1. Before X received the contribution to the partnership, X, a limited partner, was liable to
W, a creditor. In accordance with Article 1858, before a limited partner receives his
contribution, the limited partner is liable to the creditors only to the extent of the
contribution, which is 20,000. W cannot demand more than 20,000.

After X receives the contribution, X is not liable to W. In accordance with Article


1858, general partners are only liable to the creditors when a limited partner receives their
contribution to the partnership.

2. Yes, X has a right to demand the property to the partnership. In accordance with Article
1857, when the date of the return of contributions comes, the limited partner has a right to
demand their contributions either in cash or property.

3. Yes, X may be included as a party defendant but only to the extent of his contribution to
the partnership, which is 20,000. According to Article 1858, one of the characteristics of
a Limited Partnership is the liability of the limited partner to the creditors only the extent
of the amount of money he contributed to the partnership. W, as a creditor, can’t demand
X, as a limited partner, beyond 20,000.
