GLOSSARY OI R&R 1LRMS
Assistance

All support mechanisms such as monetary help, serices or assets gien to
PAPs ,Project Aected Persons, or PAGs ,Project Aected Groups,
constitute assistance in this project.

Compensation

Compensation reers to restitution made to the property under the priate

negotiation process or under 1Nl\ Act, 2001. In this context, it reers to
payment made by the Goernment exercising Lminent Domain`.
Corridor of Impact (CoI)

1he Corridor o Impact ,CoI, is the width required or the actual construction
o the ,bypass, road including the carriageway, shoulder, embankment,
longitudinal drainage, wayside amenities like bus stops, bus shelters, etc. and
necessary saety zones. In this project, the CoI is proposed or a minimum
width o 18 m and maximum width o 2 m.
Cut-off Dates

Cut-o date is established to identiy and enumerate the Lntitled Persons. 1he
last date o census surey will be the cut-o date or non-titleholders
occupying the Ro\. lor legal owners, the cut-o date will be the date o
notiication declaring the intention to acquire the property. lor those legal
owners who are not agreeable to compensation through negotiations, the date
o sering the notice u,s 15,2, o 1amil Nadu ligh \ay Act, 2001 will be
established as the cut-o date.
Lncroacher

Any person, illegally occupying public property by extending their land
boundary or a portion o their building into the CoI, is an encroacher.
Squatter

Any person, occupying structures entirely within the CoI ,with no legal rights
to occupy that parcel o Goernment land, or residential and,or business
purposes, is a squatter.
1enant

Any person by whom or on whose account rent is payable or any property.
Lntitled Person (LP)

Lntitled Person includes all PAPs who qualiy or and entitled to compensation
, assistance since being impacted by the project. 1he basis or identiication o
Lntitled Persons ,LP, in the project will be the cut-o date.
Pucca Buildings

uildings o a permanent construction type with reinorced concrete or Madras
terrace roos.
Semi-Pucca Building

uildings o a semi-permanent type with tiled roo and walls not o concrete or
permanent brickwork
utcha Building

utcha building means a temporary type o structure, which includes building
with roos constructed o thatch, galanized iron or asbestos.
Major Impact

1he PAls suering the ollowing impacts are categorized as Major Impact:

Minor Impact
A PAl suering minor impact is one who is aected to a lesser degree than
the major impacts deined aboe. Compensation or minor impacts will be
limited to one-time payment o cash or giing adance notice.
Minimum Wages
1he wage o a person or his,her serices,labour to be paid, during the
implementation time, at the rate as recommended by the P\D Schedule o
Rates.
Non-Perennial Crop
Any plant species, either grown naturally or through cultiation that lies or a
season and perishes with haresting o its yields hae been considered as a non-
perennial crop in the project. lor example, paddy, sugarcane, groundnut, etc.
Perennial Crop
Any plant species that lie or years and yields its products ater a certain age o
maturity is a perennial crop. Generally trees, either grown naturally or by
horticultural and yield ruits or timber hae been considered as perennial crop
in the project. lor example, tamarind, coconut, mango, teak, neem etc. are
perennial crops.
Persons Losing their Livelihood
Persons losing their lielihood are indiidual members o the PAl, who are at
least 18 years o age and are impacted by loss o primary occupation or source
o income.
Private Property Owners
Priate property owners are persons who hae legal title to land, structures or
other assets. 1hese property owners are entitled to compensation.
Project Affected Group (PAG)
Any group or community aected by the project is a Project Aected Group
,PAG,.
Project Affected Household (PAH)
Any house liing, cultiating land or carrying on business, trade or any other
occupation within the Corridor o Impact ,CoI, who are impacted by the
project are a Project Aected louseholds. All the members o PAls in the
project will be treated as PAPs.
Project Affected Person (PAP)
Any indiidual ,part o the PAls, liing, cultiating land or carrying on
business, trade or any other occupation within the Corridor o Impact ,CoI,
who are impacted by the project is a Project Aected Person ,PAP,.
Replacement Cost
1he amount required or an aected person to replace the lost asset through
purchase in the open market.
Residual Land
Residual land can be deined as the remaining portion o land let with the
owner o the holding, ater acquisition o land or the project
Severance of Land
Seerance o and can be deined o a land holding, diided into two and more
separate pieces due to acquisition o land, mainly or laying new project
alignment, such as a bypass or a re-alignment.
Women Headed Household
A household that is headed by a woman and does not hae a male earning
member is a \oman leaded lousehold. 1his woman may be a widowed,
separated or deserted person.
'ulnerable Group ('G)
Vulnerable Group includes but is not limited to the ollowing categories:
O PAls alling under elow Poerty ine` category as identiied by
the State

O Persons who belong to Schedules Castes ,SC, and Scheduled 1ribes

1he cut-o income leels or extending beneits under the Poerty Alleiation
Program during the 9

Plan period or 1amil Nadu are nominated as Rs.269.0
and Rs.381.01 per capita per month or rural and urban area respectiely.
1hus, in 1NRSP or an aerage amily o 5 considering 25 increase in the
state P leel, the accepted annual income leels or P people in rural and
urban areas come around Rs.20, 180, and 28,56, respectiely. At present,
the income level for BPL people in rural area, is Rs.2S, 22S/- pa or Rs.2,
J02/- pm and or urban area, Rs.32, 00,- pa or Rs.2, 2,- pm.
1. PAPs up to 14 years hae been considered as children, while those oer 60
years o age hae been considered as elderly people in the project.


LXLCU1I'L SUMMARY



1he Goernment o 1amil Nadu ,Go1N, has undertaken the 1amil Nadu Road
Sector Project ,1NRSP, or implementing this project with \orld ank ,\, loan
assistance. M/s Consulting Lngineering Services (I) Pvt Ltd has been appointed
or assisting the PIU ,Project Implementing Unit, in the preparation o RAP or this
project. 1his RAP has been prepared or umbakonam ypass Lxtension only, based

on the outputs o easibility studies or the ormation o a road length o 4.080 m.
1he Resettlement Action Plan ,RAP, or umbakonam ypass Lxtension under
1amil Nadu Road Sector Project ,1NRSP, contains the magnitude o and
Acquisition and mitigation o impacts. 1his report also includes the baseline socio-
economic characteristics o the Project Aected households ,PAls,, R&R policy
proisions, entitlements, outcomes o the consultations held with the communities,
implementation and monitoring mechanisms, budget and implementation o the R&R
proisions.
Minimum acquisition o land and minimum disturbance to the existing eatures are the
prime objecties o the design. Socially sensitie stretches hae been aoided by
means o detailed study o dierent alternatie alignments. Minimization o impacts
within the limitations o technical requirements and cost eectieness were
emphasized.
1o address the resettlement issues in the project, the Go1N has adopted a
Resettlement and Rehabilitation Policy or the project ,ide GO.Ms.No.193 dated
10.08.1998,. 1he RAP has been prepared as per the proisions laid down in this
policy. 1he entitlements and options or each impact category hae been proided in
the detailed entitlement matrix. 1his matrix has been ormed the basis or
ormulation o entitlement options and enabled the working out o the R&R budget
or the project.
Due to the project, totally 199 households are getting aected by losing land or
structures, land and structures. Out o them 184 PAls are losing land only, 5 PAls
are losing structure only, 10 PAls are losing land and structure. On the title holders
who lose their structures, resettlement sites or 11 Nos o PAls are required as they
hae opted or alternatie houses. 1hese PAls will be allotted each a house in the
resettlement sites with necessary inrastructure acilities. During the Public
Consultation meeting, they hae been apprised o the option o the alternatie houses,
as per the Lntitlement Matrix.
1otal land requirement in the project is JJ.J747 Ha. Out o which 7.090S Ha rom
priate landowners, 0.3233 Ha o 1rust land, J.90J6 Ha o 1emple land and J.8S93
Ha o Goernment land will be acquired.
Only the lands o 1emples and 1rusts are aected and no temples are aected. 1he
temple and trust authorities are eligible or compensation only.
1he proposed project has no impact on 1ribal population and there is no loss o
community resources, also. 1he proposed alignment was inalized based on the
concerns and responses o likely PAPs, indiidual consultations with the PAPs during
the census sureys, public meeting held with the local communities inoling PAPs
and Goernment agencies to minimize the aderse impacts.
1here was oer- whelming response rom the public who welcomed the proposal to
construct the bypass and 100 o the people are in aor o the bypass.
1he socio-economic conditions o the PAls are urnished as ollows.
Income Level
1he income o the arious groups reeal that 15 o the PAls all in the group
o below poerty line, 32 between Rs.2103,- to Rs.3000,- p.m., 19 between
Rs.3001,- to Rs.5000 p.m, 32 between Rs.5001,- to Rs.15000 p.m and 2
aboe Rs.15001 p.m.
Occupation Profile of PAHs & Iamily members
1he occupation proile o the PAls & lamily members reeals that Agriculture is
the predominant actiity with 11 highest among the PAls engaged in
Cultiation and the remaining are inoled as Agriculture labors ,4,, Casual
labors ,2,, Priate sector salaried ,4,, Goernment sector salaried ,4,,
usiness ,4,, Unemployed ,11, and Not in \ork orce ,60,.
Religion
y religion, majority o the PAls are lindus ,9, ollowed by the Muslims
,2, and Christians ,1,.
Literacy of PAHs & Iamily members
66 o the PAPs are iterates and 29 are Illiterates and the others are children
,5,. Out o the total PAls & lamily members, belong to Primary
education, 10 has carried out their Middle school education, 20 has
completed ligh school education, 12 has completed ligher Secondary
education, the remaining 18 hae carried out College education.
Age-group Classification of PAHs & Iamily members
As per socio economic surey carried out, the elderly population ,i.e., 60 & more
than 60 years accounts or 12 and the remaining 88, all within the age group
o 60 and below.
'ulnerable populations
In total there are 28 are ulnerable and 2 are non ulnerable. It is obsered
that there are 19 are Schedule caste, 6 are PAls below Poerty line, 2 o
the PAls are o elderly population and 1 is \oman- headed. Since all the
PAls are 1itle- lolders, they are eligible or compensation only or alternatie
houses in case o loss o structures.

A Social Deelopment Unit ,SDU, has been set up within the PIU to tackle land
acquisition. An oicer o the rank o Joint Project Director ,JPD, has been entrusted
the responsibility to oersee and co-ordinate the implementation actiities related to
and Acquisition. Llaborate mechanisms are proposed to assist the JPD, both at the
head quarters as well as at the ield leel to ensure eectie implementation o the
project. 1he State and District eel Committees hae been constituted to redress the
grieances o the PAPs.

R & R Costs and Budget: 1he budget or the implementation o the project
and other associated costs has been estimated as INR 27.00 million.


J. 0 IN1RODUC1ION



1.1 1he Resettlement Action Plan ,RAP, or the 1amil Nadu Road Sector Project
,1NRSP, contains the magnitude o and Acquisition and the mitigation o
impacts. 1his report also includes the baseline socio-economic characteristics
o the Project Aected louse holds ,PAls,, R&R policy proisions and
entitlements, outcomes o the consultations held with the communities and
the budget or the implementing the project.
1.2 1he umbakonam bypass extension likely to be implemented in the second
phase o the project, under the contract package 1NRSP-05. 1he length o the
corridor or this package is 4.080 m. 1he road will be ormed with a total
road width o 12.0 m, as 1wo ane Grael Shoulders ,2 GS,. 1he riding
surace will be o 2 anes, with a width o .0 m ,2x3.5,. 1he road will hae
Grael shoulders on both sides and the total width o the shoulders alone will
be o 5.0 m ,2x2.5,
1.3 1he social impact assessment and resettlement planning carried out as part o
the project preparation which inoles the ollowing ie main elements:
O Screening and social impact assessment as a part o project easibility
study,
O Preparation o Resettlement and Rehabilitation Lntitlements and
policy ramework,
O Census o the potentially aected population,
O Public consultation, and,
O Preparation o Resettlement Action Plan ,RAP,.

1.4 1he objectie o the RAP is to improe the oerall liing standards o the
persons aected due to the project. 1his will be achieed by adopting the
ollowing measures.
O Minimisation o land acquisition and resettlement impacts, reduction
o the CoI and adopting constricted cross-sections,
O 1o proide compensation to PAPs or the loss o assets under priate
negotiation process or under 1amil Nadu ligh \ay Act. 2001.
O 1o present an action plan or the disbursement o compensation and
assistance prior to commencement o ciil works.


1.5 1he total land requirement or umbakonam ypass Lxtension to be
constructed or 1NRSP is JJ.J747 hectares, according to the approed
alignment. 1he exact magnitude o social impacts and land acquisition will be
worked out through a Resettlement Action Plan ,RAP,. ased on the
approed alignment, broad R&R budget estimate has been proided in the
oerall R&R budget.
1.6 1he loss o assets inoles impacts on Agriculture land and structures as

1.9 The PIU, through the District Collector has to initiate the LA process. The LA will be completed prior to the s

1.10 In order to arrive at the best alternative, two diIIerent Ieasible options oI alignments have been studied. Each
de-merits. An eIIort has been made to Iind out the best oI two, by collecting more details along these alignments.

1.11 From the above table it may be seen that the Alternative-I, impacts 2 ponds, 55 structures, 5 temples and a
Alternative-II does not aIIect as much. Moreover Alternative-I, is very close to the town and the developm
this reason many houses (55 Nos) are aIIected. In total, the cost oI Alternative-II is lesser than the Alterna
been chosen as the better alignment. In addition to that, majority oI the people have also opted Ior Alterna
Consultation Meeting and the minutes oI Meeting are enclosed in Annexure - 1.
1.12 So, the Alternative II is the best option Ior the bypass oI Kumbakonam town, in terms oI Environmen
engineering point oI view. ThereIore, Alternative II is selected and the Detailed Engineering has been car

2. 0 LAND ACQUISITION AND RESETTLEMENT IMPACTS
2.1 This chapter outlines the magnitude and extent oI the various impact categories. These shall Iorm a base

2.2 The project involves land Ior acquisition Ior Iormation oI bypass. Altogether 11.1747 Ha oI land wil
which 9.3154 Ha oI patta land will be acquired Irom private owners and the balance oI 1. 8593 Ha land
oI irrigated and unirrigated land are provided as Iollows in Table 2.1.

3.2 1he key baseline socio-economic characteristics hae been worked out based on analysis o the census s
include those related to income, occupation, etc.
