Introduction to the Philippine Civil Aviation Regulation

What is civil aviation?

It is one of the two major categories of


flying, representing all non-military
aviation. It is applicable to both Private
and Commercial operators and
personnel.

Most of the countries are members of


ICAO from which all civil aviation
regulation in the world adheres to.

such as recreation and business meetings) and Commercial (such as flying done for hire)
operators and personnel.
Most of the are members of International Civil Aviation Organization (ICAO) and work
together to establish regulations.

The Civil Aviation Authority of the Philippines
(CAAP) is the agency responsible for
prescribing rules and regulations for all
aircraft owned and operated in the
Philippines. It is also tasked with the
enforcement of laws governing air
transportation.

The Civil Aviation Authority of the Philippines (CAAP) is the agency responsible for

Mandates and Functions:

Republic Act No. 9497


• Determine, fix and/or prescribe charges
and/or rates pertinent to the operation of
public air utility facilities and services;
• Administer and operate the Civil Aviation
Training Center (CATC);
• Operate and maintain national airports, air
navigation and other similar facilities in
compliance to ICAO;
• Perform such other powers and functions
as may be prescribed by law.

R.A No. 9497 otherwise known as Civil Aviation Authority Act of 2008
- Establish and prescribe rules and regulations for the inspection and registration of all
aircraft owned and operated in the Philippines and all air facilities.
- Establish and prescribe the corresponding rules and regulations for the enforcement of
laws governing air transportation.
- Determine, fix and/or prescribe charges and/or rates pertinent to the operation of public
air utility facilities and services.
- Administer and operate the CATC.
- Operate and maintain national airports, air navigation and other similar facilities in
compliance to ICAO.
- Perform such other powers and functions as may be prescribed by law.

PART 2.2.10.5 : Reinstatement Of Privileges Of Expired Amt/Ams Licenses And Ratings


- No person who holds an expired license or rating shall exercise the privileges of the
said license or rating.
- AMT or AMS who seek reinstatement of their licenses that had already expired shall
comply with the following conditions:
(1) Within 24 months from expiration of license, shall pass the test given by the
authority.
(2) After 24 months from expiration of license, shall pass the test given by the
authority and must undergo recurrent training from an approved AMO or any
school or facility accredited by the authority for such purpose.
(3) After 60 months from expiration of license, shall comply with the requirements for
the application for the initial application for AMT/AMS License.

• The applicant for AMT license shall have pass a knowledge test
(1) Air Law and Airworthiness
(2) Natural science and aircraft general knowledge (example : basic mathematics,
theory of physics)
(3) Aircraft engineering (such as characteristics and applications of the materials of
aircraft construction)
(4) Aircraft maintenance (tasks required to ensure the continuing airworthiness of an
aircraft including methods and procedures)
(5) Human performance (and limitations)

2.6.2.7 : Experience Requirements


(a) An applicant for an AMT license and associated ratings may qualify by either practical
experience or through training in an ATO.
(b) Practical experience only. Each applicant for an AMT license and rating(s) relying
solely on practical experience shall provide documentary evidence, acceptable to the
Authority
(c) Approved Training. Each applicant for an AMT license relying on completion of training
in an Approved Training Organization (ATO) shall provide documentary evidence,
acceptable to the Authority.

2.6.3 : Aviation Maintenance Specialist (AMS)


2.6.3.3 : AMS Rating
NOTE : When employed by an AMO, an Aviation Maintenance Specialist (AMS) license
should correspond to the specialty shop or group in which they perform, supervise, or sign
a maintenance release an aeronautical product or aircraft. For example, Hydraulic
component overhaul, landing gear overhaul, special inspections, non-destructive testing,
turbine disc overhaul, etc.

3.1.2.10 : Changes requiring notice to the authprity


• Each ATO shall notify the authority within 30 days of any of the following changes
(1) The Accountable Manager - The “accountable manager” is not specifically
defined under ICAO, but the concept is partially discussed in ICAO Doc. 9642,
Section IV, Chapter 2, as being either the CEO or a high level corporate official who
has financial responsibility for the entire organization. The examples of an
accountable manager are: the CEO, President, Managing Director, Director General,
General Manager, etc.
(2) The Quality Manager
(3) The Instructional Staff
(4) The housing, training facilities and equipment, process, training program and
work scope that could affect the approval.

3.2.3 : Record Keeping


• A certificate holder shall maintain and retain the records for a period of 1 yr after the
completion of training.
• The format of the student training records shall be specified in the Training Manual.
• The ATO shall submit training records and reports as required by the authority.

• Instructors should hold appropriate licenses and ratings.
• An ATO, may provide specialized instructors, who are not licensed in accordance with
Part 2, to teach Mathematics, physics and similar subjects.

instructors.

PART 4.2 : REGISTRATION REQUIREMENTS


4.2.1.1 GENERAL
No person may operate a civil aircraft that is eligible for registration under the laws of
the Republic of the Philippines unless it has been registered by its owner/operator under
the provisions of the laws of the Republic of the Philippines and the Authority has issued a
Certificate of Aircraft Registration for that aircraft which shall be carried aboard that
aircraft for all operations.

4.3 Nationality and Registration Marks


(a) No person may operate a civil aircraft registered in the Republic of the Philippines
unless it displays nationality and registration marks in accordance with the requirements
of this section.

(c) The nationality mark for the Philippine registered aircraft is RP.
(d) The registration mark shall be a combination of letters and numbers assigned by the
Authority.

5.4.1.6 : Effective Dates of a Certificate of Airworthiness


(a) Certificate of airworthiness are effective as follows:
(1) Standard Certificate of Airworthiness, special Certificate of Airworthiness, and
Certificate of Airworthiness issued for restricted or limited category aircraft are
effective for one year.
(2) A special flight permit is effective for the period of time specified in the permit.
(3) An experimental certificate for research and development, showing compliance
with regulations, crew training, or market surveys is effective for 1 year after the date
of issue or renewal unless the Authority prescribes a shorter period.

Summary:
● As an airmen working on the aviation industry, it is necessary that we understand the
regulations stated under PCAR
● When working in our industry, it is important that we apply the regulations stated in
PCAR when we exercise our profession
● PCAR is the basis of the things that we do and will do when working in the aviation
industry here in the Philippines
● PCAR training is necessary for all airmen that are working here in the country
● PCAR is the local aviation regulation of the Philippines which states the law wherein all
