IN TEHSIL TAXILA, DISTRICT RAWALPINDI.

Respected Sir,
It is to inform you that a case with
the title of Sajid Ali versus PHC was
pending before the Session Court of
Rawalpindi, whereby vide order dated 19-
10-2023, PHC is ordained to solve the
matter, forthwith.
That on 18-05-2023, the petitioner
filed the instant petition before the
honourable court of ASJ Taxila, on which
the order of de-sealing was issued;
however, when the petitioner filed
application for the implementation of the
order on 28-07-2023, PHC was issued a
notice on 29-05-2023. As a result, PHC
submitted that the learned session court
of Taxila did not have jurisdiction to
adjudicate upon the matter and only the
Session court of Rawalpindi has the
authority over it. Consequently, the case
was transferred to Rawalpindi Session
Court, which upheld the de-sealing order
of the court and directed the issue to
the chairman PHC in Lahore. Furthermore,
it is also prayed that the equipment,
apparatus, and other belongings of the
quondam tenants who were performing the
quackery may also be removed from the
case property with the assistance of
police.
Therefore, it is kindly prayed that the
instant application may kindly be
accepted, and hereby resolve the matter
equitably and judiciously pertaining to
the Applicant as the he is merely a bona-
fide purchaser and owner of the case
property, and had nothing to do with the
quackery and illegal business being
performed in the case property.
Hence, it would be in the better
interest of justice if he supra mentioned
case property be de-sealed in favour of
the applicant.
