EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH SALE
KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered and executed in Davao City, Philippines, by and


among:

SOCORRO G. ARCIAGA, of legal age, Filipino, widow and a resident of


Rang-ay, Banaybanay, Davao Oriental;

TOMAS LAUREANO G. ARCIAGA, of legal age, Filipino, married to


Maryrose A. Arciaga and a resident of Purok 1 Communal, Buhangin District,
Davao City;

CAROLINA G. ARCIAGA, of legal age, Filipino, single, and a resident of


Purok 1 Communal, Buhangin District, Davao City;

MILDRED ARCIAGA PAJO, of legal age, Filipino, married to Jeremias


Pajo and a resident of Purok 4 Rang-ay, Banaybanay, Davao Oriental;

LEO ALFRED G. ARCIAGA, of legal age, Filipino, single, and a resident of


4 Mango Hill Drive, Camp Catitipan, Davao City; and

AMADO G. ARCIAGA, JR., of legal age, Filipino, married to Maria Victoria


H. Arciaga and a resident of Rang-ay, Banaybanay, Davao Oriental;
-The above-named persons are hereinafter referred to as the Heirs.
WITNESSETH:

WHEREAS, the above-named persons are the heirs of the late Amado
Valdez Arciaga who died on February 15, 2022 at Rang-ay, Banaybanay, Davao
Oriental, Philippines, without any will.

WHEREAS, at the time of his death, he left fifty percent (50%) portion
share in property covered by Transfer Certificate of Title No. T-188086
containing an area of 1,000 square meters, more or less, and located at
Barangay Communal, Davao City and particularly described as follows:

WHEREAS, the above-mentioned portion shares have no fruits or
income.
WHEREAS, to the best knowledge of the above-named heirs there are no
known debts or obligations due against the estate of the late Amado Valdez
Arciaga.
WHEREAS, pursuant to the provision of Section 4 of the Rule 74 of the
Rules of Court, creating a lien in favor of the heirs and creditor who might have
been deprived of their participation in the distribution of the above-described
property for a period of two (2) years;
That in accordance with Section 1 of Rule 74 of the Rules of Court, the
above-named heirs hereby adjudicate the above-mentioned one-half (1/2)
portion shares of paraphernal property equally in accordance with the sharing
provided by law.
WHEREAS, in the remote event that any other property of the decedent
should ever be found which is not included herein-above, the HEIRS thereto
further agree as they do so agree to settle and distribute the same in like
manner and proportion as herein established and disposed.
WHEREAS, the respective HEIRS hereby covenant and further warrant
that should there be preterition or omission of one, some, or all of the
compulsory heirs in the direct line, whether living or not at the time of the
execution of this Deed, will not invalidate/nullify the terms and conditions of

this Deed. Instead, the HEIRS shall proportionately oblige themselves to pay to
the omitted HEIRS or the latter’s heir(s) the share which belongs to him/them,
in accordance with the rules of succession under the Civil Code of the
Philippines.

DEED OF ABSOLUTE SALE


WHEREAS, it is to the best interest of the above-named heirs to SELL,
TRANSFER and CONVEY the above-mentioned paraphernal parcel of land to
VANESSA P. SULLA, of legal age, Filipino, married to Eric S. Sulla and a
resident of Block 101 Lot 7 Phase 4 Copper St., DECA Homes Indangan, Davao
City, hereinafter referred to as the BUYER;
WHEREAS, the above-named HEIRS/SELLERS will sell their respective
shares over the one-half (1/2) inherited portion as well as the remaining
one-half (1/2) portion owned by Socorro G. Arciaga over the above-mentioned
paraphernal parcel of land;
WHEREAS, the HEIRS/SELLERS hereby warrant valid title and
peaceful possession of the above-mentioned parcel of land herein sold and
conveyed and further declares that the same are free and clear of all liens and
encumbrances of any kind whatsoever.
NOW THEREFORE, for and in consideration of the sum of FIVE
HUNDRED THOUSAND PESOS (PHP500,000.00), Philippine currency, in hand
paid by the BUYER, to the full satisfaction of the HEIRS/SELLERS, receipt of
which is hereby acknowledged by the HEIRS/SELLERS, by these presents, the
HEIRS/SELLERS hereby SELL, CEDE, TRANSFER and CONVEY unto and in
favor of the BUYER, her heirs, successors-in-interests and/or assigns the
above-mentioned parcel of land covered by Transfer Certificate of Title No.
T-188086 containing an area of 1,000 square meters, more or less, including
improvements that may be found therein, if any, free from all liens and
encumbrances and further, accepts the conveyance and agrees to be bound by
the rules and regulations, and restrictions pertaining to the said parcels of
land.
IN WITNESS WHEREOF, we have hereunto set our hand this day of

more or less, and located at Barangay Communal, Davao City, together with
the improvement found therein, if any, which consists of four (4) pages
including this page wherein this acknowledgement is written duly signed by the
parties and their witnesses on every page thereof and sealed with my notarial
seal.
