Right to Work Guidance

In May 2014, the UK Visas and Immigration department published a series of guidelines and codes of
practice governing the documentation that must be viewed prior to a worker being engaged for
work on or after 16th May 2014 and where a repeat check on an existing worker is required to be
carried out on or after 16th May 2014.

Q. What is a right to work check for a temporary worker?

A. Right to work checks refer to the process of suppliers verifying individuals’ eligibility to work
in the UK and to carry out the work in question, in compliance with current legislation.

Q. What must the supplier do?

A. Please use the Government’s guidance on an Employers’ Right to Work Checklist to check a
candidate’s eligibility to work either in person (manually) or via an online service. Please
Note: Suppliers are required to conduct follow-up checks on candidates who have time-
limited permission to work in the UK. If unsure, Matrix recommends that suppliers seek
independent advice.

Q. How can a supplier complete an online right to work check?

A. If the candidate is NOT a British or Irish Citizen, the supplier must request a share code from
the candidate and complete a check using the Home Office checking service. If the candidate
is a British or Irish Citizen with an in-date passport, the supplier must conduct a right to work
check via an Identity Service Provider (IDSP).

For online right to work checks, this form is not required.

Q. How can a supplier complete a manual right to work check?

A. The supplier must meet the candidate face-to-face and complete a manual check if any of
the following apply:
1. The candidate cannot provide a share code, but holds an acceptable document listed in
the Employers’ Right to Work Checklist.
2. The candidate does not have an in-date British/Irish passport, but holds an acceptable
document listed in the Employers’ Right to Work Checklist.
3. The supplier does not have access to an IDSP.

This form must be completed for manual right to work checks.

 I have made a clear, uncropped copy of the candidate’s original documentation.
