ANSWER

I, PCpl Bill Jordan Balladeng Acnam, member of the Philippine National Police
and presently assigned at Paz Police Community Precinct, after having been duly sworn
to in accordance with law, do hereby depose and state that:

1. That I am the respondent of the above-titled administrative case, particularly in

Serious Irregularity in the Performance of Duty;

2. That I am adapting my Affidavit of Explanation and Comment/Counter-Affidavit

dated July 12, 2023 and July 24, 2023 respectively submitted to this Honorable Office, a
copy of which is hereto attached as Annex 1;

3. That on July 12, 2023, PUPC LYLE FERNANDEZ y ANGUAS was brought to
Manila City Hall for inquest proceedings for the violation of the above-mentioned laws
by PSSg Rolando D Capuz and PCpl Bill Jordan Acnam in which the suicide incident
transpired;

4. At around 9 o’clock in the morning, the suspect and the undersigned were
already at the 3rd floor of the Manila City Hall for the conduct of the inquest proceedings.
The inquest proceedings commenced at around 10:40 in the morning because the duty
investigating prosecutor was currently in a meeting at Manila Hotel.

5. That about 11:00 in the morning, the inquest proceedings have concluded. I,
was inside the Prosecutor’s Office together with the complainants;

6. That PSSg Capuz on the other hand, was outside the Prosecutor’s Office
together with the suspect and the City Security Force (CSF). I was inside the
Prosecutor’s Office assisting and attending the inquiries of the complainants. The
inquest proceedings were facilitated outside to avoid tension between the suspect and
the complainants;

7. That during the inquest proceedings, PSSg Capuz together with the City
Security Force (CSF) kept a watchful eye on the suspect by closely monitoring every
action of the latter and even anticipating any attempt to escape or cause harm to
himself or others;

8. That after the inquest proceedings, PSSg Capuz instructed the suspect to
approach me for the purpose of going back to Ermita Police Station 5 for his detention
and waiting for the disposition of the Court;

9. That as they were about to head towards the parking lot where the mobile
was, the City Security Force (CSF) suddenly approached and informed PSSg Capuz

regarding a piece of information about a drug personality linked to a previous
entrapment (buy-bust) operation conducted by Police Station 5;

10. That at that very moment, the suspect suddenly ran towards an open
window and jumped off the building. PSSg Capuz tried to stop the suspect but to no
avail upon exerting diligent efforts to do so;

11. That PSSg Capuz and I rushed down the building to check upon the
condition of the suspect. Prompt medical attention was given by the MDRRMO who was
in the area at the time of the incident;

12. That I immediately informed PCpl El-Ar Malonzo via phone call, who at that
time was with PCPT ALBERT C BADIOLA, Paz PCP Commander, relative to the
circumstances of the incident; and

13. That PCT ALBERT C BADIOLA, Paz PCP Commander, immediately

proceeded to the place of incident to monitor and supervise the situation;

14. That based on the abovementioned circumstances, I respectfully DENY the

charge against me and that I am in good faith and exercising due diligence in the
performance of my duty as police security escort, also have the duty to assist the
complainants and assure that the Prosecutor has finally adduced all the information
necessary to support the case against the suspect, hence, I should not be charged
administratively.

15. Accordingly, the undersigned, in the performance of his regular duty of

assisting the complainant and assuring that the Prosecutor has finally adduced all the
information necessary to support the case against the suspect, submits that he should
not be charged with Serious Irregularity in the Performance of Duty pursuant to PNP
POP 2021 in relation to that incident. Thus, it is most respectfully prayed that this
Complaint against me be DROPPED AND CLOSED for utter lack of merit and for lack
of substantial basis.

WHEREFORE, premises considered, respondent respectfully prays before this

Honorable Hearing Officer to DISMISS the complaint against me for lack of merit and
lack of substantial evidence, and for other relief that may be just and equitable under
the premises.
