COMPROMISE AGREEMENT

This Compromise Agreement ("Agreement") is entered into on this ___ day


of _________________, 2023, by and between:

______, of legal age, Filipino, and a resident of


___________________________, Philippines, hereinafter
referred to as the "Private Complainant";

____, of legal age, Filipino, and a resident of___, Philippines,


hereinafter referred to as the "Accused";

Collectively referred to herein as the "Parties."

WHEREAS, there is a pending criminal case before the Regional Trial


Court of ___for Violation of _____ commenced by Private Complainant against
Accused, entitled “_____

WHEREAS, the Parties have mutually agreed to settle the aforementioned


case amicably and peacefully in order to avoid protracted litigation, expenses, and
further disputes;

NOW, THEREFORE, in consideration of the premises, the Parties hereby


agree to the following terms and conditions:

1. Sta. Rosa Property:

1.1 The Parties acknowledge that a deed of donation was executed by them in
favor of their common child, ____, on _________________, regarding the Sta.
Rosa Property.

1.2 Private Complainant and ____shall be responsible for paying the outstanding
Association Dues, which currently amount to PHP 19,362.70 as of May 2023, and

any and all other fees associated with the said property, including taxes and
charges incurred therefor.

2. Loan Agreement:

2.1 The Parties agree to reduce the outstanding loan amount of PHP 700,000.00 to
PHP 400,000.00.

2.2 Accused shall pay PHP 140,000.00 of the reduced loan amount by December
2023. He shall issue a post-dated check for this purpose upon the execution of this
Agreement.

2.3 The remaining balance of PHP 260,000.00 shall be settled by Accused in


monthly installments of PHP 10,000.00, commencing on January 2024, and
concluding on February 2026. He shall issue post-dated checks for these
installments upon the execution of this Agreement.

3. ___'s Allowance:

3.1 Accused shall assume the responsibility for providing ____with a monthly
allowance of PHP 15,000.00 until the completion of Matthew's master's degree
program.

4. Affidavit of Desistance:

4.1 Private Complainant shall execute an affidavit of desistance upon the execution
of this Agreement, with the intent to withdraw the criminal case filed against
Accused.

5. General Provisions:

5.1 This Agreement, for all purposes, shall be deemed to have been drafted jointly
by both parties, and shall constitute the entire understanding between them,
superseding all previous agreements or arrangements, and cannot be amended
except in writing and signed by both Parties.

5.2 The Parties undertake to cooperate fully in implementing this Agreement,


including the prompt delivery of post-dated checks and any other actions required
to fulfill the terms herein.

5.3 This Agreement may be executed in any number of copies, each of which
shall be deemed to be a counterpart of the original.

5.4 Each of the parties participated voluntarily, freely, willingly, without force,
intimidation, or coercion in the drafting and negotiation of this Agreement.

IN WITNESS WHEREOF, the Parties hereto have executed this Compromise


Agreement on the date first above written.
