CONTRACT FOR SCHOOL OPERATION

BETWEEN

Bannawag Integrated School Teachers, Employees and Retirees Association (BISTERA), a local
chapter association through its Authorized signatory, WENILA L. MIRERA, BISTERA
President (hereinafter called the 'First Party') of the ONE PART.

AND

Bannawag Integrated School, a public institution having its principal place at Bannawag Sur
Diffun, Quirino through its authorized Signatory, ERLITO B. MADRIAGA, School Principal
(hereinafter called the 'Second Party') of the OTHER PART.

WHEREAS the First Party in a unanimous vote agreed, to


serve foods for the learners, teachers, employees, clients other visitors and guests by occupying
a certain place inside the school that will serve as its selling area;

AND WHEREAS, on the said representations of the First Party, the Second Party has accepted
the offer/ proposal of the First Party and agreed to permit the First Party to render canteen
services provided a memorandum of agreement shall be entered into and founded on the terms
and conditions mutually discussed, agreed upon and recorded hereunder:

NOW THIS AGREEMENT WITNESSETH AS UNDER:

1. This Agreement shall remain effective for one year and may be revised from time to time
according to the necessity that may crop up during progress of the contract by mutual consent. If
any of the parties wants to terminate the agreement during the tenure, it must give a notice of at
least three months. This agreement may be renewed after one year, if required with suitable
modifications on mutual discussions and consent.
2. If, the First Party fails to meet the expectation of Second Party or breaches the term of this
Agreement, Second Party will issue a written notification to rectify any such breaches of this
Agreement. The First party shall rectify and improve within fifteen (15)days of The First Party
written notification of such breaches, The First Party shall be entitled to terminate the service
with a 30 days notice if the company fails to comply to this.

3. That the Second Party awards the contract to set up facilities to provide food in the outlet of
the Second party's premises. The Second Party accepts the contract to supply foods and snacks
to the students, teachers, employees, clients, guests and visitors of the Second Party.

4. That to enable the First Party to offer the services, in terms of this Agreement, the First Party
agrees to provide the following:

a. An appropriate space inside the premises to install the equipment required by the Second
Party to provide the said services;

b. The rate fixed shall be exclusive of electricity, and Second Party shall not charge any amount
over and above the rates mentioned in the rate list which is as follows:

Monthly Rent-

Electricity- depends on the electric consumption based on the metric reading ( Meter)
owned and provided by First Party

c. The First Party shall keep the Canteen open from 7.00 a.m. to 5.00 p.m 5 days a week, from
Monday to Friday, except when required by the Second Party to offer services on other days, or
as the need arise.

d. The foods or menu and snacks to be served shall be in accordance with Deped Orders on
School Canteen Operation and by considering the feed back by School Canteen Committee
which shall comprise the Employees and the members from Second Party.

e. The First Party shall shall ensure that the canteen staffs and the premises are clean.

f. The First Party will not serve alcoholic beverages.

g. The First Party shall pay and give its rent in a monthly basis, and the wage of its employees
preferably parents of the learners of Bannawag Integrated School in a weekly basis.

h. That the First Party shall ensure that in the event of any complaint about the quality of the
food or snacks/beverages to be supplied or the hygienic conditions of the Cafeteria, the First
Party shall immediately withdraw the stale or sub-standard quality food and supply good quality
items and the First Party will be solely responsible and legally bound for it. The Second Party
shall have the right to inspect the quality of the items to be served and maintenance standards of
the canteen and offer suggestions, to the First Party from time to time without requiring any prior
permission.

SIR:

I am writing this letter to bring into your knowledge the plan of the plurality of the
BISTERA members of putting and operating a new canteen in our school to be managed by
the said association. Such plan were coined during the second quarterly meeting last March 5,
2023.

This rooted to the observation of everyone that the old and existing canteen has become
very crowded. Breaktime and lunchtime is the same for all of the classes and due to the
numerous learners from elementary to senior high school, many have to wait in lines for a long
time. At times many students have to go outside and buy foods and snacks from nearby stores
which is very dangerous for them. By the time we do get our turn, all the food has finished and
sometimes we have to stay hungry for the rest of the day. During lunchtime too, students have
to look for other stores to buy viand due to the scarcity of choices served in the old canteen
which is very bothering aside from the feedback that most of the foods served in the old canteen
are frozen. This affects the productivity in class of both the learners and teachers and has a
negative impact. Hence, the association had come up with an idea that that the school has
another canteen built so that it can become easier for students, teachers and employees during
break and lunch time.

Finally, by putting up a new canteen to be operated by the association, it will gradually


help the association generate resources to finance its project, programs and activities, all
will redound for the benefit of the school and the association members.

Please consider this proposal of having a new canteen built. Thank you for your time and
