DEED OF EXTRAJUDICIAL SETTLEMENT

OF THE ESTATES OF ZENAIDA V. CORREA


WITH DEED OF ABSOLUTE SALE AND WAIVER OF
SHARES/RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This extrajudicial settlement with absolute sale entered into by and among
the following:

LUISITO C. CORREA, widow, surviving spouse, Filipino,


and with postal address at no. 606 Sampaguita St., Brgy.
San Juan , Ildefonso, Bulacan

JUDEE V. CORREA, Filipino, of legal age, Single with postal


address at no. 606 Sampaguita St., Brgy. San Juan ,
Ildefonso, Bulacan

LUISITO V. CORREA JR. , Filipino, of legal age, Single ,;


postal address at no. 606 Sampaguita St., Brgy. San Juan ,
Ildefonso, Bulacan

JERRY V. CORREA, Single, Filipino, of legal age, with postal


address at no. 606 Sampaguita St., Brgy. San Juan ,
Ildefonso, Bulacan

RONALD V. CORREA, Married to Joan May De La Cruz,


Filipino, of legal age, with postal address at no. 606
Sampaguita St., Brgy. San Juan , Ildefonso, Bulacan

GLADIES V. CORREA, Married to Daryl M. Chavez, Filipino, of


legal age and with postal address at no. 606 Sampaguita St.,
Brgy. San Juan , Ildefonso, Bulacan

Collectively referred to as the HEIRS-SELLERS;

and

ENRIQUE B. DIZON IV, Single, of legal age with postal


address at Block 4, Lot 6, Romans St., Jordan Plains Subd.,
Novaliches, Quezon City, and LIA CARI M. MANALO, Single,
of legal age with postal address at No. 942 P. Lopez St., Brgy. New
Zaniga, Mandaluyong City, referred to as the BUYERS;

W I T N E S S E T H:

WHEREAS, LUISITO C. CORREA married to ZENAIDA V. CORREA


who died on October 20, 2019, is the registered owner of the following REAL
PROPERTY and more specifically described as follows:

1. Lot without improvement located in Brgy. Kalawakan, Municipality of Dona


Remedios Trinidad, Bulacan with a lot of area of FORTY-EIGHT
THOUSAND NINE HUNDRED NINETY-SIX (48,996) SQUARE METERS
and with TRANSFER CERTIFICATE OF TITLE NO. T-190235 issued by
the Registry of Deeds for The Province of Bulacan and more specifically
described in the Certified true copy of the transfer certificate of title (TCT)
Attached as ANNEX “A”.

2. Lot with improvement located at Brgy. San Juan, San Ildefonso, Bulacan with
a lot area of ONE HUNDRED EIGHTY-SEVEN (187) SQUARE METERS
and with TRANSFER CERTIFICATE OF TITLE NO. T-193458 issued by
the Registry of Deeds for the Province of Bulacan and more specifically
described in the Certified true copy of the TCT attached as Annex “B”.

3. Lot with improvement located at Brgy. Mataas na Parang, San Ildefonso,


Bulacan with a lot area of TWO THOUSAND FIVE HUNDRED (2,500)
SQUARE METERS and with TRANSFER CERTIFICATE OF TITLE NO.
T-22531 issued by the Registry of Deeds for the Province of Bulacan and
more specifically described in the Certified true copy of the TCT attached as
Annex ”C”.

WHEREAS ZENAIDA V. CORREA died without a Will on October 20, 2019,


as shown by a copy of her death certificate attached as Annex (D).

WHEREAS ALL names of SELLERS mentioned are the legitimate surviving


Heirs of the deceased ZENAIDA V. CORREA.

WHEREAS JUDEE V. CORREA, LUISITO V. CORREA, JR., JERRY V.


CORREA, RONALD V. CORREA, GLADIES V. CORREA waives their inheritance
from their deceased mother in the property described in number one (1) in favor of
LUISITO C. CORREA.

WHEREAS LUISITO C. CORREA, JERRY V. CORREA, RONALD V.


CORREA, LUISITO V. CORREA, JR., and JUDEE V. CORREA waives All their
Rights and their inheritance from the property described in number 2 in favor of Gladies
V . CORREA.

WHEREAS LUISITO V. CORREA and GLADIES V. CORREA waive their


rights and inheritance in favor of JUDEE V. CORREA, LUISITO V. CORREA JR.,
JERRY V. CORREA, and RONALD V. CORREA from the property described in
number 3.

WHEREAS pursuant to Section 1, Rule 74 of the Revised Rules of Court, the


HEIRS-SELLERS have agreed to adjudicate the property among themselves in
accordance with the immediately preceding distribution stated above;

WHEREAS, no personal properties are involved in this extrajudicial settlement;

WHEREAS, to the best knowledge and information of the parties,the


aforementioned deceased left no outstanding debts in favor of any person or entity;

WHEREAS, a copy of this extrajudicial settlement shall be published once a


week for three (3) consecutive weeks in a newspaper of general circulation;

WHEREAS, all taxes, including the Estate Tax, shall be paid for by the HEIRS-
SELLERS to have the said title transferred;

WHEREAS, all shares in the real property having been acquired through a
gratuitous title, the same are not part of the Absolute Community Property or Conjugal
Partnership of Gains as provided for under the Family Code of the Philippines and
therefore considered as the separate property of each of the HEIRS-SELLERS;

WHEREAS, the HEIR-SELLER (LUISITO V. CORREA) has offered the said


real property described in number 1 for sale to the BUYERS who have accepted the
offer under the terms and conditions set below;

NOW, THEREFORE, for and in consideration of the foregoing premises, the
parties have agreed as follows:

1. The HEIR-SELLER agreed to sell the subject property in the amount of


SEVEN MILLION THREE HUNDRED FORTY-NINE THOUSAND FOUR
HUNDRED PESOS ( P7,349,400.00) gross, which is acceptable to the BUYERS.

2. Upon the execution of this Deed of Absolute Sale, the HEIR-SELLER


hereby SELL, TRANSFER and CONVEY the subject property, in a manner
absolute and irrevocable, unto the said BUYERS, their heirs, successors,
and assigns.

3. The HEIR-SELLER hereby represents and warrants that they have a


good, valid, and subsisting right, interest, and title to the subject property sold to the
BUYERS.

4. THE HEIR-SELLER also warrants that the subject property is free from
any and all liens and encumbrances whatsoever and that there is no pending, threatened
or imminent action or controversy, whether administrative or judicial, involving or
affecting the above-described property.

5. All outstanding real property taxes, if any, Estate taxes, Capital Gains tax
shall be paid by the SELLER, transfer taxes, and Documentary Stamp Taxes shall be for
the account of the BUYERS.
