QUESTION 1

On 1 February 2019, Anid was on his second day working as a driver for Pent Medical
Supplies. He has acquired his 'Goods Drivers Licence' (GDL) about two weeks ago. The Pent
Medical Supplies' depot received a call that there has been a serious rail crash and a delivery of
medical products was urgently required at the nearby hospital. Goon, the usual GDL driver was ill,
thus, Lonnie, the manager, instructed Anid to do the delivery because she did not want
to lose the contract to a competitor. While driving, Anid lost control of his van on a bend on
the road and crashed into Gaya, who was crossing the road at the pedestrian crossing.

Advise Gaya.

QUESTION 2

During the inter-league football match between Shahbandar FC and Yamtuan United, Dgomo, a
Shahbandar player, deliberately committed a foul against his opponent, Saddiy. As a result,
Saddiy ruptured his Achilles tendon. Saddiy has to undergo a surgery and later on spent
months of rehabilitation, marking the end of his ability to play football throughout the season.

Saddiy is thinking of suing Dgomo. Saddiy wonders whether Dgomo has any tortious liability
towards him.

Advise Saddiy.
