AFFIDAVIT OF DESISTANCE

I, OLIVER AGUSTIN, of legal age, Filipino, married, and with residence

at #338 Capricorn St., Angel Village, Dasmarinas City, Cavite, after being duly
sworn, hereby depose and state that:

1. I am the private complainant in the criminal case filed against Dexter

A. Bihis entitled "People of the Philippines vs. A. Dexter Bihis” docketed as Crim.
Case No. 23-0234 pending before the Municipal Trial Court in Cities, Branch 1,
Dasmarinas City, for the crime of Other Deceits under Article 318 of the Revised
Penal Code;

2. After carefully considering all the surrounding circumstances relative

to the above-mentioned cases, I firmly believe that there was no deliberate nor
malicious, criminal, and evil intent on the part of Dexter A. Bihis to defraud me or
to breach his obligations;

3. Thus, in order to have peace of mind and in order not to cause further
vexation between and among us brought about by the above-mentioned case,
Dexter A. Bihis and I have decided to enter into a compromise agreement. A copy
of the Compromise Agreement is attached hereto as Annex “A;”

4. Having already entered into a Compromise Agreement with Dexter A.

Bihis, I am no longer interested in prosecuting and further pursuing the above-
mentioned cases. Thus, I hereby voluntarily and unconditionally DESIST from
pursuing the any legal actions against Dexter A. Bihis, and I hereby withdraw
and/or recant all statements I made against him without coercion and intimidation,
and on my own free will, after having fully understood the legal consequences of
my act, and I hereby express my intention to cooperate fully in the dismissal of the
said cases;

 5. I am fully aware of the consequences of this Affidavit of Desistance,
and I further undertake not to institute any civil, criminal, or administrative
proceedings against the accused arising from the same subject matter.

6. I am executing this Affidavit of Desistance freely and voluntarily and

without any form of coercion, intimidation, or inducement from any party.
