Sir,

We Fedbank Financial Services Ltd, having its registered office at Federal

Towers, Aluva -683101, Ernakulam, Kerela and corporate office at Unit
No.501/502/511/512,A wing 5th floor, kanakia wall street, AndheriKurla Road,
chakala, Andheri (East), Mumbai-400093 and having regional office at D.No.103,
Navins Presidum, B-Block, 5th Floor, Nelson Manicham Road, Amanjikarai, Chennai-
600029 hereby wish to inform you as under:-

That one Mr. S Swaminathan hereinafter referred to as “Borrower”) had

approached us for a Loan by submitting his /her duly filled up Loan Application
Forms along with other documents to substantiate its financial soundness. On the
basis of the said applications and other documents, Loan facility came to be granted to
Borrower under Loan Agreement No:FEDCHN0BL0481567 to the tune of
Rs.30,00,000/-(Rupees Thirty Lakhs Only) towards Loan vide Loan Agreement which
was to be repaid in Equal Monthly Installment of Rs.69,805/-(Rupees Sixty Nine
Thousand Eight Hundred and Five Only).

The Borrower entered into and executed loan agreement and availed loan
facility. The said loan facility was granted on an assurance that the same will be
repaid as per agreement schedule and other terms and condition. Than one and two
Mr. S Swaminathan, Mrs.S Sudha (herein after referred to as “Co-Borrower”) duly
filled up Loan Application Forms and other documents along with the Borrower.

That as per the terms and conditions of the said Agreement, borrower and co-
borrower are jointly and severally liable to pay loan amount along with interest and all
the other charges to the Fedbank Financial Services Ltd.
Since the customer/Borrower failed and neglected to adhere the terms & conditions of
agreement in making regular repayment a dispute has been arised.

That Fedbank Financial Services Ltd. Issued a letter intimating a Loan Recall notice
dated 25-Jun-2022 at last known address had called upon the said Borrower and
asked them to pay the outstanding amount of Rs.30,70,557.47/-(Rupees Thirty Lakhs
Seventy Thousand Five Hundred and Fifty Seven and Forty Seven Paise Only), the said
Borrower have refused and neglected to make the said outstanding payment and
thereby they has been raising dispute over payment of said outstanding dues.

That as per arbitration clause of Loan Agreement Loan, all disputes, differences
and/or claims or questions arising out of the said presents shall be referred to and
settled by an arbitration, as per the provisions of the Arbitration and Conciliation Act,
1996(as amended time to time), by a Sole Arbitrator to be appointed by the Fedbank
Financial Services Ltd and the arbitration proceeding shall be held at Mumbai. We
issued the letter to the borrower/co-borrower with a request to accord their consent to
include Chennai as additional venue for their convenience and also we requested them
to revert with their objections if any as regards the Chennai to be included as
additional venue of arbitration. We did not receive any objection from the borrower
despite the notice. Hence we include Chennai as additional Venue of Arbitration.

As the dispute has been arisen between the parties i.e. the Fedbank Financial
Services Ltd and the Customer/Borrower by virtue of the said arbitration clause, it is
required to be adjudicated/settled by a Sole Arbitrator. We, therefore, wish to invoke
the said arbitration clause and refer the dispute to arbitration and wish to appoint
your good self as the Sole Arbitrator to adjudicate/settle the dispute/claim/differences
between the parties.

We hereby request you to kindly accord your consent to act as the Sole
Arbitrator in the said matter. If your goodself is pleased to act as the “Sole Arbitrator”;
we hereby further request your goodself to fix the venue of arbitration at Chennai, as
per the said arbitration clauses, agreed by both the parties and intimate the proposed
date of hearing to parties concern.
