SECTION ONE: COMMANDER-IN-CHIEF

ARTICLE 1
1.1 - The Commander-in-Chief is the highest officer of the Armed Forces of
Nueva España, they shall have the ultimate command authority over the Armed
Forces
1.2 - The Commander-in-Chief shall have the right to use the highest military
rank if they ask for it
1.3 - The Commander-in-Chief shall be empowered to:
a) Issue military orders and decrees, which shall be countersigned by Prime
Minister and Minister of National Defence
b) Appoint, or recall on the advice of the Minister of National Defence
Chairman, Vice Chairman and other members of the National Defence
Commission
c) Issue or remove officers into/from ranks above the general-grade
d) Declare martial law or state of war based on voting of the National
Assembly and the Government

SECTION TWO: ARMED FORCES OF THE


REPUBLIC OF NUEVA ESPAÑA

ARTICLE 2
2.1 - The Armed Forces of the Republic of Nueva España (AFRNE) shall be the
supreme institution of national defence and border security of Nueva España
2.2 - The Armed Forces shall be divided into three branches:
a) The Ground Forces
b) The Air Force
c) The Naval Force
2.3 - Each branch shall possess a Defence Commission, its Chairman and a
Commander, all shall be appointed by the National Defence Commission with
consent of the Ministry of National Defence
2.4 - The Armed Forces shall possess a rank structure, which shall resemble
NATO rank structure (i.e.: OR, OF grade ranks)
2.5 - The Armed Forces shall possess a budget provided by the Ministry of
National Defence and managed by the National Defence Commission
2.6 - The Armed Forces shall remain a non-politicised institution
SECTION THREE: NATIONAL DEFENCE
COMMISSION OF THE ARMED FORCES

ARTICLE 3
3.1 - The National Defence Commission (NDC) shall be the highest specialised
administrative institution of the Armed Forces, subordinate to the Ministry of
National Defence and responsible with execution and of day-to-day operations,
tasks and all forms of supplies of the Armed Forces
3.2 - NDC shall consist of the President of the Republic, the Prime Minister,
Minister of National Defence, Chairman, Vice Chairman and other members
appointed by the President on the advice of the Minister of National Defence
3.3 - For becoming an appointed member (this also applies for Chairmanship
and Vice Chairmanship) of the National Defence Commission, an individual
must:
a) Served in the Armed Forces for at least 15 (irp) years
b) Not be involved with political activities of any kind
c) Be of at least the rank of Major
d) Have a masters degree from a Military Academy/University
3.4 - The National Defence Commission shall be empowered to:
a) Direct the whole armed forces and defence upbuilding of the State
b) Establish or abolish central bodies in the field of national defence
c) Appoint or recall members of Defence Commissions of the Branches,
Commanders of the Branches and other branch cadres
d) Nominate soldiers for ranks above the general-grade to the President
(Commander-in-Chief)
e) Issue orders and decisions which shall be countersigned by Chairman of
the National Defence Commission
3.5 - National Defence Commission is a subject of the Ministry of National
Defence, accountable to it for its actions
3.6 - Military doctrine, policies etc. which the National Defence Commission
passes are subject for approval by the Ministry of National Defence, which may
veto the decisions

ARTICLE 4
4.1 - The head and chief executive of the National Defence Commission shall
be the Chairman of National Defence Commission
4.2 - The NDC Chairman shall be appointed or recalled by the President on the
advice of National Defence Minister
4.3 - The Chairman shall represent the Commission domestically and abroad,
the Chairman shall be accountable for their actions to the Ministry of National
Defence
4.4 - The Chairman of National Defence Commission shall be the
administrative head of the Armed Forces
4.5 - The Chairman shall be empowered to:
a) Direct, suggest or issue the policies of the National Defence Commission
b) Issue orders and regulations on behalf of the Commission, which shall be
countersigned by the Minister of National Defence
c) Veto policy suggestions of the National Defence Commission, the
Commission is empowered to overrule such veto with a two-thirds
majority vote
d) Preside over meetings of the Commission
e) Represent the Commission
4.6 - The term for National Defence Commission and all of its appointed
members shall be the same as the term of the President (Commander-in-Chief)

SECTION FOUR: MINISTRY OF NATIONAL


DEFENCE

ARTICLE 5
5.1 - The Ministry of National Defence shall be a ministerial department of the
Government of Nueva España responsible with management of the Armed
Forces
5.2 - The Ministry of National Defence shall be headed by a Minister, who shall
be assisted by a Deputy Minister
5.3 - Deputy Minister shall be appointed by the Prime Minister on the advice of
the Minister of National Defence
5.4 - The Ministry of National Defence shall be tasked with:
a) Creating, issuing and executing important military doctrines and policies
b) Create basis and manage the overall administration of the Armed Forces,
accompanied by the National Defence Commission
c) Manage the Defence Budget and spend the budget
d) Manage the all forms of logistical supplies of the Armed Forces
e) Manage the equipment of the Armed Forces
f) Issue orders and decisions, subject for approval of the Prime Minister
5.5 - The Minister of National Defence shall be empowered to:
a) Lead the Ministry
b) Nominate the Deputy Minister
c) Direct, regulate and issue the work of the Ministry
d) Regulate and supervise the policies and decisions made by the National
Defence Commission
e) Represent the Ministry in domestic and internal affairs

SECTION FIVE: RANKS OF THE ARMED FORCES

ARTICLE 6
6.1 - The Armed Forces shall use a western-styled rank structure, based on the
NATO codes of OR and OF
6.2 - The Ranks above general-grade shall be issued to the officers by the
President (Commander-in-Chief) on the advice of the National Defence
Commission
6.3 - The Ranks shall be divided between the Ground Forces, Air Force and the
Naval Forces
6.4 - The Ranks of the Ground Force and the Air Force:

6.5 - The Ranks of the Naval Force:

SECTION SIX: ENACTMENT

ARTICLE 7
7.1 - The Act shall be enacted by the National Assembly and the President
through a simple majority vote, all laws and acts in direct violation of this Act
shall be hereby annulled
