PETITION FOR CANCELLATION OF ENCUMBRANCE under

SEC. 4 RULES 74, RULES OF COURT TCT No. 144438

PETITION

Petitioner, to the Register of Deeds, respectfully alleges:

1. Petitioner is a Filipino, Married, of legal age, and with Postal

address at B2 L32 Jasper St. Silvercrest Villas, Habay 1,
Bacoor Cavite;

2. Petitioner is the registered owner of a certain real Property

covered by TCT No. 144438 of the Register of Deeds of Pasay
City;

3. Annotated on the said title is the two (2)-year lien Covered by

“Sec. 4, Rule 74, of the Rules of Court” Which was annotated
on 09 Dec, 2002 under Entry No. 02-5263/T-144438

4. The two (2)-year period provided for under Section 4, Rule

74for the filing of claims against the estate of the Deceased
already lapsed without any claim having been Filed, thus the
necessity of cancelling the said Annotation.

PRAYER

WHEREFORE, premises considered, and by virtue of the Provision of

LRC Circular No. 119, petitioner respectfully Prays for the cancellation of
the annotation pertaining to Sec. 4, Rule 74 of the Rules of Court on TCT
No. 144438, Without any judicial pronouncement, 13 Dec, 2023.
