NOTICE INVITING TENDER

MINOR IRRIGATION COMPLEX,
AQUEM-BAIXO, RAWANFOND, SALCETE– GOA

e – TENDERING MODE e-PAYMENT ONLY


Item rate tender is invited in online mode only on behalf of the Governor of Goa from approved and
eligible contractors of W.R.D., Goa state, registered in appropriate class and category for the work of
“Conjunctive use of water by construction of Open Type Bandharas for Agriculture purpose on the
Sal River at Chainage 1.900km, Chainage 2.600km, Chainage 0.900km, Chainage 3.500km &
Chainage 6.200km in Nuvem Constituency of Salcete Taluka.”

The enlistment of the contractors should be valid on the last date of submission of tender.

In case only the last date of submission of tender is extended, the enlistment of contractor should be valid
on the original date of submission of tender.

In case both the last date of receipt of application and submission of tender are extended, the enlistment of
contractor should be valid on either of the two dates, i.e., original date of submission of tender or on the
extended date of submission of tender.

1.1 The work is estimated to cost Rs. 5,15,42,123/- This estimate, however, is given merely as a rough guide.

1.1.1 The authority competent to approve NIT for the combined cost and belonging to the major discipline will
consolidate NITs for calling the tenders. He will also nominate Division which will deal with all matters
relating to the invitation of tenders.

ELIGIBILITY TO PARTICIPATE IN THE TENDER


1.2.1 The applicants who intend to participate in the tender have to scan and upload the eligibility documents on
the e-tendering portal https://eprocure.goa.gov.in The eligibility documents are:
a. Attested copy of Valid Contractor’s Registration certificate.
b. Attested copy of Valid PAN Card.
c. Attested copy of certificate of Goa GST Registration and acknowledgement of up to date filed returns
along with copy of Application Reference Number (ARN) as per GST Law.
d. The bidder who have works in hand with total value of which is equal to or more than four times their
tendering limit as per Goa Enlistment Rules 2020, in the same category of registration in their name or
Firm’s name at the time of application are not eligible and such application will be summarily rejected.
e. The bidder has to submit the self declaration on Rs.100/- stamp paper giving the names of works in
hand till date.

1.2.2 The enlistment of a contractor in WRD, Goa, shall only entitle him to be considered for issue of tender
papers subject to the conditions laid down in individual Notice Inviting Tender. It shall not confer any
right on him either to be necessarily issued the tender papers or for award of work.
1.2.3 The successful bidder shall produce all original documents for verification as and when called for by
Engineer-in -charge.
Notice inviting bids as published in the news paper shall not form part of N.I.T./Bids documents.

1.2.4 Tender papers shall not be sent by post.

1.2.5 The estimate is based on GSR 2023 (Bldgs), GSR 2023 (Roads) and Rate Analysis.

1.2.6 The tender related documents for the above mentioned works are available in the office of Executive
Engineer, Works Division II, WRD, Minor Irrigation Complex, Aquem Baixo, Rawanfond, Salcete-
Goa.

2. Agreement shall be drawn with the successful tenderer on prescribed form No. 8 (or other Standard Form as
mentioned). Tenderer shall quote his rates as per various terms and conditions of the said form which will
form part of the agreement.

3. The time allowed for carrying out the work will be 180 days (Excluding monsoon) (monsoon period from
1stJune to 30th September) from the date of start as defined in schedule “F” or from the first date of
handing over of the site, whichever is later, in accordance with the phasing, if any, indicated in the tender
documents.
4. The site for the work is available.
5. The Bidder who wish to participate in the tender process, have to remit the Tender Processing Fee (TPF),
Tender Documents Fee (TDF) and EMD at the time of application for issue of tender document, through
online Payment Gateway on portal https://eprocure.goa.gov.in.
6. The last date and time for online application for issue & submission of tender bid is 26 / 03 / 2024 upto
4.00 p.m.
7. The date and time of opening of Technical bid amongst eligible bidders is on 27 / 03 / 2024 at 11.00 a.m.
in the Office of the Superintending Engineer, Circle I, WRD, Sinchai Bhavan, Alto Porvorim Bardez-Goa.

8. The date and time of opening of Financial bid amongst eligible bidders is on 28 / 03 /2024 at 11.00 a.m in
the Office of the Superintending Engineer, Circle I, WRD, Sinchai Bhavan, Alto Porvorim Bardez-Goa.

9. Tenders documents Consisting of plans, Specifications, the schedule of quantities of various types of items
to be executed and the set of items & conditions of the contract to be complied with and other necessary
documents in hard copy can be seen in the office of the Executive Engineer, W.D.II, WRD, Rawanfond
Salcete - Goa. During the office hours. The intending bidders must have valid digital class III signature to
submit the bid.

10. The bidders participating for e-tendering/ e-payment mode has to remit Tender Processing Fees (TPF),
Tender Documents Fees (TDF) and Earnest Money Deposit (EMD) through online payment gateway on
portal https://eprocure.goa.gov.in.

(i) e-tender processing fee of Rs. 6,000 /- (non refundable).

(ii) Tender documents fee of Rs. 20,000/-(non refundable).

(iii) Earnest Money Deposit of Rs. 10,30,843/-

Only the online tender documents submitted by those intending bidders who have remitted Earnest
Money Deposit, Tender Document Fee and e-Tender Processing Fee online within specified time shall
be opened (No physical documents shall be accepted).

11. Bidders participating in e-Tendering have to remit Tender Processing Fee (TPF), Tender Documents Fee
(TDF) and Earnest Money Deposit (EMD) through online Payment Gateway on portal
https://eprocure.goa.gov.in through any of the following modes of payment.

(i) Payment Through Internet Banking.


(ii) NEFT / RTGS (National Electronic Fund Transfer/ Real Time Gross Settlement): Bidders are
required to download NEFT / RTGS challan and make payment to dynamically generated
Account No. through any Bank.
Note: Any Payments made through NEFT/RTGS normally take 24 hours for its reconciliation. Hence applicants
are therefore advised to make the payments through NEFT/RTGS etc at least TWO BANK WORKING DAYS in
advance before due date and upload the scanned copy of challans in the e-tendering website
https://eprocure.goa.gov.in as a token of payment

12. The Contractor whose tender is accepted will be required to furnish performance guarantee of 5% (Five
Percent) of the tendered amount within the period specified in Schedule F. The guarantee shall be in the
form of Fixed Deposit Receipts or Bank Guarantee of any Scheduled /Nationalized Bank in accordance
with the prescribed form. In case the contractor fails to deposit the said performance guarantee within the
period as indicated in schedule ‘F’ including the extended period, if any, the Earnest Money Deposited by
the contractor shall be forfeited automatically without any notice to the contractor.

12A Forfeiture of earnest money
i) If any tenderer withdraws his tender before the expiry of the validity period, or before the issue of
letter of acceptance, whichever is earlier, or makes any modification in the terms and conditions
of the tender which are not acceptable to the Department, then the Government shall, without
prejudice to any other right or remedy, be at liberty to forfeit 50% of the earnest money
absolutely. This provision would naturally apply only to the lowest tenderer once the earnest
money of all the tenderer except those of the lowest is refunded.

ii) If the contractor fails to furnish the prescribed performance guarantee within the prescribed
period specified, his/her, earnest money is forfeited to the Governor of Goa automatically without
any notice

iii) In case the contractor fails to commence the work specified in the tender documents on the 15th
day or such time period as mentioned in letter of award, after the date on which the Engineer-in-
charge issues written orders to commence the work or from the date of handling over of the site,
whichever is later. the Government shall, without prejudice to any other right or remedy, be at
liberty to forfeit whole of earnest money absolutely.

iv) If only a part of the work as shown in the tender is awarded, and the contractor does not
commence the work, the amount of the earnest money to be forfeited to the Government should
be worked out with reference to the estimated cost of the work so awarded.

v) In case of forfeiture of earnest money as prescribed in (i) to (iv) above, the tenderer shall not be
allowed to participate in the re-tendering process of the work.
vi) Forfeiture of EMD on three occasions due to non-submission of performance guarantee in time
will liable the tenderer to be black listed and tender forms may not be issued to him in future.
The description of the work is as follows: -

“Conjunctive use of water by construction of Open Type Bandharas for Agriculture purpose on
the Sal River at Chainage 1.900km, Chainage 2.600km, Chainage 0.900km, Chainage 3.500km &
Chainage 6.200km in Nuvem Constituency of Salcete Taluka.”

The copies of the drawing/ documents pertaining to the work will be open for inspection of tender at
office of Executive Engineer, W.D.II, WRD, Minor Irrigation Complex, Aquem Baixo, Rawanfond
Salcete-Goa. Intending tenderers are advised to inspect and examine the site and its surroundings and
satisfy themselves before submitting their tenders as to the nature of the ground and sub-soil (so far as is
practicable), the form and nature of the site, the means of access to the site, the accommodation they
may require and in general shall themselves obtain all necessary information as to risks, contingencies
and other circumstances which may influence or affect their tender. A tenderer shall be deemed to have
full knowledge of the site whether he inspects it or not and no extra charges consequent or any
misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and
maintaining at their own cost all materials, tools & plants, water, electricity, access facilities for workers
and all other services required for executing the work unless otherwise specifically provided for in the
contract documents. Submission of a tender by a tenderer implies that he has read this notice and all
other contract documents and has made himself aware of the scope and specifications of the work to be
done and of conditions and rates at which stores, tools and plant, etc., will be issued to him by the
Government and local conditions and other factors having a bearing on the execution of the work.

13. The competent authority on behalf of the Governor of Goa does not bind itself to accept the lowest or
any other tender and reserves to itself the authority to reject any or all the tenders received without the
assignment of any reason. All tenders in which any of the prescribed condition is not fulfilled or any
condition including that of conditional rebate is put forth by the tenderer shall be summarily rejected.

13A.Use of correction fluid anywhere in the tender document is not permitted. Such tender is liable for
rejection.

14. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the
tenders submitted by the contractors who resort to canvassing will be liable to rejection.

15. The competent authority on behalf of Governor of Goa reserves to himself the right of accepting the
whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted.

16. The contractor shall not be permitted to tender for works in the WRD Circle (Division in case of
contractors of Horticulture/ Nursery category) responsible for award and execution of contracts in which
his near relative is posted as Divisional Accountant or as an officer in any capacity between the grades
of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the names of
persons who are working with him in any capacity or are subsequently employed by him and who are
near relatives to any Gazetted Officer in the Water Resources Department contractor would render him
liable to be removed from the approved list of contractors of this Department.

17. No Engineer of gazette rank or other Gazetted officer employed in Engineering or Administrative duties
in an Engineering Department of the Government is allowed to work as a contractor for a period of one
year after his retirement from Government service, without the previous permission of the Government
of Goa in writing. This contract is liable to be cancelled if either the contractor or any of his employees
is found any time to be such a person who has not obtained the permission of the Government as
aforesaid before submission of the tender or engagement in the contractor’s service

18. The tender for the work shall remain open for acceptance for a period of ninety (90) days from the date
of opening of tender. If any tenderer withdraws his tender before the said period or issue of letter of
acceptance, whichever is earlier, or makes any modifications in the terms and conditions of the tender
which are not acceptable to the department, then the Government shall, without prejudice to any other
right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. Further the tenderer
shall not be allowed to participate in the re-tendering process of the work.

19. This Notice Inviting Tender shall form a part of the contract document. The successful tenderer/
contractor, on acceptance of his tender by the Accepting Authority shall, within 15 days from the
stipulated date of start of the work, sign the contract consisting of:

(a) The notice inviting tender, all the documents including additional conditions, specifications and
drawings, if any, forming part of the tender as uploaded at the time of invitation of tender and the
rates quoted on-line at the time of submission of bid and acceptance thereof together with any
correspondence leading thereto.
(b) C.P.W.D. Form 8 or other C.P.W.D. Form as mentioned.
(c) Notice inviting bids as published in the newspaper shall not form part of NIT/ Bid documents.

20. In case, it is found that e-payment made is bogus, then the contractor, (He/They) shall be weeded out
from the approved contractors list of the Government and criminal action will be initiated against
(Him/Them) for the offence.
21. As per Section 51 of Goa Goods And Service Tax Act, 2017(SGST) and section 51 of Central
Goods And Services Tax Act, 2017(CGST) Water Resources department shall recover the TDS at
the rate of 2% (i.e. 1% CGST and 1% SGST) on the value of work contract undertaken by the agency.
Any other tax/Octroi applicable shall be borne by Agency.
22. In case any discrepancy is noticed between the documents as uploaded at the time of submission of the
bid online and hard copies as submitted physically in the office of the Executive Engineer, then the bid
submitted shall become invalid and Government shall without prejudice to any other right on remedy,
be at liberty to forfeit 50% of the said earnest money as aforesaid. Further the tenderer shall not be
allowed to participate in the re-tendering process of the work.

23.The Royalty on Minor minerals like laterite, basalt, river sand, brick, earth etc., consumed on the
contract work will be recovered by the WRD from the running bills of the contractor, at rates stipulated
in the Notification No.4/59/2015/Minor/Mines/3657 series 1 to 37 Dt.10.12.2015 or as amended from
time to time.

24. Tax collected at source @2% shall be deducted on Royalty subject to minimum of Rs.10.00/-.

25. The Income tax TDS @ of 2% shall be deducted from each running bills.

26. Labour Welfare Cess @ 1% shall be deducted on the value of work-contract from R.A. Bills at source
as per the provision of the building and other construction worker’s Regulation of Employment &
Conditions of Service Act 1996.

27. The contractor shall comply with the provisions of the payment of wages Act, 1936, Minimum Wages
Act, 1948. Employees Liability act, 1938, workmen’s Compensation Act, 1923, Industrial disputes Act,
1947, Maternity Benefits Act 1961 and the Contractors Labour (Regulation and Abolition) Act, 1970.

The Employees Provident Funds and Miscellaneous Provisions Act, 1952 or the modifications thereof
or any other laws relating thereto and the rules made there under from time to time.

28. The contractor shall carryout the electrical component of work from agency/person who is having a
valid license from a competent authority for doing so.

29. Relevant CPWD specification, IS codes of practice and IRC specifications shall be applicable for Civil,
Electrical, Mechanical components and as directed by Engineer-in-charge.

30. All the rates quoted shall be bare rates upto 2 decimal places only. GST as applicable will be added by the
system

31. 1) All the works tendered by Water Resources Department which is quoted more than 20%
below the estimated cost put to tender (Rs. 4,12,33,698.40) regardless of whether the estimate is based on GSR or
Non-GSR or including GSR and Non GSR items shall be rejected.

2) Tenders quoted at same percentage / amount by more than one agency, shall be recommended by the
Executive Engineer concerned based on the following criteria:
a) For item Rate Tenders, the rates quoted by the agency for the major / important Items quantum wise and cost
wise to be considered for recommendation (i.e. with respect to Abnormally High and Abnormally Low
Quoted Items) and for Percentage Rate Tenders below criteria (b, c &d) may be followed.
b) The agency having less nos. of works in hand with respective Division.
c) The ongoing works of the agency in the same vicinity of the proposed work.
d) The performance / past record of the agency in execution of public works.

32. Payment for the work will be made, subject to the availability of funds without any additional liability
of interest.
33. The EMD (Earnest Money Deposit) of all the participating bidders will be released automatically by the
system only when the Award of Contract (AOC) is issued online to the Lowest (L1) bidder.
