LOCAL ZONING REGULATIONS A LOW-DENSITY COMMERCIAL AREA WITHIN A CITY OR MUNICIPALITY INTENDED FOR NEIGHBORHOOD OR
COMMUNITY SCALE TRADE, SERVICE AND BUSINESS ACTIVITIES.
THE PROPOSED RECREATIONAL PARK
AND RIVER PROMENADE ALONGSIDE THE BANKS OF ALLOWABLE USES
ILOILO RIVER IS CATEGORIZED UNDER COMMERCIAL
1/ MIXED ZONE. THE MIXED-USE NATURE OF THIS ● PARKS, PLAYGROUNDS, POCKET PARKS, PARKWAYS, PROMENADES AND PLAY LOTS
ZONE AIMS TO CREATE VIBRANT AND DIVERSE ● PARKING LOTS/GARAGE FACILITIES
COMMUNITIES WHERE PEOPLE CAN LIVE, WORK, AND
ACCESS AMENITIES WITHIN CLOSE PROXIMITY. BUILDING REGULATIONS

1. PER THE RELEVANT PROVISIONS OF THE NBC AND THIS ORDINANCE.


ZONING ORDINANCE
2. THE NUMBER OF ALLOWABLE STOREYS/FLOORS ABOVE ESTABLISHED GRADE IS THREE (3) AS
PROVIDED IN THE NBC

VIEW CORRIDORS, AND ARCHITECTURAL HERITIES. PURPOSES FOR THE UNDERPRIVILEGED AND HOMELESS AS DEFINED IN RA 7279. SUCH ZONES SHALL BE
FUTURE PLAN SEEKED TO IMPROVE THE APPLIANCE DISTRIBUTED THROUGHOUT THE CITY AND IN ALL OF ITS DISTRICTS TO HELP ENSURE THE ESTABLISHMENT
OF EXISTING FLOOD OVERLAY ZONE REGULATIONS. OF SOCIALIZED HOUSING SITES OR HOUSING FOR THE URBAN POOR THAT WILL ALWAYS BE WITHIN 8-10
KILOMETERS PROXIMITY OF JOBS AND LIVELIHOOD SOURCES. SUCH DISTRIBUTION IS ALSO FACILITATED
WATER USE POLICIES WITH THE INTENT TO MAKE ACCESS TO THESE AREAS BY PUBLIC TRANSPORT EASY AND AFFORDABLE. (THIS
IS APPLICABLE FOR
REGULATIONS GOVERN THE USE OF WATER RESOURCES FOR MINING, RECREATION, TRANSPORTATION, AND
FISHING AS LONG AS THEY COMPLY WITH APPLICABLE LAWS AND COVER RIVERS, ESTUARIES, STREAMS,
CREEKS, AND SEAS. SECTION 13. ZONING INCENTIVES

DENSITY BONUSES, SUCH AS THROUGH ALLOWABLE BUILDING HEIGHT INCREASES, MAY BE PROVIDED AS
CLUP VOL.2, ART. V: ZONE REGULATIONS
INCENTIVES FOR PROJECTS THAT USE CCA/DRRM TECHNOLOGY OR INNOVATIONS, I.E., USE OF SOLAR
SECTION 10. GENERAL PROVISIONS PANELS, RAINWATER HARVESTING, SMART URBAN DRAINAGE SYSTEMS, GREEN ARCHITECTURE/ BUILDING
SYSTEMS.
ZONE REGULATIONS REFER TO USE AND BUILDING REGULATIONS AS DESCRIBED BELOW:
SIMILAR INCENTIVES MAY ALSO BE GIVEN TO PROJECTS THAT PROVIDE WIDER SETBACKS, INCREASED
GROUND LEVEL OPEN SPACES, PROVIDES PUBLIC INFRASTRUCTURE OR CONSERVE HERITAGE SITES. THESE
ALLOWABLE USES
INCENTIVES WILL BE DEVELOPED BY A MANAGEMENT BOARD OR EXISTING APPROPRIATE LOCAL BODY OR
COUNCIL THAT SHALL ENSURE GOALS FOR AREA MANAGEMENT WILL BE ACHIEVED.
THE USES ENUMERATED IN THE SUCCEEDING SECTIONS ARE NOT EXHAUSTIVE NOR ALL INCLUSIVE. THE
ILOILO CITY ZONING BOARD OF APPEALS (ICZBA) MAY ALLOW OTHER USES SUBJECT TO THE REQUIREMENTS
OF THE MITIGATING DEVICES PROVISION OF THIS ORDINANCE.
ENVIRONMENTAL CODES
SPECIFIC USES/ACTIVITY OF LESSER DENSITY WITHIN A PARTICULAR ZONE (C-1) MAYBE ALLOWED WITHIN
THE ZONE OF HIGHER DENSITY (C-2, C-3) BUT NOT VICE VERSA, NOR IN ANOTHER AND ITS SUBDIVISIONS (E.G.,,
LOCAL GOVERNMENT CODES (REPUBLIC ACT NO. 7160):
R- 2/MXD, R-3/MXD) EXCEPT FOR USES EXPRESSLY ALLOWED IN SAID ZONES, SUCH THAT THE CUMULATIVE
EFFECT OF ZONING SHALL BE INTRAZONAL AND NOT INTERZONAL.
LOCAL GOVERNMENT UNITS (LGUS) HAVE THE AUTHORITY TO ENACT ORDINANCES AND REGULATIONS
RELATED TO ENVIRONMENTAL PROTECTION, WASTE MANAGEMENT, AND POLLUTION CONTROL.
BUILDING REGULATIONS
RECREATIONAL PARK DEVELOPERS AND OPERATORS MUST COMPLY WITH LOCAL ORDINANCES AND SECURE
BUILDING REGULATIONS SPECIFY WHETHER BUILDINGS/STRUCTURES MAY BE ALLOWED IN SPECIFIC PERMITS FROM LGUS FOR PARK DEVELOPMENT AND OPERATION.
ZONES/SUB- ZONES. WHEN ALLOWED, BUILDINGS/STRUCTURES SHALL BE DESIGNED, CONSTRUCTED AND
PHILIPPINE ENVIRONMENTAL IMPACT STATEMENT SYSTEM (PRESIDENTIAL DECREE NO. 1586, AS AMENDED
OPERATED IN ACCORDANCE WITH THE REQUIREMENTS OF EACH ZONE'S GOVERNING AUTHORITY AS WELL
BY EXECUTIVE ORDER NO. 192):
AS WITH THE RELEVANT PROVISIONS OF THE NATIONAL BUILDING CODE (NBC) AND THIS ORDINANCE.
PROJECTS, INCLUDING THE ESTABLISHMENT OR EXPANSION OF RECREATIONAL PARKS, THAT MAY HAVE
SECTION 11.17. PARKS AND RECREATION ZONE
SIGNIFICANT ENVIRONMENTAL IMPACTS ARE SUBJECT TO THE ENVIRONMENTAL IMPACT ASSESSMENT (EIA)
PROCESS. RECREATIONAL PARK DEVELOPERS ARE REQUIRED TO PREPARE AN ENVIRONMENTAL IMPACT
A PARKS AND RECREATION ZONE SHALL PRIMARILY BE USED AS AN AREA DESIGNED FOR DIVERSION/
STATEMENT (EIS) AND SECURE AN ENVIRONMENTAL COMPLIANCE CERTIFICATE (ECC) BEFORE PROJECT
AMUSEMENTS AND FOR THE MAINTENANCE OF ECOLOGICAL BALANCE OF THE COMMUNITY.
IMPLEMENTATION.
NATIONAL INTEGRATED PROTECTED AREAS SYSTEM (NIPAS) ACT OF 1992 (REPUBLIC ACT NO. 7586): WATER CODE (P.D. 1067):

THIS LAW ESTABLISHES A COMPREHENSIVE SYSTEM OF PROTECTED AREAS THROUGHOUT THE PHILIPPINES THE WATER CODE OF THE PHILIPPINES, A DECREE INSTITUTING A WATER CODE, THEREBY REVISING AND
FOR THE CONSERVATION OF BIODIVERSITY AND SUSTAINABLE DEVELOPMENT. IT INCLUDES PROVISIONS FOR CONSOLIDATING THE LAWS GOVERNING THE OWNERSHIP, APPROPRIATION, UTILIZATION, EXPLOITATION,
THE MANAGEMENT AND PROTECTION OF THESE AREAS, WHICH CAN INCLUDE RECREATIONAL PARKS. DEVELOPMENT, CONSERVATION AND PROTECTION OF WATER RESOURCES

THE CLIMATE CHANGE ACT (REPUBLIC ACT NO. 9729) SANITATION CODE OF THE PHILIPPINES (P.D. 856):

A LEGISLATION ENACTED IN THE PHILIPPINES AIMED AT ADDRESSING CLIMATE CHANGE ISSUES. IT PLACES RESPONSIBILITY ON LOCAL GOVERNMENT UNITS FOR THE PROVISION OF AN ADEQUATE SOLID
MANDATES THE CREATION OF A CLIMATE CHANGE COMMISSION, WHICH IS TASKED WITH COORDINATING, WASTE DISPOSAL SYSTEM IN THEIR AREA OF JURISDICTION.
MONITORING, AND EVALUATING PROGRAMS AND ACTION PLANS RELATED TO CLIMATE CHANGE MITIGATION
AND ADAPTATION. THE LAW ALSO PROMOTES CLIMATE CHANGE AWARENESS AND EDUCATION, AS WELL AS P.D. 1152 - ESTABLISHES SPECIFIC ENVIRONMENTAL MANAGEMENT POLICIES AND SETS ENVIRONMENTAL
THE INTEGRATION OF CLIMATE CHANGE CONSIDERATIONS INTO NATIONAL, LOCAL, AND SECTORAL QUALITY STANDARDS TO GUIDE A COMPREHENSIVE ENVIRONMENTAL MANAGEMENT PROGRAM.
DEVELOPMENT PLANS.
P.D. 1586 - SETS UP AN ENVIRONMENTAL IMPACT STATEMENT (EIS) SYSTEM TO EVALUATE THE POTENTIAL
CLEAN AIR ACT (REPUBLIC ACT NO. 8749): ENVIRONMENTAL IMPACTS OF PROPOSED PROJECTS.

THE CLEAN AIR ACT AIMS TO PROTECT AND PRESERVE THE QUALITY OF THE AIR BY REGULATING EMISSIONS P.D. 296 - DIRECTS INDIVIDUALS AND ENTITIES TO VACATE AND REFRAIN FROM ENCROACHING UPON
FROM VARIOUS SOURCES, INCLUDING RECREATIONAL FACILITIES WITHIN PARKS. RECREATIONAL PARKS RIVERBANKS, CREEKS, ESTEROS, DRAINAGE CHANNELS, AND SIMILAR WATERWAYS.
NEED TO COMPLY WITH EMISSION STANDARDS FOR VEHICLES, GENERATORS, AND OTHER EQUIPMENT TO
MINIMIZE AIR POLLUTION. P.D. 619 - AUTHORIZES THE RECLASSIFICATION, RESERVATION, AND DEVELOPMENT OF PUBLIC LANDS,
INCLUDING GRAZING RESERVES FOR LARGE-SCALE RANCHING PROJECTS.
CLEAN WATER ACT (REPUBLIC ACT NO. 9275):
NETWORK OF GREEN AND OPEN SPACES
THE CLEAN WATER ACT ESTABLISHES POLICIES AND REGULATIONS FOR THE PROTECTION AND ASIDE FROM COMPLYING WITH THE OPEN SPACE REQUIREMENTS OF PD 957, BP 220 AND OTHER RELATED
PRESERVATION OF WATER QUALITY IN RIVERS, LAKES, AND COASTAL AREAS. RECREATIONAL PARKS MUST ISSUES, ALL RESIDENTIAL, COMMERCIAL, INDUSTRIAL, AND MIXED-USE SUBDIVISIONS ARE REQUIRED TO
PREVENT THE DISCHARGE OF UNTREATED SEWAGE AND POLLUTANTS INTO WATER BODIES WITHIN PARK PROVIDE TREE-PLANTED STRIPS ALONG ITS INTERNAL ROADS HAVING SPACING OF NOT MORE THAN TEN (10)
BOUNDARIES. METERS. SIMILAR DEVELOPMENTS WITH TOTAL CONTIGUOUS LAND AREAS GREATER THAN TEN (10)
HECTARES ARE REQUIRED TO PROVIDE, IN ADDITION TO THE GREEN STRIPS EARLIER, ADEQUATE
PHILIPPINE CLEAN WATER ACT (REPUBLIC ACT NO. 9275): LANDSCAPED FOREST PARKS FOR THE USE OF THE OCCUPANTS AND/OR THE GENERAL PUBLIC. RESIDENTIAL
COMPOUNDS, REGARDLESS OF TOTAL LOT AREA, SHALL PROVIDE AN OPEN SPACE FOR PLAYGROUND
THIS LAW REGULATES THE QUALITY OF WATER RESOURCES AND SETS STANDARDS FOR THE DISCHARGE OF PURPOSES. WHERE THE RESIDENTIAL COMPOUND IS INTENDED FOR LESS THAN TEN (10) FAMILIES, THE
POLLUTANTS INTO WATER BODIES. RECREATIONAL PARKS MUST IMPLEMENT MEASURES TO PREVENT WATER SETTING ASIDE OF SUCH AREA FOR PLAYGROUND PURPOSES MAY BE DISPENSED WITH, PROVIDED THAT AN
POLLUTION, SUCH AS PROPER WASTEWATER TREATMENT AND STORMWATER MANAGEMENT. OPEN SPACE MAY BE USED AS PART OF THE YARD REQUIREMENT FOR THE COMPOUND. ALL DESIGNATED
OPEN SPACES SHALL NOT BE CONVERTED TO OTHER USES.
ECOLOGICAL SOLID WASTE MANAGEMENT ACT (REPUBLIC ACT NO. 9003):
ENVIRONMENTAL URBAN GREENING
THIS LAW PROVIDES GUIDELINES FOR THE PROPER MANAGEMENT OF SOLID WASTE, INCLUDING
SEGREGATION, COLLECTION, RECYCLING, TREATMENT, AND DISPOSAL. RECREATIONAL PARKS ARE ESTABLISHMENT OF TREE PARKS, GREEN TUNNELS, GREEN WALLS AND LANDSCAPING OF POCKET PARKS
REQUIRED TO IMPLEMENT WASTE SEGREGATION AND RECYCLING PROGRAMS TO MINIMIZE THE GENERATION ROAD MEDIANS, SIDEWALKS BY THE OFFICE OF THE CITY AGRICULTURIST, CITY ENRO AND THE CITY
OF SOLID WASTE AND PROMOTE SUSTAINABLE WASTE MANAGEMENT PRACTICES. BEAUTIFICATION PROGRAM TEAM

SOLID WASTE MANAGEMENT RULES AND REGULATIONS (DENR ADMINISTRATIVE ORDER NO. 35, SERIES OF
URBAN SUSTAINABILITY AND RESILIENCE PROGRAM
1990):
ENVIRONMENTALLY FRIENDLY MATERIALS ARE USED FOR CONSTRUCTION, AND BUILDINGS ARE DESIGNED
ISSUED BY THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR), THESE RULES PROVIDE
AND BUILT TO BE ENERGY EFFICIENT. DEVELOPMENTS ARE DESIGNED WITH THE HEALTH OF RESIDENTS IN
SPECIFIC GUIDELINES FOR THE IMPLEMENTATION OF SOLID WASTE MANAGEMENT PROGRAMS, INCLUDING
MIND, WITH PEDESTRIAN AND BICYCLE ACCESS PRIORITIZED OVER CAR USE. SUSTAINABILITY INITIATIVES
WASTE SEGREGATION, COLLECTION, AND DISPOSAL. RECREATIONAL PARKS MUST COMPLY WITH THESE
NEED TO THINK BEYOND THE BUILDING SITE. THEY ENCOURAGE PEDESTRIAN- AND BIKE-FRIENDLY
RULES TO ENSURE PROPER WASTE MANAGEMENT PRACTICES.
COMMUNITIES BY PRIORITIZING PUBLIC TRANSIT, SMALL BLOCKS, DENSE ROAD NETWORKS, AND MIXED-USE

LAND USE RESTRICTIONS RIVERBANK ROAD PROJECT) BY THE DPWH.

EASEMENT IS A NO BUILD ZONE WITHIN THREE (3) METERS FROM THE MHWM ALONG RIVERS, CREEKS
AND ESTUARIES. NO PERSON SHALL BE ALLOWED TO STAY IN THESE AREAS LONGER THAN WHAT IS
