1. Ld. Counsel for plaintiff accepts notice of the captioned


IA and submits that he does not wish to file any reply to
the same and has no objection if the same is allowed.
2. Heard. For the reasons stated in the application and in
view of the above submissions, delay in filing written

4. It is submitted that the matter is coming up for hearing
before the Hon’ble Court on 17.01.2024.
5. As per office noting, written statement and affidavit of
admission/denial of documents were filed by defendant
no.1 vide diary no.1911761 dated 13.10.2023. Same has
been taken up today in view of order passed today while
disposing off IA No.21343/2023.
6. Office noting further shows that documents with list of
documents were also filed on behalf of the defendant no.1
vide diary no.1914244 dated 14.10.2023.
7. Office noting further shows that replication and affidavit
of admission/denial were filed by plaintiff qua defendant
no.1 vide diary no.2006761 dated 03.11.2023.
8. Pleadings qua defendant no.1 are complete.
9. Ld. Counsel for defendant no.3 enters appearance and
accept summons of the suit and submits that he has not
received complete copy of plaint and documents. Ld.
Counsel for plaintiff has submitted that he will supply the
copies within one week from today. Let same be supplied
accordingly.
10. After receiving complete copy of plaint and documents,
the defendant no.3 may file written statement alongwith
affidavit of admission/denial of documents within 30
days with advance copy to the opposite party, who may
file replication and affidavit of admission/denial within
30 days thereafter.

11. At request, issue summons of the suit to the defendants
no.2, 4 and 5 through all permissible modes for next date
of hearing.
12. The defendants no.2, 4 and 5 shall file written statement
alongwith affidavit of admission/denial of documents
within 30 days from the date of service with advance
copy to the plaintiff, who may file replication, rejoinder
and affidavit of admission/denial of documents within 30
days thereafter.
13. Re-notify the present matter for completion of service,
completion of pleadings and further proceedings on 11th
January, 2024.
