MEMORANDUM OF AGREEMENT

KNOWN ALL BY MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT (MOA) is made and executed by


and between the “Parties” (as herein collectively referred to), namely:

The LANDBANK COUNTRYSIDE DEVELOPMENT FOUNDATION,


INC., a non-stock, non-profit, corporate foundation of Land Bank of the
Philippines (LANDBANK), and classified as Government Owned and Controlled
Corporation (GOCC) pursuant to Executive Order No. 203, with SEC
Registration No. 110790, and principal office address at the 14th Floor,
LANDBANK Plaza, 1598 M.H. Del Pilar corner Dr. J. Quintos Sts., Malate,
Manila, represented herein by ROY C. OSCILLADA, in his capacity as Officer-
in-Charge/Executive Director, and referred herein as “LCDFI;”

- and -

The KALINGA STATE UNIVERSITY, established by virtue of RA 9722,


with principal address at Purok 6, Bulanao, Tabuk City, Kalinga represented
herein by its University President, EDUARO T. BAGTANG, hereinafter referred
to as “KSU.”

WITNESSETH THAT:

WHEREAS, LANDBANK Countryside Development Foundation, Inc.


(LCDFI), GOCC and the corporate foundation of LANDBANK are committed to
spur development in the countryside particularly among its sectors such as the
small farmers and fishers, agrarian reform beneficiaries (ARBs), Countryside
Financial Institutions (CFIs), small and medium enterprises (SMEs) and
Overseas Filipino Workers (OFWs).

WHEREAS, the Iskolar ng LANDBANK Program (ILP) was established by


LANDBANK to provide educational assistance to deserving dependents of
agrarian reform beneficiaries (ARBs) and small farmers and fisher folk which will
help provide a responsive and flexible scholarship program to ensure varied
employment opportunities upon graduation and to promote awareness among
the youth of the need to improve the lives of their families and communities, and
allow them to contribute to nation-building and in serving the nation;

WHEREAS, the LANDBANK through its Corporate Affairs Group (CAG)


entrust to LCDFI, the management of ILP through Service Level Agreement;

WHEREAS, Kalinga State University shall primarily provide advanced education,


higher technological professional instruction and training in the arts, agriculture,
forestry, social and natural sciences and technology, and other relevant fields of
study. It shall also promote and undertake research and extension services, and
provide progressive leadership in its areas of specialization.

WHEREAS, Kalinga State University vision: A Knowledge and


Technology Hub in Asia-Pacific Region.

Mission: Kalinga State University shall primarily provide higher


and advanced education, professional instruction and training in
the arts, agriculture forestry, social and natural sciences and

technology, and other relevant fields of study. It shall also
promote and undertake research and extension services, and
provide progressive leadership in its areas of specialization.

WHEREAS, Kalinga State University goals in extension: Enterprise


Development-Oriented Extension Services Program. Strong
Linkages and funding support from local, regional, national and
international partners
Extension Service / Community Service / Public Service / Community
Engagement Programs

NOW THEREFORE, for and in consideration of the foregoing premises and the
mutual covenants hereinafter set forth, LCDFI and KSU have agreed, as they
hereby agree, to wit:

ARTICLE I
OBJECTIVE, SCOPE AND COVERAGE

Section 1. Objectives – The Iskolar ng LANDBANK (ILP) aims to:

1. To provide educational assistance to deserving dependents of


agrarian reform beneficiaries (ARBs) and small farmers and fisher folk
who belong to the mandated sectors of the Bank.

2. To provide a responsive and flexible scholarship program to ensure


varied employment opportunities upon graduation.

3. To promote awareness among the youth of the need to improve the


lives of their families and their communities, and thus contribute to
nation building.

ARTICLE II
FUNDING

Section 2: The funding for the Iskolar ng LANDBANK Program will be


sourced from Scholarship Trust Fund to be set up from LANDBANK’s donation to
fund the Program based on the separate undertaking of LANDBANK to LCDFI to
appropriate an annual amount to the Scholarship Trust Fund, subject to
availability of funds and proper approvals. The Trust Fund shall be constituted
with the LANDBANK Trust Banking Group (TBG) and disbursement shall be
governed by separate Trust Agreement. LCDFI shall facilitate the request for the
release of the fund from the TBG.

Schedule of Fund Releases – The fund shall be released by LCDFI


directly to the scholars through their LANDBANK ATM Cards. Each student will
be provided with an endorsement to open a peso savings account with
LANDBANK nearest to their present location.

In the event that there is a possibility of insufficient funds to fulfill the


obligations under this agreement, the parties hereby acknowledge and agree
that such insufficiency may result in the pretermination of this agreement.

ARTICLE III
SELECTION OF SCHOLARS

Section 3. LCDFI shall notify KSU on the call for application depending
on the availability of slots and scholarship funds.

1. Qualification Criteria of Applicants

a. Must be a Filipino citizen

b. Children/grandchildren of Agrarian Reform Beneficiaries


(ARBs) or small farmers and fishers

c. High school graduate Student with a minimum average grade


of 90% or belonging to the top 10% of their class *(i.e. final
grade or senior high or grades from the latest available grading
period)

d. Must pass the selection requirement of partner SUCs (e.g.,


entrance exams, submission of the required documents and
preliminary interviews)

e. Must not enjoy any other financial assistance, grant, or


scholarship from other external sources (e.g., foundations, local
government units, Department of Science and Technology
[DOST], pre-need educational plans)

f. Students whose annual total family income does not exceed


PHP 300,000.00 as stated in their BIR Income Tax Return (ITR) or
in the absence, any other document as proof of income (e,g.
Certificate of Indigency or BIR Certificate of Tax Exemption may be
considered)

2. Pre-Qualification Requirements

a. Duly filled-out Scholarship Application Form

b. Certified true copy of birth certificate issued by the Philippine


Statistics Authority (PSA)

c. Two 2” x 2” ID photos

d. Medical Certificate

e. Photocopy of membership of parent/s as ARB and/or certificate


of membership of parent/s as member of the Registry System
for Basic Sectors in Agriculture (RSBSA) under the Department
of Agriculture (DA)

f. Endorsement Letter from partner SUCs

g. Photocopy of recent ITR of parent/s or Barangay Certification


of Indigency/BIR Certificate of Tax Exemption of unemployed
parents/guardians

h. Summary of grades (Grade 12 senior high school)

i. Endorsement letter from the high school principal

j. Certificate of good moral character coming from the school

k. Current resume, with list of activities, awards and honor

l. 500-words essay on “Why I am pursuing my chosen course”
and “How does LANDBANK Help in nation Building”

m. Barangay clearance from the applicant’s home barangay or


residence

3. Application

a. Scholarship application forms will be distributed by LCDFI to its


Partner SUCs.
b. The Scholarship application form together with the other
requirements shall be submitted to the Program Administrator
(LCDFI).

c. Applications must be postmarked or received on or before the


published deadline of submission.

4. Selection

a. LANDBANK-CAG, together with LCDFI, shall identify the


poorest agriculture-based municipalities in the identified 60
provinces, based on the official poverty incidence classification
of the Philippine Statistics Authority (PSA).

b. LCDFI shall accept and screen the applications for scholarship,
as to the completeness of the documentary requirements and
consolidate the same for endorsement to the Selection
Committee.

c. The LANDBANK President and CEO or the Management


Committee may recommend applicants subject to the selection
process based on the Program’s qualification criteria.

d. The Selection Committee, composed of representatives from


the LANDBANK CAG (2), Human Resource Management
Group (2), Field Support Services Center (1), and LCDFI (2),
shall screen and select the qualified applicants based on the
established qualification criteria.

Note: FSSC representative shall come from the region


where the applicants reside.

e. The final list of the selected sixty (60) scholars and their
alternates shall be submitted to the LANDBANK Board of
Directors for approval.

5. Notification

a. All applicants (successful and unsuccessful) shall be notified


via email by the LCDFI of the outcome of the selection process.

b. Names of successful applicants shall be announced and


posted at the websites/ bulletin boards of LANDBANK and
partner SUCs, as well as in major national and/or regional
newspapers, if possible. Scholars, especially in far-flung areas,
may also be notified though e-mail or postal service.

ARTICLE IV
POST QUALIFICATION AND CONTINUING REQUIREMENTS

Section 4. Post Qualification Requirements

a. The scholar shall enter into an agreement with LCDFI for the
acceptance and awarding of the scholarship grant.

b. The scholar shall be required to open a LANDBANK ATM


Savings Account where allowances and stipends shall be
credited.

c. Adherence to the guidelines of the implementing partners (i.e.,


LCDFI and SUCs) and signing of the Non-Disclosure Agreement

d. Must have completed the Program orientation

Section 5. Continuing Requirements. The individual scholarship grant


may be renewed each year until the scholar has completed the course, provided
that the following conditions are met every semester subject to submission of
documents:
a. A general weighted average (GWA) of not lower than 2.5 or its
equivalent per semester, with no grade lower than 3.0 in any
subject.

b. If the scholar obtains a failing grade and in case of failure to


meet the required GWA, the scholar may appeal the case to
the LCDFI with the endorsement of the dean and the
appropriate authorities of the SUC. LANDBANK-CAG shall
make the final decision based on the recommendation of
LCDFI.

c. The decision of the LCDFI and LANDBANK-CAG shall depend


upon the nature and/or gravity of the case, based on the
following guidelines:

1) First Offense – When a scholar obtains a failing, incomplete


or conditional grade in any one (1) subject in a semester, a
written warning shall be issued.

2) Second Offense – When a scholar obtains a failing,


incomplete or conditional grade in any two (2) subjects in a
single semester, an automatic withdrawal of the scholarship
shall be made.

3) If a scholar obtains a failing, incomplete or a conditional


grade in any one (1) subject in two (2) separate semesters,
automatic withdrawal of the scholarship shall also be made.
In all cases, a notice of scholarship termination shall be
issued to the scholar, the parents/guardian, and [SUCs
Acronym].

4) In case of an incomplete or conditional grade, the scholar


shall be given one (1) semester following the receipt of the
incomplete grade to complete all the necessary
requirements for the subject.

5) The scholar shall only be allowed to obtain a failing,
incomplete or conditional grade only once for the whole
duration of his/her degree program.

d. Must be enrolled in the regular number of subjects offered in


the semester as indicated in the approved curriculum for the
degree.

e. Must not drop any subject or cancel enrollment for the period in
the duration of the scholarship.

f. Shifting of courses is prohibited. Failure to comply with this


requirement shall automatically result to withdrawal of
scholarship. However, exemptions may be granted by the
LANDBANK-CAG and LCDFI on a case-to-case basis (e.g.,
degree course has been discontinued by the SUC; closure of
the SUC; and other similar circumstances).

g. Duration of the scholarship shall be extended for students who


shall not graduate on time for justifiable reasons such as
health, unresolved family issues and force majeure. Under
these conditions, the scholars shall be given a maximum of one
(1) additional semester to complete the degree program.

h. Must not be found guilty of grave misconduct or a


misdemeanor in accordance with existing policies, rules, and
regulations of the SUC where the scholar is enrolled.

i. Must comply with the core values of KSU, LCDFI and


LANDBANK.

j. Must not accept any other educational financial assistance


such as cash allowance, grant, or scholarship from external
sources (e.g., foundations, local government units, DOST, pre-
need educational plans).

ARTICLE V
PROGRAM INCENTIVES

Section 5. Program Incentives – Successful Scholars shall receive the


following:
1. Total annual grant of Pesos: One Hundred Thousand Only
(Php100,000.00), less applicable taxes to cover the following
expenses:

a. Allowance/stipend
b. Book allowance and other requirements of the course
c. Clothing/uniform/shoes

2. Scholars graduating with high honors shall receive a


corresponding special cash award incentives as follows:

Honor Award
Summa Cum Laude PHP 100,000.00
Magna Cum Laude PHP 70,000.00
Cum Laude PHP 50, 000.00

3. Subsidy for Graduating Scholars:

A maximum of PHP 16, 000.00 shall be granted as licensure
review and examination fees, via reimbursement, to cover the
following expenses:

a. Review Center Fee (Only official receipts shall be accepted)


b. Professional Regulation Commission Application Fee
c. Photocopying and/or printing of review materials

4. Subject of prevailing rules of LANDBANK unit in the Head Office or


the Bank’s Field Units, cooperatives or partner institutions
following their OJT curriculum.

ARTICLE VI
ROLES AND RESPONSIBILITIES

SECTION 6. The Parties shall cooperate and collaborate with each other
in fulfilling the objectives of this agreement in a timely and expeditious manner.

1. KSU shall have the following responsibilities:

a. To assign at least one (1) Scholarship Coordinator who shall


coordinate with LCDFI Program Officer;

b. To assist LCDFI in the initial selection and screening of the


documentary requirements;

c. To assist the scholar applicant and/or LCDFI during the


interview and selection process (e.g. the SUC must provide the
applicant stable internet connection during the interview (if via
online platform), or the SUC must provide venue for the
interview (if face-to-face), etc.);

d. To provide LCDFI the semestral monitoring of student


scholastic performance by providing LCDFI a report of grades;
and

e. To report scholar misconduct or misdemeanor in accordance


with existing policies, rules, and regulations of the SUCs.

2. The LCDFI shall have the following responsibilities:

a. Oversee program administration and management;

b. Responsible for securing the signing and approval of


documents;

c. Coordinate with [SUCs acronym] to monitor the status of the


current scholars;

d. Review all the necessary documents for the renewal of


scholarships;

e. Send letter of renewal to the scholars;

f. Submit Semestral Report to LANDBANK-CAG; and

g. Responsible for all financial transactions of the Program.

Each respective institution involved in this agreement shall bear the costs
incurred in connection with their respective obligations as outlined herein. The
parties hereby acknowledge and agree that any costs or expenses directly
attributable to their own roles and responsibilities under this agreement shall be
the sole responsibility of the respective institution.

ARTICLE VII
SETTLEMENT OF DISPUTES

SECTION 7. The parties agreed that any conflict, controversies, issues or


disputes which may arise within or during the effectivity of this Agreement shall in
their best efforts, try to settle the same among themselves.

In case of failure to come on an amicable settlement, all disputes between


the parties arising from the interpretation or application of this Agreement shall
be administratively settled or adjudicated in the manner provided under Chapter
14 of Book IV of the Executive Order No. 292 date July 25, 1987, as amended.

ARTICLE VIII
SEVERABILITY

SECTION 8. If at any time, any provision of this Agreement is adjusted to


be or becomes illegal, invalid, or unenforceable in any respect under the laws,
rules and regulations of the Republic of the Philippines, the provisions not so
affected or impaired shall subsist and remain legal, valid, and enforceable as
between the parties herein.

ARTICLE IX
EFFECTIVITY AND TERMINATION

SECTION 9. This Agreement shall be governed by and interpreted in


accordance with the laws of the Republic of the Philippines and shall take effect
on Academic Year 2023-2024, and shall remain in full force and effect until
Academic Year 2028-2029.

ARTICLE X
AMENDMENTS, RENEWAL AND EXTENSION

SECTION 10. Any modification or amendment to this agreement shall be


valid only if it is made in writing and duly executed by all parties. The written
modification shall clearly reference this original agreement and specify the
particular provisions being modified. No oral agreements or understandings shall
be binding or effective in altering the terms of this agreement

Any extension of this agreement shall be made in writing and agreed upon
by all parties. The extension shall specify the new term duration and any other
modified terms. No extension shall be deemed automatic, and all parties must
consent to the extension before it becomes valid and enforceable.

ARTICLE XI
DATA PROTECTION AND PRIVACY

SECTION 11. Both parties shall comply with all applicable data protection
and privacy laws, rules, and regulations.

The parties shall implement and maintain appropriate technical and
organizational measures to protect the security and confidentiality of any
personal data processed or handled under this agreement.

IN WITNESS WHEREOF, the LCDFI and KSU have hereunto set their hand this
