EO Safe Spaces Act SSA 2024 Draft

WHEREAS, it is the policy of the State to value the dignity of every human person and
guarantee full respect for human rights. It is likewise the policy of the State to recognize the role of
women in nation-building and ensure the fundamental equality before the law of women and men.
The State also recognizes that both men and women must have equality, security and safety not
only in private, but also on the streets, public spaces, online, workplaces and educational and
training institutions.
WHEREAS, since 1995, sexual harassment in the Philippines has been specifically
prohibited under RA 7877, otherwise known as the "Anti-Sexual Harassment Act of 1995".
However, the definition of sexual harassment under this law was limited and covered only the acts
committed in work, education, and training-related environments. Further, it does not penalize the
acts of sexual harassment committed in many other spaces such as the streets, in restaurants and
malls, public utility vehicles (PUV) and other public spaces.

for human rights. It is likewise the policy of the state to recognize the role of women in nation-
building and ensure the fundamental equality before the law of women and men. The State also
recognized that both men and women must have equality, security and safety not only in private
spaces but also in public spaces.
WHEREAS, the passage of RA 11313, otherwise known as the Safe Spaces Act (SSA)
expands the law on sexual harassment in the country to cover all of its forms including verbal and
physical. Further, it seeks to secure all persons regardless of sex, sexual orientation and gender
identity expression, from all kinds of gender-based violence and discrimination such as sexual
harassment, not only in private spaces but also in public spaces.
WHEREAS, the Department of the Interior and Local Government and Philippine
Commission on Women Joint Memorandum Circular No. 2020-01 dated December 7, 2020 provide
the guideline son the localization of the Safe Spaces Act and its IRR particularly the provisions of the
CGSH in streets and public spaces.
NOW, THEREFORE, I,
Section 1. Establishment of the Barangay Anti-Sexual Harassment Task Force (BASH-TF). The
BASH-TF of Barangay , Mendez Nuñ ez, Cavite is hereby organized and shall be
composed of the following:
Section 2. Functions of the BASH-TF. The BASH-TF shall have the following functions:
2.2 Designated public spaces regardless of ownership and nature as safe spaces against
GBSH;
2.3 Ensure the participation of Anti-Sexual Harassment Enforcers (ASHES), Anti- Sexual
Harassment Desk Officer and members of the Katarungang Pambarangay in gender-sensitivity
training orientation on Safe Spaces Act and protocols in responding to GBHS in streets and public
spaces;
2.4 Develop and distribute Information and Education Campaign materials developed by
the municipality and other entities that raise awareness for the concerns GBSH in streets and public
spaces;
2.5 Create a mechanism for handling and documentation of complaints including those
cases covered by the Katarungang Pambarangay system;
2.7 Ensure the setting-up and maintenance of functional CCTV cameras in major roads,
alleys and sidewalks in their respective areas to ais in the filing of cases and gathering of evidence
as well as in the prevention of GBSH in streets and public spaces.
Section 4. Functions of Barangay Anti-Sexual Harassment Enforcers (BASHES). The ASHES shall
have the following functions:
4.2 Immediately apprehend the perpetrator if caught in the act of committing the crime;
4.3 Immediately bring the perpetrators to the nearest police station for appropriate action;
and
4.4 Together with the Women and Children's Desk of the PNP stations, keep a ledger of
perpetrators for the purpose of determining if the perpetrators is a first-time, second-time or third-
time offender.
Section 5. Establishment of Anti-Sexual Harassment (ASH) Desk. The VAW Desk of the Barangay
which is located at shall also serve as the ASH Desk. It shall ensure that the
privacy of the victim-survivor is protected at all times. It shall also have the necessary furniture and
fixtures such as but not limited to table, chairs and separate filing cabinet where logbook and
tools/equipment for documentation are stored.
Section 6. Designation of the ASH Desk Officer (ASH-DO). The VAW Desk Focal Person
shall serve as the ASH Desk Officer, the ASH-DO shall be trained on the forms of
sexual harassment, as well as the functions and protocols in responding to GBHS in streets and
public spaces.
Section 7. Functions of Barangay Anti-Sexual Harassment Desk Officers (BASH-DO). The ASH-
DO shall have the following functions:
7.2 Facilitate the referral of cases and persons to the appropriate public and private service
providers for further assistance such as legal, medical, psychosocial, safety, security and other
services;
7.3 Record the number of cases of GBHS in streets and public spaces received and referred
to other agencies and submit a quarterly report to the DILG Municipal Field Office and the
Municipal Social Welfare and Development Office (MSWDO);
7.4 Keep case records confidential and secure and ensure that only authorized personnel
have access to these records;
7.5 Assist in the formulation/ updating of policies, development of plans, programs, projects
and activities and educational and awareness campaigns to address GBHS in streets and public
spaces;
7.6 Coordinate with pertinent agencies in monitoring the status of GHS-related complaints
and reports; and
Section 8. Establishment of BASH Hotline. The barangay shall institutionalize the ASH hotline,
with cellphone number . IEC materials containing the hotline shall be
reproduced, distributed and displayed in major convergence areas within the Barangay and shall be
posted in the Barangay's Official Social Media pages. The Duty-Officer of the Day shall also serve as
the operator for the ASH Hotline.
Section 9. Functions of Barangay Anti-Sexual Harassment Desk Hotline Operator. The ASH
Hotline Operator shall have the following functions:
9.2 Assess the nature of the assistance needed and facilitate the referral to ASH Desk or to
the appropriate service providers for legal, medical, psycho-social, safety, security, and other
assistance or services;
Section 11. Functions of Barangay Anti-Sexual Harassment Desk Referral Network (ASH-RN).
The ASH-RN shall have the following functions:
11.1 strengthen the coordination among public and private service providers in addressing
the needs of victim-survivors of gender-based sexual harassment; and
