Sir, The reply is submitted as under: - 1. That para no. 1 of the application needs no reply. 2. That para no. 2 of the application is wrong and denied and is intrusive and has been filed only to delay the proceedings in the present case. The state of affairs is that F.I.R. No. 16 on dated 08.02.2014 was registered in the present case against Sukhdeep Singh Grewal, Jasvir Kaur Grewal and Gurdeep Singh Grewal. After the registration of FIR accused namely Gurdeep Singh Grewal was arrested and challan was presented on 05.09.2016. The remaining accused namely Sukhdeep Singh Grewal, Jasvir Kaur Grewal were not arrested since then and kept on absconding and PO proceedings were initiated against them. In the month of May’2023 the accused namely Jasvir Kaur Grewal was arrested from the airport and also bail granted to her by the Hon’ble court. After the registration of FIR till date the main accused Sukhdeep Singh Grewal neither appeared in the Hon’ble court nor arrested in the present case. 3. That para no. 3 of the application is also wrong and denied. Present application has been filed malafidely to prolong the decision of the case. There are favorable chances that if the passport is returned/released to the accused Jasvir Kaur, she might fly away to abroad as even she was arrested from the airport when she was trying to fly abroad. It is further submitted that the only reason for asking for return of the original passport is go to abroad so as to evade the present proceeding and her past act and conduct is the clear manifestation of the said facts, otherwise there is no need to get the passport from the court for the alleged purpose of renewal. 4. That para no. 4 of the application is also wrong and denied. It is requested to the Hon’ble court to not return the passport of the accused Jasvir Kaur. 5. That para no. 5 of the application needs no reply. It is therefore respectfully prayed that application be dismissed with costs
