regarding release of detained Gold articles on payment of duty. He travelled by flight no.G9481
dated 07.09.2023 from Sharjah to Ahmedabad. The Gold articles of passenger were detained
by custom officer at SVPI vide D.R. No. 2474 dated 07.09.2023 and the customs officer asked
to passenger about the invoices of gold articles but the passenger could not produce the same
at that time. Therefore, the assessed value of the gold articles were calculated in D.R. by
custom officer as 24Kt. Now, the passenger requested vide above letter to re-calculate amount
of duty of gold articles as 18Kt and he also produced supporting invoices regarding the same.

carried by her in excess to the free allowance available to her as prescribed in the
Baggage Rules 2016 (as amended). The Pax imported the gold in traded quantity and
commercial in nature, which does not constitute a part of bonafide baggage in terms of
Section 77 & 79 of the Customs Act, 1962 and violates the provisions of Baggage Rules, 2016
(as amended) and also the provisions of Foreign Trade Policy 2023. Accordingly, the goods are
liable to be confiscation under Section 111 (m) of the Customs Act, 1962. Which has been
confiscated vide DETENTION/SEIZURE OF PASSENGER’S BAGGAGE (ITC) Sr. No. 795 dtd
19.12.2023.

The detaining officers in DR No 2700 Dated 12.12.2023, at point No. 7 mentioned


that the goods are to be released on payment of duty along with RF and PP or Re-
exported out of India on payment of RF and PP. The pax opted for Re-export out of India
on payment of RF and PP.

In view of the above facts, the Deputy/Assistant Commissioner, allowed the passenger
an option to pay a fine of Rs.2,88,610/- in lieu of confiscation under Section 125 of the
Customs Act, 1962 and imposed a personal penalty of Rs. 50,795/- under Section 112 of the
Customs Act, 1962.
The passenger agreed with the fine and penalty and paid the same vide DDR No. 38722
