3. COURSE IN BRIEF

ASEAN Community Law provides learners basic knowledge and legal

specialized knowledge on ASEAN, ASEAN Community and ASEAN
Community Law.

The subject consists of 5 main units: 1) Overview of ASEAN Law

Community; 2) Trade and investment in ASEAN; 3) Protect and prevent
cross-border crimes and ASEAN mutual legal assistance in criminal
matters; 4) Rights and social justice; 5) Dispute settlement mechanism of
ASEAN. Through these issues, the subject provides not only basic
theoretical knowledge on ASEAN Community Law but also detailed and
significant legal specialized knowledge on: Cooperation in protecting and
preventing against transnational crime; mutual legal assistance in criminal
matters in ASEAN ; ASEAN Free Trade Area; Trade in goods
liberalization; Mutual recognition in ASEAN trade in service; ASEAN
Investment Area; ASEAN human rights protection mechanismn; Protecting
Rights of women, children and migrant workers; external relation of
ASEAN, ASEAN dispute settlements.

* Knowledges:
K1. List and analyze objectives, operation principles and structure of
ASEAN.
K2. Identify cooperation model of ASEAN Community and based on that,
students can compare it with those of other regional international
organizations, eg. EU
K3. Describe and analyze the conception, characteristics and source of
ASEAN Community Law.
K4. Describe the conception, characteristics and classify external
cooperation mechanism of ASEAN.
K5. Identify and apply specific legal knowledge of trade in goods, trade in
services and investment in ASEAN.
K6. Present and analyze legal issues and practice of preventing and
protecting against transnational crime and mutual legal assistance in
criminal matters of ASEAN.
K7. Describe and analyze ASEAN promotion and protection of human right
mechanism, especially the mechanism to protect women, children and
immigrant labours.
K8. Present and put in practice specialized legal knowledge of ASEAN
dispute settlement mechanism according to 2004 ASEAN Protocol on
Enhanced Dispute Settlement Mechanism and dispute settlement
mechanism between an investor and a Member State under 2009 ASEAN
Comprehensive Investment Agreement (ACIA).

10. POLICIES FOR THE SUBJECT

- Obey the rules of Hanoi Law University;
- Assignments must be handed/presented on time;
- 20% of your mark will be deducted if your work exceeds the page

11. METHODS OF ASSESSMENT
11.1. Frequent assessment
- Attendance: Students participate in 75% or more of the prescribed hours
for each theory or seminar part.
- Proofs of joining seminars and contributing to group project;
- Multiple choice test, assignments.

- Assessing knowledge: Self-study and understand the lesson (1-7 mark)
- Attitudes to participate in seminar: Not active / Active positive (1-3
mark)
- Total: 10 mark
(*) Assess knowledge:
Assess self-study and the level of knowledge acquisition to grade points.
(For example, students who fully acquire knowledge in lecture and actively
participate in seminar will get maximum point in each seminar prescribed
by the department).
Attend all the sessions: attendance at least 75% under the Regulation to
define the requirements to take a final exam (Students will not meet the
requirements to take a final exam, if they get 04 good component points
but they are off school over 25% or attend all the session but one
component point is zero).
(*) Attitude and participation in seminars
- Attending all the sessions on time: 7 points
 Abscene in one session - losing 1 point;
 Abscene in two sessions - losing 2 points;
 Abscene in three sessions - losing 3 points;
 Abscene in four sessions and above without a reasonable excuse – will not
be allowed to take the final exam.
- Positive attitude in the seminars: 3 points (Students who express their
own ideas or answer questions of lecturers well in the seminars will receive
plus – point)
 Students who have one time recognized by lecturers that they have a good
participation in the seminars will receive 1 points;
 Students who have two times recognized by lecturers that they have a good
participation in the seminars will receive 2 points;
 Students who have three times and more recognized by lecturers that they
 have a good participation in the seminars will receive 3 points;
 Group assignment:
General requirements
- All of the assignments should be written and printed on A4-size paper. The
length depends on each type of exercise.
- Format: Top margin: 2.5cm; bottom margin: 2.5cm; left margin: 3.5cm;
right margin: 2.0cm; font: Times New Roman; size: 14; line spacing: 1,5
lines.
Criteria
- Form: Written (no more than 12 A4-size pages).
- Content: choosen from the topic list provided by the Department of
ASEAN Law and International Alliances and based on lecturers’
requirement.
- Criteria for written project assessment: Did the students:
+ Identify the issue obviously and properly? 2 points
+ Logically and directly analyze the issue? 6 points
+ Use a wide range of materials? 1 point
+ Have good organization and make use of terminology? 1 point
Sum: 10 points
- The final grade is the average of all group projects in this subject.
 Final exam
- Condition to participate in the final exam:
+ Students participate in 75% or more of the prescribed hours for
each theory or seminar part.
+ Team assignment or individual exam must be greater than 0.
- Form: a 90-minute written exam, includes of multiple choice and written
questions.
