RATES AND CONDITIONS OF HIRE

1. SEATING

2. TIMES AVAILABLE FOR HIRE


From 9.00am to 11.00pm

HIRE RATES

Monday to Friday from 5.00pm to 11.00pm, Weekends


from 9.00am to 11.00pm
Hourly Rate – Full House $265.00

Minimum Booking of five (5) hours $1,325.00

Please enquire for details on weekly or longer term hire rates.

4. REHEARSAL RATES
70% of the hire rate.

4. PAYMENT
Fifty percent (50%) deposit shall be paid within SEVEN (7) DAYS OF THE BOOKING BEING
CONFIRMED.

DEPOSITS ARE NOT REFUNDABLE


The fifty percent (50%) balance owing shall be paid within seven (7) days of the conclusion of
the season.

replacements necessary during the season.)
• Any additional equipment including the items listed in section 7.

TERMS OF AGREEMENT
If the dates and times attached are acceptable to your organization, please carefully read the following term s of agreement and
return on (l) signed copy within seven (7) days. The "Hirer" referred to hereafter represents the client organisation using the AMPA
Tom Mann Theatre facilities. The word "Operator" refers to the Academy of Music and Performing Arts. The word "Theatre"
wherever appearing shall mean the Tom Mann Theatre.

1. The Hirer understands that if this letter of agreement is not signed, and returned to the registered office at the Operator
within 7 days, the season on offer may be withdrawn at the discretion of the Operator.
2. The Hirer agree s that unless payment representing the fifty per cent (50%) deposit of the total costs of the season is
not received within seven (7 ) days of this letter of agreement being signed, the season on offer may be withdrawn at
the discretion of the Operator. DEPOSITS ARE NOT REFUNDABLE.
3. The Hirer understands that if the season on offer is cancelled (once this letter of agreement is signed) in the four weeks
before the commencement of Hire, the Hirer is liable to pay for the entire season as compensation for loss of revenue to
the Operator. The Hirer shall give the Operator written notice of cancellation.
4. The Hirer agrees to pay the fifty per cent (50%) balance within seven (7) days of the conclusion of the season.
5. The Tom Mann 's Theatre Manager reserves the right to approve all technical staff brought into the premises by the
Hirer. The Hirer is requested to supply a list of cast and production personnel two weeks before the commencement
date.
6. The Operator reserves the right of entry to the premises at all times.
7. The Hirer accepts that access to the premises at times other than those negotiated is at the discretion of the Operator.
8. The Hirer warrants that all necessary copyright associated with the staging of the production having been obtained and
hereby indemnifies the Operator from any action arising from breach of copyright or defamation.
9. The Hirer will observe and comply with the provisions of all industrial agreements, awards and determinations relating to
any person engaged or employed in relation to the production. Should any labour disputes occur as a result of or
connect in any way with the Hirer 's activities, the Hirer hereby assumes the burden of resolving any such disputes.
10. The Operator does not accept liability for the following:
a. Monies collected and/or held at these premises
b. Actions of the Hirers or their associates while on the premises
c. Any loss or damage to the equipment or personal effects of the Hirers or their associates.
11. Any production equipment, sets, costumes, props, or personal effects at the premises are at the risk of the Hirer.
12. The Operator points out and it is understood by the client organization that it is the responsibility of the client
organization to make provision for any necessary insurances for the production (Equipment, Public Liability, etc.).
13. The Hirer agrees to take diligent care with the lighting and sound systems placed at their or her / his disposal, and
undertake to pay for the cost of any stage lighting lamps replacements necessary during the season.
14. The Hirer is liable to pay for any extra time used in the premises over and above the negotiated dates and scheduled
times within seven days of an invoice being sent by the Operator.
15. The Hirer must vacate the premises by the end of the Agreed Times. Failure to do so will result in a call to security to
attend the premises. Any call out will attract a fee of up to $500.
16. The Hirer understands that under no circumstances is the Theatre to be used as a workshop for the manufacture of sets
and costumes as such activity contravenes Council regulations. Sets must arrive ready to erect. No construction is
permitted on the premises. Any painting, repairs, or assembly must take place on stage.
17. The Hirer will not bring or permit any flame, explosive, fuel, ammunition, firearm, or flammable liquid or substance to be
brought into or used on the premises.
18. The Hirer is responsible for equipment, furniture, fittings, walls and floors during the hire period. Any loss, theft or
damage will be charged to the Hirer and is payable within seven days of an invoice being sent by the Operator.
19. All sets,props, costumes and any other production equipment must be removed from the premises by the Hirer after the
final performance with in the negotiated schedule time. Property not removed may be disposed of by the Operator.
20. If the Hirer books the Theatre for broken periods during a season then the Operator has the right to require the Hirer to
remove all sets, co stumes and production equipment during the periods in which the Hirer has not booked.
21. No changes may be made to the negotiated dates and scheduled times other than by prior consultation and agreement.
22. The hiree is not to permit smoking in the theatre or foyer.
23. The hiree shall hold AMPA and AMWU harmless and indemnified in respect of:
a. Any claims of any type arising out of breach of any provision of the Occupational Health and Safety Act 1983
ar ising out of smoking during the period of the hire;
b. The costs of cleaning and removal of smoke related odour arising out of the period of the hire;
c. Any costs, claims, suites, damages or damage of any type arising out of or incidental smoking within the
theatre or foyer.
24. Non compliance with any of the above of the above terms of agreement may render this letter of agreement invalid and
the production liable to closure at the discretion of the Operator without recourse of loss of revenue or damages by the
Hirer as a consequence of the Operator decision and in addition the whole amount due under the Hiring Agreement to
the Operator shall be payable forthwith and in the event such amount is not paid forthwith the Operator reserves the
right to recover that amount in any court of competent jurisdiction.
25. The nominated person acknowledges that in signing this agreement he / she or they agree to be personally bound by
the terms of the agreement and personally responsible for any breach by the Hirer.
