quiet possession and peaceful enjoyment of the unit
subject to the conditions stated in this agreement.
4.2 The unit shall only be used for private occupancy or dwelling purposes and shall not be used
for any other purposes i.e. commercial purposes.
4.3 The tenant shall occupy and use the unit in a sustainable manner and shall carefully look
after all fittings, appliances and all materials installed for enjoyment of the unit.

5. STATE OF UNIT, REPAIR AND MAINTENANCE


5.1 The landlord shall hand over the unit to the tenant while it is in good and habitable
conditions.
5.2 The landlord shall be responsible for the maintenance of sections of the unit or its fittings
and appliances under the condition that damage or misfunction was caused by reasonable
wear and tear.
5.3 The tenant shall be responsible for any damage caused to the unit or its fittings and
appliances which was caused by unreasonable wear and tear or poor usage.
5.4 The tenant shall promptly notify the landlord of all matters regarding repair or
maintenance.

6. INSPECTION
6.1 Landlord personally or through their agent shall have the right to enter the unit for the
purpose of inspecting the condition of the property at reasonable times upon giving not less
than seven days’ notice to the tenant.

7. TERMINATION
7.1 The Landlord and tenant shall both have the right to terminate this agreement upon giving
30 days’ notice to the other party.
7.2 All rent due upon effective termination shall be payable by the tenant.
