The term 'DEVELOPER" and 'PURCHASER", wherever the context so


means, requires or permits, includes their legal heirs, representatives,
executors, administrators, nominees, successors-in-interest and assigns;

WHEREAS the Mr.L.Sreedhar Reddy, Son of Mr.Leburu Veera Reddy, is


sole and absolute owner of the vacant house Plot Nos.l to 42, ar'.d. 48, 52,
54 to 94 and Shop-l, Shop-2, & 86 in all totally measuring an extent of
3,67,864 Sq.ft., Survey Nos.210l1A (Part), 210/18 (Partl, 2tOl2 to 2LO17,
2Lo/9, 2tO /lO, 2to ltt (Partl, 2tr l2s (Partl, 2tt 127 to 2tt /33 and 5612,
5614, 5615 in to layout of housing plots and obtained Approval from the
Deputy Director of Country and Town Planning Chingleput granted their
approval vide D.T.C.P. Approved No.L222 /9O based on Thiruvallur
Panchayat Union Commissioner's L€tter R.C.No.38950/ 1990, dated
27.12.L99O and the layout named as (SHRMNI(ATESWARA NAGAR",.

WHEREAS, the above Housing plots in "SHRMNKATESUIARA lIAcAR,,


approved Layout by D.T.C.P. vide Ma.Va./Na.Vu.E. No.L222li-99A, with
Thiruvallur Panchayat Union Commissioner's Letter dated 27 .12.1990,
situated at No.78, Kilambakkam Village, Thimvallur Taluk, Thiruvallur
District

WHEREAS the VENDOR MT.L.SREEDHAR REDDY, Son of Mr.Leburu Veera


Reddy, were appointed their General Power of Attorney Agent M/s.MANJU
PROMOTERS PRIVATE LIMITED, to sell the vacant housing Plot Nos.2lB,
24 South, 34, 35, 37, 62 West, 67,68,79,83, 91, Shop - 2, in all totally 12
Nos. of Plots, measuring an extent of 18,354 Sq.ft., comprised in Survey
Nos.210/7, 2tO/8, 2tolto, 2rO/tL, 2Ltl28, 2Ltl29, 2tL/30, 2Ltl3L,
2lI/33 as per patta sub-division Survey Nos.21O/7A, 2lO l8AlA, 2lO/LOA,

the Sub-Registrar OIIice at Thiruvallur Joint-l

WHEREAS, the DEVELOPER herein, a-fter careful consideration, agreed to


& sell the aforesaid Housing Layout named as "SHRI
develop, market
VENKATESWARA NAGAR", situated at No.78, Kilambakkam Village,
Thiruvallur Taluk, Thiruvallur District.

WHEREAS, with an intention to Purchase housing Plot No.35 South


Pottlo[, measuring an extent of 888 Sq.ft., Comprised in Survey
No.210/ 11, as per patta sub-division Sunrey l{o. 21O/11A1AA1A, in the
aJoresaid Project, more fully described in Schedule hereunder, the
PURCHASER herein, approached the DEVELOPER herein, with a request to
develop the aforesaid Plot proposed to be purchased, and agreed to pay a
sum of Rs.4,21,8OO/- (Rupeea Four Iakhs fVrenty One Thousand and
Etght Hundred Onfyl to the DEVELOPER towards Development Works as
listed in the Annexure to this Development Agreement.

NOW, THIS DEVELOPMENT AGREEMENT WITNESSETH AS FOLLOWS:


1) Upon request from the PURCHASER, the DEVELOPER herein has agreed
to develop Plot No,35 South Portlon, measuring an extent of888 Sq.lt.,
Comprised in Survey No.210/ 11, as per patta sub-division Sunrey No.
21Ol11A1A41A, in (SHRMNI(ATESWARA NAGAR", D.T.C.P. vide
Ma.Va./Na.Vu.D. No.l222/1990, dated 27.12.1990, situated at No.78,
Kilambakkam Village, Tiruvallur Taluk, Tiruvallur District, more fully
described in Schedule hereunder, for al estimated Development Charges
Rs.4,21,8OO/- (Rupees Four Lakhs lbenty One Thousand and Etght
Huadred Only), towards Development Works as listed in the Annexure to
this Development Agreement.
2) The PURCHASER has paid a sum of Rs.10,000/- (Rupees Ten Thousand
Only) paid as Advance, from out of the total estimated Development

Charges, to the DEVELOPER, to develop the Schedule mentioned


Property.
3) The PURCHASER agrees to pay the balance remaining Development
Charges amounting to Rs.4,21,8OO/- (Rupees Four LaLhs fuent5r One
Thousend and Elght Huadred Oalyf, at the time of Registering the
Schedule Property, or within one month from the date of this Agreement,
whichever is earlier.
4) THE DEVELOPER has agreed to complete the Development Works of the
Schedule Property within one month from the date of signing this
Agreement.
5) During the pendency of this Development Agreement, if Taxes/Charges are
revised or additionally levied by the Government of the Day, ard/or, by the
Statutory Authorities, the PURCHASER herein agrees to bear tJ:e same
including any other incidental expense/s incurred thereon.
6) THE DEVELOPER herein, agrees to arrange for the Registration of the
Schedule Property, in favour of the PURCHASER or their Legal Nominees
upon receipt of the entire Plot Cost at Guideline Value including the
Development Charges.
7) The DEVELOPER herein, agrees to hand over the duly developed Vacant
Possession of the Schedule Property to the pURCHASER, after the
Registration of the Sale deed in respect of the Schedule property.
8) Any dispute or difference arising out of or in connection with this
Agreement, the same shall be referred to Arbitration in accordance with
ttre provisions of tJle Arbitration and Conciliation Act, 1996. Arbitration
will be conducted by a Sole Arbitrator to be appointed by the Developer.
The proceedings will be conducted in tJle English language and the venue
shall be in Chennai. The Courts in Chennai, Tamil Nadu and Laws of
India will have exclusive jurisdiction on any matter concerning this
Agreement.
