DEED OF DONATION INTER VIVOS

KNOW ALL MEN BY THESE PRESENTS:

This instrument executed in Daet, Camarines Norte, Philippines by and among:

____________________, of legal age, married/single, Filipino and presently

residing in San Vicente, Camarines Norte, herein after called the DONOR; and

____________________, all of legal age, married/single Filipinos and residents

of San Vicente, Camarines Norte, herein after called the DONEES;

WITNESSETH THAT

The DONOR is the owner of a _____________ of the following described

property as follows:

PARCEL 1

A parcel of land situated in Calintaan, Talisay, Camarines Norte, identified as Lot

1222 Cadm. 456-D, containing an area of .2775 ha. more or less. Bounded on the N, by
Lot 1220; on the E, by irrigation canal and Lot 1202; on the W, by Lot 1224 and on the S,
by irrigation canal and Lot 1002, covered by TCT No. T-59054 and declared under ARP
No. 005-00142;

That on January 15, 2003, herein DONOR and DONEES, Marsha and
Christopher, both surnamed Hernandez, extra-judicially partitioned the one half (1/2)
portion of the said properties, which portion was the share of the deceased, Benjamin
Hernandez, herein parties’ predecessor-in-interest, in such a way that the (1/3) undivided
share thereof was adjudicated in favor of the herein donor and the other 1/3 each went to
donees, Marsha and Christopher, but without including BENIEDICK I. HERNANDEZ in
the partition. The said Deed of Extra-judicial Settlement was acknowledged before
Notary Public Atty. Fernando F. Dialogo under Doc. No. 24; Page No. 6; Book No. 1;
Series of 2003;

That for and in consideration of the love and affection which the DONOR holds
to the DONEES, herein DONOR hereby transfers and conveys, by way of DONATION
INTER VIVOS unto the said DONEES, their successors and assigns, her entire share
consisting of one half (1/2) of the entire property plus her one third (1/3) share of the
other one half (1/2) subject of the earlier partition above described, free from all liens
and encumbrances of whatever kind and nature saving and excepting those created by
operation of law. Provided however, that each of the DONEES shall receive only such
share as would equally divide the whole property among themselves in equal pro-
indiviso, including the one third (1/3) share each already adjudicated to Marsha and
Christopher in the aforesaid partition earlier made. Provided further that they may divide
the same in a manner agreed upon by them.

The DONEES hereby accept the donation of the above described property of the
DONOR, subject to such terms and conditions set forth herein and at the same time
express their sincerest appreciation, thanks and gratitude for the kindness, love and
liberality of the DONOR who, by these presents, also takes notice of the DONEES’
ACCEPTANCE thereof.

The DONOR hereby states that for purposes of giving effect to this DONATION
she had reserved for herself, in full ownership and/or usufruct, other properties sufficient
to support her in a manner appropriate to her status.
