 JOBEST STUDIO AGREEMENT
for Photography & Videography Services

Entire Agreement

This agreement contains the entire understanding between JOBEST STUDIO and the CLIENT. It
supersedes all prior and simultaneous agreements between the parties. In the following conditions
of agreement “PHOTOGRAPHER & VIDEOGRAPHER” shall mean any photographer(s) and
videographer(s) appointed by JOBEST STUDIO. “CLIENT” shall be those whose names appear on
the agreement. If the client arranges for a third party to meet the costs of this agreement the
agreement remains with the client. The due performance of the contract is subject to the conditions
below and cannot be varied in any way by the clients unless expressly agreed by the
Photographer/Videographer in writing.

Reservation

Upon your signature and payment of the Reservation Deposit, Jobest Studio will reserve the time
and date agreed upon, and agrees not make other reservations for that time and date. For this
reason, the Reservation Deposit as set forth in this agreement is non-refundable, non-
transferable, even if the event date is changed or wedding cancelled for any reason, including
acts of God, fire, strike, pandemic and extreme weather. If the Event to be photographed is
postponed to a different date, the deposit and any advances made may be used as credit towards the
Event on the new date only if the Photographer/Videographer is available on the new date. This
contract is validated and enforced after the 1st payment (deposit payment) is received.

Payments

The Client agrees to make the reservation deposit to retain the Photographer/Videographer to
perform the services specified herein. The remaining balance must be paid as set forth in the
payment terms. Payments may be in the form of cash or bank deposit/transfer. Bank
deposit/transfer please email copy of remittance slip/receipt as proof of payment.

 Exclusive Photographer

The photographer(s) & videographer(s) appointed by JOBEST STUDIO shall be the exclusive
professional photographer(s) & videographer(s) retained by the Client for the purpose of
photographing the event. Family and friends of the Client may photograph the event as long as they
do not interfere with the Photographers’ duties. The Client shall indemnify the photographer and
JOBEST STUDIO against loss of photographic opportunities due to interference by family and
friends or any other party who may be photographing or video graphing the event.

Cooperation

The parties agree to cheerful cooperation and communication for the best possible result within the
definition of this assignment. The Photographer is not responsible if key individual’s failure to
appear or cooperate during photography sessions or for missed images due to details not revealed to
the Photographer. The Photographer recommends that the Client designate an "event guide" to
point out important individuals for informal or candid photographs to the Photographer during the
wedding; that they wish to have photographed. The Client is responsible for the conduct of their
guests. The Photographer will not tolerate verbally or physically abusive behavior, nor will he/she
share his/her time or compete with guest photographers for the attention of the subjects. Unchecked
guest conduct that interferes with the photographer’s job will seriously affect the quality of the
photographs taken. If the Client is unable to control the conduct of their guests or if the conduct of
any of their guests is damaging to the photographer or his/her equipment, it will result in the early
or immediate departure of the photographer. Client agrees that in such an event, no refunds will be
given.

Artistic Style And Creative License

On its own behalf, and on behalf of the subject: Client acknowledges that it is familiar with the
Photographer’s portfolio and is requesting Services of the Photographer’s style; that Photographer’s
work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the
photos may be different from photographs taken by the Photographer in the past; and that in
creating the photos, the Photographer shall use his personal artistic judgement to create images
consistent with his personal vision of the Event, which vision may be different from the Client’s
and / or the Subject’s vision of the Event. Accordingly, Client acknowledges that the Photos shall
not be subject to rejection on the basis of taste or aesthetic criteria. Due to changes of the weather,
unforeseen circumstances, availability and willingness of subjects, the Photographer(s) will do their
best to honor requested Images but does not undertake to guarantee any specific picture nor
incorporate any specific background, location or group arrangement.

 COPYRIGHT & LICENSE TO USE

It is understood that JOBEST STUDIO owns the copyright of all photographic materials created,
including but not limited to negatives, transparencies, proofs, digital files (including RAW, Tiff,
JPEG), and previews. JOBEST STUDIO shall have the exclusive right to make reproductions. The
Client hereby grants JOBEST STUDIO and its legal representatives and assigns, the irrevocable
and unrestricted right to use and publish photographs of the Client or in which the Client may be
included, for the Client or for JOBEST STUDIO portfolio, samples, self-promotions, entry in
photographic contests or art exhibitions, advertising, illustration, editorial use, or for display within
or on the outside of the studio, including printed materials, media on the World Wide Web, and any
current or future digital media. If JOBEST STUDIO desires to make other uses, JOBEST STUDIO
may do so without oral or written permission of the Client.

Client’s Usage

The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any
reproductions thereof by parties other than JOBEST STUDIO. If the Client is obtaining a print for
newspaper announcement of the wedding, JOBEST STUDIO authorizes the Client to reproduce the
print in this manner. In such event, Client shall request that the newspaper run a credit for, adjacent
to the photograph, but shall have no liability if the newspaper refuses or omits to do so. If the Client
purchases limited, non-exclusive usage rights to digital files, such usage shall be for personal,
noncommercial use only.

Images

The Photographer will provide a pleasing colour balance but cannot guarantee accurate image
colour or skin tone matching owing to aesthetic tastes in post processing, environment, decoration,
lighting used in event venue, differences in display media technology, calibration and viewing
environment. Only JPEG (JPG) format files will be given to the Client.

Retouching / Editing

Only basic retouching & editing to all images are provided, which includes exposure, white balance
correction, cropping and straightening. If the Client requires advance retouching or editing for
example skin smoothing, whitening, image enhancement etc., a third party service will be engaged
whereby the Client agrees to bear the additional costs involved.

Inherent Qualities

Client is aware that color dyes in photography may fade or discolor over time due to the inherent
qualities of dyes, and Client releases the Photographer from any liability for any claims whatsoever
based upon fading or discoloration due such inherent qualities. Client is also aware that the
Photographer is not responsible for the quality of re-prints made by the client.

 Selection Schedule

Photographs ready for selection process will take up to 3 months (90 working days) from the date
of the last function. JOBEST STUDIO may reserve the right to exceed completion timescales,
especially during busier periods and this is in order to give the proper time, attention and care to
your final photographs and ensure the quality of the final product.

Album Design and Amendments

Upon completion of image selection by the Client, JOBEST STUDIO will undertake the design of
the custom album as per the Invoice. Any request for amendments to the layout of the custom
album by the Client will only be allowed once. After which the layout of the album is deemed final.
The Client agrees that the Client has viewed samples of JOBEST STUDIO work and is completely
satisfied with its quality, capability and artistic style. Client's request for changes to accommodate
aesthetic or personal tastes will not be allowed. Client’s are required to complete the image
selection within 90 days of receiving the access to the selection gallery via email. Failure to do so
will result in JOBEST STUDIO doing the selection on their own and proceeding with the album
design, in which case no request for changes will be allowed.

Limit Of Liability

In the unlikely event of severe medical, natural, or other emergency where it could be necessary to
retain a different Photographer, JOBEST STUIO will make every effort to secure a skilled
replacement Photographer. If the situation should occur and a suitable replacement is not found,
responsibility and the Photographer’s liability is limited to only returning payment amount
received. The Photographer takes the utmost care with respect to exposure, transportation, and
processing the photographs including using professional grade equipment and professional grade
backup equipment. However, in the unlikely event those photographs have been lost, stolen, or
destroyed for reasons within.

Arbitration

All disputes arising under this Agreement shall be arbitrated in Kuala Lumpur, Malaysia under the
laws of Malaysia. Judgment on the arbitration award may be entered in any court having
jurisdiction. Client shall pay all arbitration and court costs, reasonable legal fees and expenses, and
legal interest on any award or judgment in favor of the Photographer.

Performance

The performance of this contract on behalf of JOBEST STUDIO shall be contingent upon acts of
God, flood, fire, warfare, pandemic, government laws or regulations, electrical failure, strikes by
suppliers, and/or conditions beyond its control.

 Terms and Condition

The terms and conditions of this agreement supersede any and all expressed or implied terms and
conditions of client’s purchase order, voucher or cheque (payment). Any exceptions of terms and
conditions must be negotiated and stated here in as amendment(s).
I have read and fully understand the schedule and terms of agreement of this contract and realize
that this contract becomes effective immediately once deposit payment. I agree that cancellation
conditions will apply in case of cancellation by me.
