Domestic Workers Act
SEC. 4 (d) Domestic worker or “Kasambahay”
refers to any person engaged in domestic work
within an employment relationship such as, but
not limited to, the following: general
househelp, nursemaid or “yaya”, cook,
gardener, or laundry person, but shall exclude
any person who performs domestic work only
occasionally or sporadically and not on an
occupational basis.

Who are the Kasambahay covered

All Kasambahay engaged in domestic work,


whether on a live-in or live-out arrangement, such
as, but not limited to the following:

Contributions of Household Employers

If wage is less than ₱5,000 a month, the full


amount of the SS contribution shall be shouldered
by the household employer.

If ₱5,000 and above, the SS contribution shall be


shared by the employer and the employee based
on the SSS Contribution Schedule.

➢ Spouses who devote full time to managing


the household and family affairs, may be
covered by the SSS on a voluntary basis.
➢ Legally married to a currently employed or
self – employed member
Note: Contribution is 50% of the
working spouse’s last posted MSC but should not be lower than Php 2,000.

Overseas Filipino Workers (OFW)

A Filipino recruited by a foreign-based


employer for employment abroad;

who has a source of income in a


foreign country; or

a permanent resident of a
foreign country.

Overseas Filipino Workers (OFW)
Coverage in the SSS shall be compulsory upon all sea-
based and land-based OFWs. Provided, that they are not
over 60 years of age, if initial coverage.

If the SSS has bilateral labor agreements with the worker’s


host country, they shall be considered as covered EEs with
ER and EE shares in contributions.

Otherwise, the member may pay as self-employed


members, as their coverage is compulsory.

Overseas Filipino Workers (OFW)
1995 – Regular OFW Coverage Program
Minimum Monthly Salary Credit for OFWs is
₱8,000, effective April 2019 (RA 11199)

2001 – SSS Flexi-Fund Program


Voluntary, individual account scheme offered
exclusively to OFWs in addition to the Regular
Coverage Program
Members are entitled to the net guaranteed earnings from their
accumulated Flexi-fund contributions, tax-free.

Reminders: Employer DAEM

✓ The employer shall enroll only one account where proceeds of benefits shall be
credited. Employer may enroll the same account for all its branches and
subsidiaries.

✓ Only the employer's authorized personnel will be given access and authority to
enroll the PESONet Participant account information.

✓ Bank accounts should be from among the PESONet-accredited banks. You


should enter your bank account number and not your ATM card number.

✓ Bank account numbers should be written as a continuous string of numbers

Reminders for Self-employed Members
Members who have already paid their contributions in advance for
applicable months of January 2023 onwards based on the old contribution
schedule are advised as follows:
1. Those with advance payment at the minimum MSC of P3,000 shall
settle underpayment amounting to P170 to retain the posting of
contributions to the new minimum MSC of P4,000; otherwise, such
advance payment shall be deemed as an ineffective contribution;
and

2. Those with advance payments at an MSC other than the minimum of


P3,000 may opt to pay the corresponding increase in contributions to
retain posting at the same MSC; otherwise, such advance payment
shall be posted at the applicable lower MSC.

Changing of Monthly Salary Credit (MSC)
Self-Employed (SE)/Voluntary Member (VM), including OFW, may change their MSC by
one to two salary brackets without requiring the submission of documents to prove their
earnings.

a) An SE member who is below 55 years old shall be allowed to change his/her MSC
without limit in frequency and in number of salary brackets in a given calendar year, but
in no case shall it be lower than the prevailing minimum MSC for SE members.

b) An SE member who is 55 years old and above shall be allowed to increase his/her MSC
only once in a given calendar year and by one salary bracket only from the last posted
MSC, regardless of whether proof of earnings is presented or not, except for the case of a
higher maximum MSC under a new applicable Schedule of Contributions. He/She shall be
allowed to increase his/her MSC up to the new maximum MSC, provided that his/her last
posted MSC corresponds to the maximum MSC under the immediately preceding
Schedule of Contributions.

No. The SS number assigned to a member is his/her

benefits or loans in the future.

No. The SS number assigned to a
member is his lifetime number. The
“temporary SS No.” flag is simply an
indicator that the registrant did not
submit the required document/s at the

voluntary members?
No. He/She just need to pay his/her SS
contributions under the membership type of a
“voluntary member”. She/He can get the Payment

What should a member do if an employer
does not remit the contributions they have
deducted from the EE’s salary?
He/She can visit any SSS Branch to file a
complaint against his/her employer and bring
documentary proofs of employment (e.g.,
payslip, company ID, etc.) It is, however,
advisable to go to concerned SSS branch which
has jurisdiction over the employer’s principal
place of business to expedite the process.

Can a foreigner paying SSS contributions file for a
refund of his/her contributions if he/she is
permanently leaving the Philippines?
No. He/She will follow Philippine law,
rules, and regulations that no refund of
his/her contributions be made. He/She,
however, can file for a retirement
benefit (monthly pension or lump sum)
upon reaching 60 years of age.

Self-Service Express Terminals

Using the Self-Service Express Terminal, members can


avail of the following services:

✓ Online Inquiry
✓ Verification of loan/benefit application status
✓ Loan and benefit eligibility inquiry
✓ Submission of Salary Loan Application
✓ Submission of Maternity Notification
✓ Submission of Retirement Application
✓ Compliance to ACOP
✓ Generation of PRN for contributions
✓ PIN Change

STEPS IN USING THE
SELF-SERVICE EXPRESS TERMINAL (SET)
• Tap the screen to start (if screen is on standby mode).
• Select an option to start the transaction – UMID Card or SSS Website.

UMID Card Activation:


1) Place your UMID Card on the card reader.
2) A confirmation message will show that the card has been read. If an error message is displayed, please remove
your card and replace it on the card reader.
3) Click “YES” to activate the card.
4) Place your finger accordingly on the fingerprint scanner, as instructed onscreen by the system.
5) Assign your 6-Digit PIN and click “Submit”. You may now use the SET.

Accessing the SET with the UMID Card:


1) Place your UMID Card on the card reader.
2) A confirmation message will show that the card has been read. If an error message is displayed, please remove
your card and replace it on the card reader.
3) Select one of the following options:
a) Scan your fingerprint/s; or
b) Enter your 6-Digit PIN.
4) Click “Submit”.

Logging in to My.SSS Account:


1) Tap the SSS Website icon.
2) Log in using your Username and Password.
3) Click “Submit”.
Note: Printing and file attachment are unavailable in the SET.

Reference Number;
• Pag-apply sa Pension Loan Program; o
• iba pang serbisyo tulad ng pag-file o paglakad ng
claims.
