Prison near Baghdad. The detainee was Manadal Al-Jamaidi,1 who (b)(7)(c)
was captured by Navy Sea, Air, Land (SEAL) Team 7 (ST-7)

earlier that day. He was transported to the ST-7 compound at (b)(3) NatSecAct
(b)( 1) Baghdad International Airport (BIAP) for battlefield interrogation.

medical examiner ruled Al-Jamaidi's death a homicide.

ST-7 personnel to their compound at BIAP for initial interrogation by
Agency officers. In route to BIAP, Al-Jamaidi was physically abused
by ST-7 personnel, who also posed for unofficial photographs with
. the injured prisoner. Al-Jamaidi was interrogated for ap~:>roximately • ,
one hour at the ST-7 compound before being transportedl~~~~-~(b)(1)

I Upon arrival at the prison, NatSecAct

request of the Agency interrogator, Al-Jamaidi was secured by
handcuffs to a barred window for interrogation. Al-Jamaidi died
approximatelyune hour later while being interrogated. An autopsy
determined the death resulted from blunt force injuries to the torso
complicated by compromised respiration .. The deputy medical
examiner ruled the death a homicide.

the interrogation exacerbated his otherwise serious but non-life-
threatening internal injuries and compromised his breathing.

9 January 2004. Specifically, the deputy medical examiner wrote in
his Opinion:

E<'ternal injuries ar~ consistent ,with injuries sust~ined dµring


apprehension. Ligature injuries are. preser1t 011-the wrists and
ankles. Fractures of the ribs and a contusion of the left lung imply
significant blunt force injuries of the thorax and likely resulted in
impaired respiration. According to investigating agents, interviews
taken·from individuals present at the prison during the
interrogation indkate that a hood made of synthetic material was
placed over the head and neck of the detainee.IS This likely
resulted in further compromise of effective respiratio11. Mr. Al-
Ja;rnaidi was not m,1der t~e influence of drugs of abuse or ethanol at
the time of death. The cause of death is blunt force injuries of the
tor_so complicated by compromised respiration. The manner of
death is homicide.

175. (U) Federal criminal laws. Four provisions of Title 18


U.S.C., Crimes and Criminal Procedure, could apply to the actions of
CIA officers in this case. Title 18 U.S.C. §1112, Manslaughter,
provides:

Manslaughter is the unlawful killing of a human being without


malice. . . . Involuntary-In the commission of an unlawful act not
amounting to a felony, or in the commission in an unlawful
manner, or without due caution and circumspection, of a lawful act
which might produce death .... Whoever is guilty of involuntary
manslaughter, shall be fined under this title or imprisoned not
more than six years, or both; . . . •

Title 18 U.S.C_. §1001, Statements or entries generally, provides:

[W]hoever, in any matter w!thin the jurisdiction of the executive,


legislative, or judicial branch of the Government of the United
States, knowingly and willfully-(1) falsifies, conceals, or covers up
by any trick, scheme, or device a material fact; (2) makes any
materially false, fictitious, or fraudulent statement or
representation ... shall be fined under this title or imprisoned not
more than 5 years, or both.

Title 18 U.S.C. §1519, Destruction, alteration, or falsification of records in


Federal investigations and bankruptcy, provides:

Whoever knowingly alters, destroys, mutilates, conceals, covers up,


falsifies, or makes a false entry in any record, document, or tangible
object with the intent to impede, obstruct, or influence the
investigation or proper administration of any matter within the
jurisdiction of any department or agency of the United States or

Standards for Employee Accountability provides:

a. Consequences will follow an employee's failure to comply with
