1. The plaintiff Mr.P is a permanent residence & tenant in Al Nahda Dubai
starting May 2021. This house has 2 rooms – a latrine and a kitchen + he is paying rent of dhs.4000 per month excluding electricity and water. 2. Tenancy is under dead Mr. A. The house owner or landlord – Mr. A passed away on Feb 1st 2022 used to collect rent from the plaintiff but would not give a rent receipt even after Mr. P asked. 3. Mr.P spent a huge amount of money for the construction of the room as there was lot of work to be done. Mr. A assured that whatever he spent on the rooms he would deduct or adjust it from the rent. 4. Now the plaintiff has necessary documents and proof of materials for the construction. 5. Whenever Mr. A was unwell, he used to be looked after by the plaintiff. 6. Plaintiff has been having peaceful possession of that place – living there – has all records. 7. The house has all the household goods. 8. The legal heirs of Mr.A , is not aware of the plaintiff – so now plaintiff is ready to give rent to the legal heirs. 9. On 14th February 2022, Mr.D , defendant came and threatened the plaintiff to vacate the premise without disclosing his identity – started throwing out the household goods – quarrelling – neighbors intervened – they left the spot (2 defendants). If he doesn’t vacate will they goons /rowdies. 10.So, plaintiff went to police station – to file a complaint but duty officer did not lodge any report – also saw defendant already present in police station. 11.P sent a notice to the D- copied to the police by registered post – stating what happened. (via registered post) 12.On 23rd Feb, D & 2 other people – P has never seen them – Came and threatened P to leave – again neighbors supported and they left. 13.P again went to the police station to report – but police dint do anything. 14.So now P is before the court for suit for permanent injunction.
