Re-assessment of Result & Academic Appeal procedures:

If a student is not happy with his/ her results, that student may appeal against their grade via a written letter,
clearly stating the grounds of appeal to the Chief Executive Officer. This should be submitted after
completion of the subject and within fourteen days of commencement of the new term.

Re-assessment Process:
 An appeal in writing is made to the Academic Manager providing reasons for re-assessment
/appeal.
 Academic Manager will delegate another faculty member to review the assessment.
 The student will be advised of the review result done by another assessor.
 If the student is still not satisfied and further challenges the decision, then a review panel is formed
comprising the lecturer/trainer in charge and the Academic Manager OR if need be an external
assessor.
 The Institute will advise the student within 14 days from the submission date of the appeal. The
decision of the panel will be deemed to be final.
 If the student is still not satisfied with the result, the he / she has the right to seek independent
advice or follow external mediation option with nominated mediation agency.
 Any student who fails a compulsory subject or appeals unsuccessfully will be required to re-enrol
in that subject.
The cost of reassessment will be borne by the Institute. The external assessor will base his/her judgement
based on principles of assessment. These principles require assessment to be reliable, fair, practical and
valid.
Academic Appeals:
 If you are dissatisfied with the outcome of the re-evaluation process, you have a right to appeal
through academic appeals handling protocol.
 To appeal a decision, the person is required to complete the WSC- Request for Appeal of a
Decision form with all other supporting documents, if any. This form is available via our website.
The completed Request for Appeal form is to be submitted to the Student Support Officer either in
hard copy or electronically via the following contact details:

 The notice of appeal should be in writing addressed to the Chief Executive Officer and submitted
within seven days of notification of the outcome of the re-evaluation process.
 If the appeal is not lodged in the specified time, the result will stand and you must re-enrol in the
unit.
 In emergency circumstances, such as in cases of serious illness or injury, you must forward a
medical certificate in support of a deferred appeal. The notice of appeal must be made within three
working days of the concluding date shown on the medical certificate.
 The decision of Chief Executive Officer will be final.
 Student would then have the right to pursue the claim through an independent external body as
detailed in the students’ complaint / grievance policy.

INSTRUCTIONS
Review the background information and complete the tasks that follow.

Background information
You have negotiated with a wholesale butcher to provide beef to the restaurant you work at,
The Best Bite Café, and believe you have negotiated a successful win-win outcome.
As you finalised the agreement you agreed to send a letter to the person you dealt with, John,
confirming the final arrangements in writing so that a formal contract could be established.
The negotiations focussed on:
 Item1: Bone-in grain fed butt (1502 vacuum-packed), MSA Grade 5, 1200kg @ $5.50/kg
 Item 2: Chuck roll – long cut (2289 Trapezius removed; undercut retained; vacuum-
packed), MSA Grade 4, 1000kg @ $4.99/kg
 Item 3: Scotch fillet grass fed (pre-cut 400 – 425gm; Marble score = 3), MSA Grade 5,
2000kg @ $10.25/kg
 Item 4: Striploin grain fed (6 ribs ; intercostals removed; upraspinous ligament removed),
MSA Grade 3, 3000kg @ $7.75/kg
 Item 5: Mince – extra lean ( 20kg packs), MSA Grade 4, 4000kg @ $40/box
 Item 6: Grain fed T-Bones (Bone-in; 500 – 520 gm), MSA Grade 5, 800kg @ $9.98/kg
The name of the butcher is Robinsvale Butchers and you had agreed to buy a nominated
amount of an agreed selection of meat for a 12-month period at agreed prices.
Delivery is to be made by 8am every morning as required Monday – Saturday every week.
Orders to be placed by phone before 3pm the day prior to delivery.
Meat is to be invoiced every 14 days with payment to be made within 7 days of invoice.

i) Head chef: A head chef is a shockingly skilled professional who cooks meals and is
in charge of managing the restaurant's or cafe's operations as well as the dining area.
Guiding and controlling the system for preparing meals and another related activity,
Creating menus using recent or new culinary innovations to provide diversity and
excellent servings. Approving and "polishing" food before it is served to the consumer.

ii) Finance adviser: A financial advisor helps a business organize a sound economic
strategy for investments and other activities so that a decision may be made with
understanding. Financial advisors consider your circumstances and financial goals
before recommending solutions to assist you achieve your goals. Financial advisors
come in two different varieties. Independent financial advisers (IFAs) offer unbiased
guidance on the whole spectrum of financial goods from all different kinds of
organizations that are readily available.

iii) Solicitor: A solicitor is a lawyer who works with criminal matters related to
corporate enterprises. In some jurisdictions, the majority of legal services are typically
provided by solicitors. To be referred to as a solicitor and permitted to practice law as
one in a particular jurisdiction, a person must meet legislative requirements that differ
from one jurisdiction to the next. For instance, a solicitor in England and Wales is
permitted to coach under the terms of the 1974 Solicitors Act. With a few exceptions,
practicing attorneys should be in possession of their training records. In England,
there are far more solicitors than barristers; they handle the fundamental tasks of
recommending legal sentences and carrying out criminal prosecutions.

iv) Connected advisor: A linked advisor is someone who is in charge of connecting


the company with various partners. He or she is responsible for explaining the
corporate structure to potential customers. Connected Advisor helps you identify and
understand the main engine and after treatment problems, and it creates a once-daily
summary, which can cut down on reported problems by up to 90%.

b) Describe three ways that specialist advice may impact the arrangements agreed to as
part of this negotiation.
The three ways that specialist advice may impact the arrangements agreed to as part
of this negotiation are as follows:-

i) Modifications to the quantity ordered: The expert advice may affect the quantity
of various types of beef that the company has decided to order. First, a negotiator
may question your knowledge or competency, for example, by declaring that you lack
the enthusiasm to do a particular task. Second, someone may make fun of your views
in a way that makes it difficult, to which you can respond by saying, "You can't be

critical!" In the end, a co-worker might call out your mannerisms by saying something

condescending, and critical in order to shift the balance of power in their desire.

ii) Modification in the agreed price: The expert counsel may affect the agreed price
of the various types of beef that the company has ordered. Despite understanding the
value of working together to create value, negotiators frequently forgo this tactic while
making decisions in a conflict. They typically regard business conflict resolution as a
zero-sum game, in which the most advantageous single issue (which includes money)

their detriment, they frequently examine the dispute settlement process as a lose-lose
conflict.

iii) Contractual terms changes: The expert counsel may have an effect on the terms
and conditions of the agreement reached by the parties. Because of our personal
experiences with the war and the opposing party, our perspectives of the dispute
settlement process may change over time. For the benefit of their children, for
instance, a couple that has gone through a contentious divorce may eventually
become more cooperative. Try to see your issue as being continually in flux rather
than as being utterly unresolvable. By doing this, you may also encourage them by
showing them that your existing approaches to the conflict resolution are ineffective
and that the prospect of negotiation gives some room for growth. Parties can
gradually resolve their issues if they realize how important regular meetings are.

c) What organisational protocols may apply to entering into binding arrangements with
third parties?

You are now ready to put the agreement into writing so that a formal contract can be
established with Robinsvale Butchers.
The Best Bite café has a formal procedure for entering into formal agreements and contracts.
The procedure states that ‘permission must be sought from management prior to entering into
formal agreements and draft contracts must be submitted to management for consideration.’

The organisational protocols may apply to entering into binding arrangements with third
parties are as follows:-

i) Due diligence on third parties: The management must perform thorough due diligence on
third parties to ensure that they are capable of cooperating with the employer's
requirements.

ii) Submission of a draft contract to counsel: Before finalizing the agreement, the control must
send the draft contract to counsel for any necessary modifications and approval.

iii) Presentation of a draft contract to the other parties who may be impacted by the

for the meat.
