COMPLAINT-AFFIDAVIT

I, LEONORA P. MIJARES, the Complainant, single, of legal age,

Filipino citizen, and a resident of Gomez Street, Barangay 7, Vigan City,
Ilocos Sur, after having been sworn to in accordance with law, do hereby
depose and say that:

1. I am instituting this criminal complaint against MR. RON

MIGUEL M. ROBLES, (“Respondent ROBLES”) single, of legal age,
Filipino citizen, and a resident of Barangay III, Cuta, Vigan City, Ilocos Sur,
for MALICIOS MISCHIEF as defined and penalized under Article 327 in
relation to Article 329 of the Revised Penal Code of the Philippines, to wit:

“Article 327. Who are liable for malicious mischief. - Any person who
shall deliberately cause the property of another any damage not
falling within the terms of the next preceding chapter shall be guilty
of malicious mischief.”

“Article 329. Other mischiefs. - The mischiefs not included in the next
preceding article shall be punished:

1. By arresto mayor in its medium and maximum periods, if the value

of the damage caused exceeds 1,000 pesos;

2. By arresto mayor in its minimum and medium periods, if such value

is over 200 pesos but does not exceed 1,000 pesos; and
 3. By arresto menor or fine of not less than the value of the damage
caused and not more than 200 pesos, if the amount involved does not
exceed 200 pesos or cannot be estimated.”

2. The criminal offense complained of was committed as follows:

a. On or about 7:00 p.m. of November 4, 2022, Respondent

ROBLES, with deliberate intent to cause damage, butchered nine
(9) pigs, in a house and lot belonging to the Complainant, located
at Barangay III, Cuta, Vigan City, Ilocos Sur.
b. Thereafter, Respondent ROBLES proceeded to deliberately cause
damage and destroy the fence and cement foundation of the
abovementioned house and lot belonging to the Complainant.
c. The value of the nine (9) butchered pigs caused by Respondent
ROBLES amounted to SIXTY-THREE THOUSAND PESOS (P
63,000.00), which was the amount spent by the Complainant in
purchasing the said pigs.
d. The value of the damage caused to the fence and cement
foundation by Respondent ROBLES also amounted to TEN
THOUSAND PESOS (P 10, 000.00), which was the amount spent
in labor and materials for the restoration and repair of the property
damaged by Respondent.
e. Respondent ROBLES’ unlawful act of maliciously butchering and
destroying the properties of herein Complainant does not
constitute arson or other crimes involving destruction.
f. Respondent ROBLES’ unlawful act of butchering and destroying
the properties of the Complainant was committed merely for the
sake of damaging and was motivated by feelings of hate and
revenge towards herein Complainant by reason of their previous
failed business venture.

3. I am executing this affidavit to attest to the truth of the foregoing

averments and to support the criminal compliant for MALICIOUS
MISCHIEF against Respondent ROBLES, who should be charged
accordingly.
