CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS: This CONTRACT OF LEASE, made and
entered into this ___day of May, 2023 at the City of Malaybalay, by and between:

RHEA AIREEN OSUNA-SUSON, of legal age and residing at 22 Rue Jean-Talon, Appt.
8, Riviére-du-loup, Quebec, Canada G5R 4H6, represented by her mother TESSIE
OSUNA residing at 01-07 Rodano street, Heights, Malaybalay City as its authorized
representative hereinafter referred to as the LESSOR,

-and-

ANTONIO R. GONZALES, also of legal age and with residential address at Houston,
Texas, USA and currently at Malaybalay City, Bukidnon, and hereinafter referred to as
the LESSEE,

WITNESSETH: That

WHEREAS, the LESSOR is the registered and absolute owner of a house and lot
situated at Lot 9, block 10 NHA Phase I, Casisang Malaybalay City Bukidnon. Attached
is a photocopy of TCT to form part of this contract as Annex “A”;

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the
LESSEE is willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR
leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR the
LEASED premises, subject to the following:

TERMS AND CONDITION

1. PURPOSES: that premises hereby leased shall be used exclusively by the


LESSEE for residential purposes only and shall not be diverted to other uses. It
is hereby expressly agreed that if at any time the premises are used for other
purposes, the LESSOR shall have the right to rescind this contract without
prejudice to other rights that may be availed of under the law.

2. TERM: This term of lease is for ONE (1) YEAR. from December 9, 2023 up to
December 9, 2024. Upon its expiration, this lease may be renewed under such
terms and conditions as may be mutually agreed upon both parties. Written
notice of intention to renew the lease shall be served to the LESSOR not later
than one (1) month prior to the expiry date of the period herein agreed upon;

3. RENTAL RATE: The monthly rental rate for the leased premises shall be TEN
THOUSAND PESOS (P10,000.00), Philippine Currency, payable every 9 th day of
the month which shall be paid by depositing the payment through the bank
account of the LESSOR in metrobank account number 7283734072606-account
name Rhea Aireen Suson or through her Gcash Account;

4. DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this
contract and prior to move-in an amount equivalent to the rent for TWO (2)
MONTHS or the sum of TWENTY THOUSAND PESOS (P20,000), representing
one (1) month deposit and one (1) month advance. Wherein the one (1) month
advance shall be applied as rent for the 12 th month if ever the contract will not be
renewed or upon termination of contract prior to its expiry due to valid causes.
That the deposit shall not be considered as payment for rental but will be
reimbursed by the LESSOR upon the termination of this contract, unless the
leased property suffers damages or the LESSEE has unpaid utility and water bills
in which case, said bills and damages will be paid out of the deposit;

A. That the deposit will be forfeited if the LESSEE will terminate the contract
before the end of the term without valid causes of its termination;

5. DEFAULT OF PAYMENT: In case of default by the LESSEE in the payment of


the rent for TWO (2) months, the LESSOR at its option may terminate this
contract and eject the LESSEE. The LESSOR has the right to padlock the
premises when the LESSEE is in default of payment for TWO (2) months and
may forfeit whatever rental deposit or advances have been given by the
LESSEE. The LESSOR shall have the option to take position of any tangible and
valuable property to offset the amount of rental arrears without the need of
judicial action and in case the leased premises shall be abandoned, vacated or
deserted for a period of one (1) month, without any previous notice to the
LESSOR and during the time the LESSEE is in default in the payment of the
monthly rental, then under such circumstances the LESSOR can consider the
leased premises as legally abandoned and may enter the premises and take
possession thereof without prejudice to its right of action against the LESSEE;

6. SUB-LEASE: The LESSEE shall not directly sublet, allow or permit the leased
premises to be occupied in whole or in part by any person, form or corporation,
neither shall the LESSEE assign its rights hereunder to any other person or entity
and no right of interest thereto or therein shall be conferred on or vested in
anyone by the LESSEE without the LESSOR’S written approval;

7. PUBLIC UTILITIES: The LESSEE shall pay for its electric, water and other public
services and utilities during the duration of the lease;

8. FORCE MAJEURE: If whole or any part of the leased premises shall be


destroyed or damaged by flood, lightning, typhoon, earthquake, storm, riot or any
other unforeseen disabling cause of acts of GOD, as to render the leased
premises during the term substantially unfit for use and occupation of the
LESSEE, then this lease contract may be terminated without compensation by
the LESSOR or by the LESSEE by notice in writing to the other;

9. LESSOR’s RIGHT OF ENTRY: the LESSOR under its authorized representative


shall after giving due notice to the LESSEE shall have the right to enter the
premises in the presence of the LESSEE or its representative at any reasonable
hour to examine the same or make repairs therein or for the operation and
maintenance of the building or to exhibit the leased premises to prospective
LESSEE, or for any other lawful purposes which it may deem necessary;

10. That all improvements to be made or introduced on the premises shall require
the prior consent of the LESSOR and that improvement that can no longer be
removed by the LESSEE shall become the property of the LESSOR and that the
expenses of such improvement may be deducted from the payment of its rent
upon agreement of the LESSOR and LESSEE;

11. That any expenses for repair arising from damage willfully and knowingly caused
by the LESSEE on the premises shall be shouldered by the LESSEE;

12. That if said premises is not surrendered to the LESSOR at the expiration of the
lease contract, the LESSEE shall be responsible to the LESSOR for all damages
which the LESSOR may suffer by reason thereof;
13. That the LESSEE hereby agrees to return the leased premises at the expiration
of the contract in as good a condition as reasonable wear and tear will permit
without any delay whatsoever;

14. The LESSOR reserves the right to increase the rental rate by ten (10%) per cent
after one (1) year and the contract is renewed by mutual agreement of the
parties. The LESSOR will inform the LESSEE three (3) months before the
expiration of the contract if it will opt to increase the rent upon renewal;

15. That the LESSEE is obliged to observe cleanliness and maintain peaceful
condition inside and outside the premises;

16. That the LESSEE hereby warrants that he read and understood all the foregoing
provisions of this contract and shall abide by the same, otherwise, any violation
will subject the LESSEE to ejectment and other legal sanctions.
