Iligan Affidavit of Undertaking 40K
I, IMELDA NALE HIMONGALA of legal age, Filipino, and resident of Purok 1, Dalipuga,
Iligan City, after being duly sworn to, under oath and in accordance with law, do hereby
depose and state that:
1. I fully acknowledge and understand that the legal and rightful land owners of the
TITLED LAND wherein I built my house is Mr. and Mrs. Albert Hugo.
3. I agree that I upon signing this undertaking I will receive FORTY THOUSAND
PESOS (P 40,000.00) as partial release of assistance, and upon full demolition and
removal of all salvaged materials the remaining THIRTY THOUSAND PESOS
(P 30,000.00) shall be fully paid to me in cash.
4. I agree to vacate the said land voluntarily with my own free will free from any
threat or intimidation on or before May 18, 2024 which is Sixty Days (60) from
the execution of this document.
7. I agree to haul/transport all the salvaged house materials at my cost. In the event
that I cannot find a truck. The land owner will provide the truck to haul all my
salvaged house materials at my cost to which it will be deducted from the
remaining balance that I am suppose to receive.
8. I further manifest that I fully understand that failure on my part to comply all or
any of the said provisions in this undertaking despite accepting the said amount is
subject to the full force of the law in court to which the land owners Mr. and Mrs.
Albert Hugo can claim for financial and moral damages including any and all
legal repercussions.
9. After the May 18, 2024 deadline if I am still not able to demolish my house
despite receiving the Partial cash assistance, I am waiving all my rights and claims
to my house in favor to the land owners without further payment. I therefore
authorize them to demolish my house without the need for a court order.
10. I agree that If I fail to comply to the May 18, 2024 deadline, I will not receive the
remaining P 30,000.00 balance.

11. Notwithstanding anything to the contrary set forth herein, The Land owner shall
not be liable for punitive, exemplary, special, indirect or consequential damages
resulting from or arising out of this agreement.
12. I am executing this Affidavit of Undertaking to attest to the truth of the foregoing.
IN WITNESS WHEREOF, I hereunto affix my signature this ______day of
_______________ 2024, at Iligan City.
ACKNOWLEDGEMENT
Known to me and to me known to be the same person who executed the foregoing instrument
and acknowledged to me that the same is his free and voluntary act and deed.
This instrument consisting of 2 pages, including the page on which this acknowledgement is
written, has been signed on each and every page thereof by the concerned parties and their
witnesses, and sealed with my notarial seal.
