AFFIDAVIT OF ADVERSE CLAIM

OF/FOR TRANSFERRED RIGHTS OVER REAL PROPERTIES
I, MARY CHRISTINE LAMBANG PACATE, of legal age, married, Filipino and a resident of San
Agustin Sur, Tandag City, Surigao del Sur, after having been duly sworn to in accordance with law, depose and
state:

1. That on September 7, 2022, three parcels of land located at Libas Gua, San Miguel, Surigao del Sur was
sold to me by Spouses Emelio Granaderos America and Lucifin Bucay America. The Deed of Sale that we executed
was duly notarized by Atty. Leoderico P. Avila, Jr. with Doc. No. 38, Book No. XXII, Page No. 9, Series of 2022;

A copy of the said Deed of Sale is hereto attached as ANNEX "A" and made an integral part of this
Affidavit;

2. That the said parcels of land were acquired by Spouses Emelio Granaderos America and Lucifin Bucay
America through a Deed of Sale they executed with the previous owner of the parcels of land, Maria Victoria L.
Rosete last April 6, 2022. The said document was duly notarized by Atty. Andre Arreza Andresan with Doc. No.
310, Page No. 63, Book No. 174, Series of 2022;

A copy of the said Deed of Sale is hereto attached as ANNEX "B" and made an integral part of this
Affidavit;

3. That the land subject in this affidavit is herein described as follows:

PARCEL 1

"A parcel of agricultural land identified as Lot No. 7234, Cad 537-D San Miguel Cadastre, located at Libas
Gua, San Miguel, Surigao del Sur, covered by Katibayan ng Orihinal na Titulo Blg. P-30811, registered in the name
of Delia L. Rosete, containing an area of THIRTY FOUR THOUSAND FIVE HUNDRED FIFTY-FIVE (34,555)
square meters, more or less;"

PARCEL 2

"A parcel of agricultural land identified as Lot No. 1179, Cad 537-D San Miguel Cadastre, located at Libus
Gua, San Miguel, Surigao del Sur, covered by Katibayan ng Orihinal na Titulo Big. P-30809, registered in the name
of Delia L Rosete, containing an area of THIRTY FIVE THOUSAND EIGHT HUNDRED FIFTY-NINE (35,859)
square meters, more or less;"

PARCEL 3

"A parcel of agricultural land identified as Lot No. 7611, Cad 537-D San Miguel Cadastre, located at Libus
Gua, San Miguel, Surigao del Sur, covered by Katibayan ng Orihinal na Titulo Big. P-30810, registered in the name
of Delia L. Rosete, containing an area of TWELVE THOUSAND FIVE HUNDRED ONE (12,501) square meters,
more or less;"

4. That I asked Spouses Emelio Granaderos America and Lucifin Bucay America to give me the Title of the
three (3) parcels of land but they refused;

5. That I reported the incident to the Barangay and ask their assistance;

A copy of the said Brgy. Summon is hereto attached as ANNEX "C" and made an integral part of this
Affidavit;
 6. That despite repetitive demands and efforts, the vendor Spouses Emelio Granaderos America and Lucifin
Bucay America refuses to surrender the said Title;

A copy of Brgy. Certification and Demand Letter are hereto attached as ANNEX "D" and ANNEX "E"
made an integral part of this Affidavit;

7. That by virtue of the execution of the Deed of Absolute Sale between me and Spouses America, I was
able to own the said parcel of land in favor to me;

8. The Vendor fails to deliver to the Vendee the Duplicate Certificates of Titles over the three (3)
properties;

9. I am therefore executing this Affidavit for the purpose of attesting to the truthfulness of the foregoing
allegations and in support of my request for the annotation of an adverse claim over the above-described three (3)
parcels of land;
