DEFINITION OF TERMS:
1. BID: A FORMAL OFFER BY A BIDDER TO EXECUTE THE WORK AT A STATED PRICE.
2. BID BULLETIN: A DOCUMENT ISSUED TO PROVIDE ADDITIONAL INFORMATION,
CLARIFICATION, OR CORRECTIONS TO THE BID DOCUMENTS AFTER THEIR
ISSUANCE.
3. BID DOCUMENTS: THE COMPLETE SET OF DOCUMENTS ISSUED BY THE OWNER
OR THE ARCHITECT/ENGINEER TO BIDDERS FOR THE PURPOSE OF OBTAINING
BIDS, INCLUDING THE INVITATION TO BID, INSTRUCTIONS TO BIDDERS, AND THE
FORM OF BID.
4. INSTRUCTION TO BIDDERS: A DOCUMENT THAT OUTLINES THE PROCEDURES AND
RULES GOVERNING THE BIDDING PROCESS AND THE SUBMISSION OF BIDS.
5. WRITTEN NOTICE: A FORMAL COMMUNICATION IN WRITING TYPICALLY USED TO
CONVEY IMPORTANT INFORMATION OR INSTRUCTIONS.
6. CONTRACT: A LEGALLY BINDING AGREEMENT BETWEEN THE OWNER AND THE
CONTRACTOR FOR THE EXECUTION OF THE WORK.
7. CONTRACT DOCUMENTS: THE COMPLETE SET OF DOCUMENTS THAT DEFINE THE
RIGHTS, RESPONSIBILITIES, AND RELATIONSHIPS OF THE PARTIES INVOLVED IN
THE CONSTRUCTION PROJECT, INCLUDING THE CONTRACT ITSELF, DRAWINGS,
SPECIFICATIONS, AND GENERAL CONDITIONS.
8. DRAWINGS: GRAPHIC REPRESENTATIONS, SUCH AS PLANS, ELEVATIONS, AND
DETAILS, ILLUSTRATING THE DESIGN AND DIMENSIONS OF THE PROJECT.
9. SPECIFICATIONS: DETAILED WRITTEN DESCRIPTIONS OF THE MATERIALS,
WORKMANSHIP, AND PERFORMANCE REQUIREMENTS FOR THE PROJECT.
10. SCHEDULE OF MATERIALS: A DOCUMENT LISTING THE TYPES AND QUANTITIES
OF MATERIALS REQUIRED FOR THE PROJECT.
11. BREAKDOWN OF WORKS: A DETAILED BREAKDOWN OF THE DIFFERENT
COMPONENTS OR PHASES OF THE CONSTRUCTION WORK.
12. GENERAL CONDITIONS: STANDARDIZED TERMS AND CONDITIONS THAT APPLY TO
THE CONSTRUCTION CONTRACT, COVERING ISSUES SUCH AS PROJECT
ADMINISTRATION, RESPONSIBILITIES OF THE PARTIES, AND DISPUTE
RESOLUTION.
13. SPECIAL PROVISIONS: ADDITIONAL OR MODIFIED CONDITIONS THAT ARE
SPECIFIC TO A PARTICULAR PROJECT AND ARE INCLUDED AS PART OF THE
CONTRACT DOCUMENTS.
14. PROGRESS BILLINGS: INVOICES SUBMITTED BY THE CONTRACTOR TO THE
OWNER FOR WORK COMPLETED UP TO A CERTAIN POINT IN TIME.
15. FINAL PAYMENT: THE LAST PAYMENT MADE BY THE OWNER TO THE
CONTRACTOR, TYPICALLY AFTER COMPLETION OF ALL WORK AND FULFILLMENT
OF CONTRACT REQUIREMENTS.
16. BID BOND: A FINANCIAL GUARANTEE PROVIDED BY THE BIDDER TO
DEMONSTRATE THEIR COMMITMENT AND ABILITY TO ENTER INTO A CONTRACT IF
AWARDED THE PROJECT.
17. PERFORMANCE BOND: A BOND THAT ENSURES THE CONTRACTOR WILL
COMPLETE THE PROJECT ACCORDING TO THE CONTRACT TERMS.
18. GUARANTEE BOND: A BOND THAT PROVIDES A GUARANTEE AGAINST DEFECTS IN
WORKMANSHIP OR MATERIALS FOR A SPECIFIED PERIOD.
19. PAYMENT BOND: A BOND THAT ASSURES SUBCONTRACTORS AND SUPPLIERS
WILL BE PAID BY THE CONTRACTOR FOR WORK AND MATERIALS FURNISHED ON
THE PROJECT.
20. TIME LIMITS: THE SPECIFIED DURATION WITHIN WHICH THE CONTRACTOR IS
REQUIRED TO COMPLETE THE PROJECT.
21. TIME ADVANCES: ADDITIONAL TIME GRANTED TO THE CONTRACTOR FOR VALID
REASONS, AS STIPULATED IN THE CONTRACT.
22. TIME DELAYS: UNFORESEEN INTERRUPTIONS TO THE CONSTRUCTION
SCHEDULE THAT MAY IMPACT PROJECT COMPLETION.
23. TIME EXTENSION: AN OFFICIAL EXTENSION OF THE PROJECT'S COMPLETION TIME
BEYOND THE ORIGINALLY SPECIFIED DATE.
24. FORCE MAJEURE: EXTRAORDINARY EVENTS OR CIRCUMSTANCES BEYOND THE
CONTROL OF THE PARTIES THAT MAY EXCUSE DELAYS OR NON-PERFORMANCE.
25. SHOP DRAWINGS: DETAILED DRAWINGS, DIAGRAMS, AND SCHEDULES PREPARED
BY THE CONTRACTOR OR SUBCONTRACTOR TO ILLUSTRATE SPECIFIC PORTIONS
OF THE WORK.
26. AS-BUILT PLANS: REVISED DRAWINGS REFLECTING CHANGES MADE DURING
CONSTRUCTION, PROVIDING AN ACCURATE RECORD OF THE COMPLETED
PROJECT.
27. CHANGE ORDER: A WRITTEN ORDER TO MAKE CHANGES TO THE WORK
SPECIFIED IN THE ORIGINAL CONTRACT.
28. EXTRA WORK ORDER: AN ORDER FOR WORK THAT IS NOT INCLUDED IN THE
ORIGINAL CONTRACT BUT BECOMES NECESSARY DURING THE COURSE OF
CONSTRUCTION.
29. LIQUIDATED DAMAGES: AGREED-UPON DAMAGES, SPECIFIED IN THE CONTRACT,
PAYABLE BY THE CONTRACTOR FOR DELAYS IN COMPLETING THE PROJECT.
30. DEFECTIVE MATERIALS: MATERIALS THAT DO NOT MEET THE SPECIFIED
STANDARDS OR REQUIREMENTS AND MAY NEED TO BE REPLACED OR
CORRECTED BY THE CONTRACT
